SUBJECT: ORDINANCE TO INCREASE THE CRIMINAL JUSTICE ADMINISTRATIVE
(BOOKING) FEE
Specific Request(s) or Recommendation(s) & Background & Justification
RECOMMENDATIONS :
1 . ACCEPT report from the County Administrator summarizing actions taken by
the Board at the May 14, 1996 hearing on the proposed increase to the
criminal justice administrative (booking) fee and the status of
discussions with arresting agencies on concerns regarding the booking
fee and process .
2 . ADOPT ordinance increasing the criminal justice administrative (booking)
fee to $145 . (Adoption of the ordinance does not preclude the
negotiation of a reduced booking fee, if warranted. )
FISCAL IMPACT:
It is anticipated that as a result of the amended ordinance, including a
revised fee amount, booking fee revenues may increase by $50, 000 based on the
current level of booking activity. Negotiation of any reduced fee would
result in a reduction of potential new revenue.
REASONS FOR RECOMMENDATION/BACKGROUND:
On January 22, 1991, the Board adopted an ordinance establishing a criminal
justice administrative (booking) fee as authorized by Chapter 29550 of the
Government Code. Government Code Section 29550 was amended effective
January 1, 1994 by Statutes of 1993, Chapter 882 (AB 2286-Pringle) . AB 2286
redefined costs recoverable through a booking fee and described the types of
bookings for which costs may be charged. Government Code Section 29550 was
further amended effective January 1, 1996 by Statutes of 1995, Chapter 910
(AB 82-Pringle) . AB 82 requires that any increase in the jail booking fee be
adopted prior to the beginning of the fiscal year in which it will take
effect and requires 'a 45-day written notice of a public hearing.

On May 14, 1996, a new ordinance was introduced at a public hearing
reflecting the new, recalculated booking fee of $145 . The jail booking fee
has not been adjusted to reflect changes in operations, staff or costs since
June 1, 1994, when it was increased from $127 to $137 . Written and oral
testimony on the proposed fee increase was received at the hearing, and
findings were adopted. In recognition of the strict deadlines related to the
effective date of the ordinance, the Board also adopted the new fee rate and
revisions to the booking fee regulations which set forth the procedures by
which fees will be charged and collected in Contra Costa County.
Further, the Board directed the County Administrator to meet with arresting
agencies that expressed concerns over the booking fee and/or process and
which requested to negotiate booking fees pursuant to Government Code section
29550(a) ( 3) , and report back on the status of those discussions . This office
has contacted the Chief of the Richmond Police Department, who identified
himself as representing member agencies of the Police Chiefs ' Association, to
arrange a meeting to discuss arresting agencies ' concerns regarding the
booking fee and/or process . The date for the meeting was set for May 20,
1996 .

The Contra Costa Coun.y Board of Supervisors ordains as follows:
SECTION I. PURPOSE AND AUTHORITY. This ordinance amends uncodified County
Ordinance 94-24 by amending Section III to increase the amount of the criminal justice
administrative fee, in accordance with the provisions of Government Code section 29550
as amended by Statutes of 1993, Chapter 882, Section 1 (AB 2286) and Statutes of 1995,
Chapter 910 (AB 82), which provides for criminal justice administrative (booking) fees.
SECTION II. Section III of County Ordinance 94-24 is amended, to increase the criminal
justice administrative (booking) fee from one hundred thirty seven ($137.00) dollars to one
hundred forty five ($145.00) dollars, to read:
SECTION III. Fee Amount. The amount of the criminal justice administrative
(booking) fee is one hundred forty five ($145.00) dollars.
SECTION III. EFFECTIVE DATE. This ordinance shall become effective 30 days after
passage, and within 15 days of passage shall be published once with the names of the
Supervisors voting for and against it in the Contra Costa Times, a newspaper of general
circulation published in this County.
