APPOINT to Business Seat #1 on the Hazardous Materials Commission for the balance of an unexpired term ending December 31, 1996, on the recommendation of the Council of Industries: Jimmy J. Rodgers Environmental Health & Safety Manager Chevron Chemical Company 940 Hensley Street Richmond, CA 94804 2. AUTHORIZE staff to write to the Contra Costa Mayors' Conference, asking that they consider the appointment of a representative to the city seat on the Hazardous Materials Commission presently held by Pinole Mayor Maria Alegria, the term of office for which expired December 31, 1995, for a new four-year term ending December 31, 1999. 3. DIRECT staff to the Hazardous Materials Commission to determine whether the current incumbent of the Labor Seat, Pam Aguilar, wishes to be reappointed. If so, indicate the Board's intent to reappoint her for a new four year term ending December 31, 1999, upon being advised of that fact. If Ms. Aguilar does not wish to be reappointed, DIRECT staff to the Hazardous Materials Commission to obtain the name of another nominee from the Central Labor Council and forward that nomination to the Board of Supervisors for appointment action. In either case, action by the Board to confirm the appointment is required. 5. DIRECT staff to the Hazardous Materials Commission to advertise for the General Public vacancy on the Hazardous Materials Commission and return all applications to the Internal Operations Committee for further consideration. 6. DETERMINE whether to appoint a member of the Board of Supervisors to the Board's seat on the Hazardous Materials Commission for the balance of a four-year term ending December 31, 1998. BACKGROUND: Several seats on the Hazardous Materials Commission are vacant. The Council of Industries of West Contra Costa County has nominated Jimmy J. Rodgers to be the business representative from West County and we concur with that nomination. Likewise, Henry Clark has represented the West Toxics Coalition on the Commission since 1993 and is interested in being reappointed. We concur and recommend his reappointment. There has been confusion about when the terms of office of some of the seats on the Commission expire. The Clerk of the Board's records indicate that the term of office of the city seat occupied by Mayor Alegria expired December 31, 1995. We are, therefore, recommending that the Mayors' Conference be requested to make an appointment- either reappointing Mayor Alegria for a new four-year term or selecting a new representative. Likewise, the Clerk of the Board's records indicate that the term of office of the labor seat expired December 31, 1995. We are prepared to recommend the reappointment of Pam Aguilar if she wishes to be reappointed. If she does not wish to be reappointed, we are asking that the Central Labor Council recommend a nominee for this seat. The Public Member seat is vacant with the resignation of Paul DeFalco. We are recommending that a full public recruitment be undertaken for this seat and that the applications be returned to our Committee for further consideration. The Board of Supervisors has historically had 'a representative on the Commission. No Board member asked to be appointed to this seat in 1996. We are again raising the need to select a member of the Board of Supervisors who is interested in being appointed to the Commission. - 2 - CHEVRON CHEM TEL No .
