SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE the Federal Communications Commission (FCC) Forms 1205 submitted on November 13, 1995 by Century Cable for the annual update of regulated equipment and installation costs. DIRECT Century Cable to revise their next annual filing to adjust the rate for new unwired homes in accordance with the letter from Rich Sander dated April 29, 1996 in reply to Assumption 4. � DIRECT Century Cable to provide information to the Cable TV Administrator that indicates to customers their universal remote options and describes the accounting mechanism used to assure that charges are removed from customer bills when the remote is paid. FINANCIAL IMPACT: None BACKGROUND: On or about November 13, 1995, Century Cable submitted Federal Communications Commission (FCC) Form 1205 to the Cable TV Administrator for review by the County (certified to regulate the basic service tier rates in August,1993). The review time for the FCC Form 1205 was tolled by the Board of Supervisors for ninety (90) days pursuant to Section 76.933(b) of the FCC rate re ulations. ATTESTED Contact: PHIL BATCHLOIJOLERK OF THE BOARD OF cc: Viacom Cablevision (Pinole) SUPERVISORS AND COUNTY ADMINISTRATOR ,David Schmidt, County Counsel's Office Cable N Administrator BY DEPUTY Since additional time was needed to complete the review, the Board of Supervisors adopted resolutions directing Century to keep certain accounting records of amounts received from these rates pursuant to section 76.933(c) of the FCC rules. After completing the review, staff determined that Century had calculated the equipment and installation rates consistent with established FCC guidelines, and that there was no refund liability for the period covered by the FCC Forms 1205 (Effective December,1995). However, Jay Smith of Public Knowledge upon completion of his review, raised questions about the calculation of the installation rate for new unwired home customers and the process used to notify and account for payments on the "lease purchase" of Century's universal remote. Century agreed that revisions to the calculation of the installation rate for new unwired home could be made in the next annual filing. Staff recommends that the Board approve the FCC Forms 1205 submitted by Century Cable and direct them to revise their next annual filing and provide staff information requested on universal remotes. -2-
