Yancey District Attorney Contra o' a nlNtuh Costa DATE: May 9, 1996 '' County SUBJECT: Approval of Personal Services Jobsharing Contract with Susan Cook for Prosecution Services for the Period July 1,1996 through June ,30, 1998 SPECIFIC REQUEST(S)OR RECOMMENDATIONS&BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION Authorize the District Attorney to sign a personal services contract, and any amendments or modifications thereof, with Susan Cook for the amount for $ 83,341 for the period July 1, 1996 through June 30, 1998 for prosecution services (budgeted). II. FINANCIAL IMPACT None. Approval of this jobsharing contract and filling the position behind it with a fixed term results in no added County cost. III. REASONS FOR RECOMMENDATION/BACKGROUND Consistent with Board guidance, the District Attorney has created a program for attorneys which permits attorneys to jobshare half-time and provides the Office with additional attorneys without added cost or positions created by the Board of Supervisors for the term of the contract. Under this innovative program,participating attorneys resign their positions for two years and are then rehired under the County's existing reemployment provisions. During the participation period, a fixed term attorney is hired into the deputy's vacated position. After the end of participation period, it is anticipated that at least one attorney will want to participate in the program, and the contracted attorney will be rehired into his/her position. In the event that no other attorneys want to participate at that time, a fixed term position will be left vacant for the deputy's rehire. The participating attorney has agreed to the terms of the program and is eagerly awaiting the the opportunity for the jobsharing contract to begin. CONSEQUENCES OF NEGATIVE ACTION Failure to approve the contract will make it impractical for the District Attorney's Office to offer a jobsharing program to the attorney. In this case, the new mother would be forced to choose between leaving her newborn after the period of family leave to return to full-time employment or to terminate her County employment, depriving the District Attorney's Office of the expertise of a valuable long-time employee.
