SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize a one-year extension of the Final Development Plan to expire on March 18 , 1997 . FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS In August, 1989 the Danville Town Council and Board of Supervisors entered into a Memorandum of Agreement (MOA) to undertake a joint- jurisdiction General Plan and project review for the Alamo Springs project involving a 148-acre site (known as the Del Chase property) straddling the boundary of the Town of Danville and the County in the Alamo area. The Alamo Springs Plan review was initiated at the request of the property owner, New West Federal Savings & Loan/American Real Estate Group. In December, 1992 , after the matter was jointly reviewed by the Danville Planning Commission and the San Ramon Valley Regional Planning Commission, the Board of Supervisors approved the project (including Final Development Plan #3003-90) for a maximum of 59 lots, one lot more than was later approved by the Danville Town Council. The unincorporated portion of the property ; was simultaneously rezoned to the Planned Unit District. DEPUTY .. y 2 To reconcile the differences in the site plan approval between the two bodies, New West filed an application, File #3006-93 , to amend the County Final Development Plan approval to make it consistent with the Town of Danville's approval including a reduction of one lot and parallel revisions to the approved vesting tentative map. The amendment application was approved by the Zoning Administrator. EXTENSION OF FILING PERIOD FOR P-1 PROJECTS The filing period for initiating project construction is one year from the effective date (March 18, 1993) of the approved Amended Final Development Plan (FDP) . The Board of Supervisors is authorized to grant extensions of the Filing Period by Sub-Section 84-66. 1602 (2) (c) of the Zoning code (Planned Unit Ordinance) . Upon showing of good cause, the Board may authorize up to five extensions, each extension not exceeding a year in time. On June 27, 1995 the Board granted a second request for a one-year extension of the final development plan to expire on March 18 , 1996 . NEW OWNER AND REQUEST FOR THIRD ONE-YEAR EXTENSION The property was acquired by Corrie Development Corporation in 1994 . In a letter dated March 4 , 1996 the owner is requesting a third one-year extension. NEW APPLICATION FOR AMENDMENT OF THE FINAL DEVELOPMENT PLAN On May 14 , 1995 a new application was filed with the new owner to amend the Alamo Springs Final Development Plan. The applicant is seeking a revised site plan that would reduce the number of lots from 58 to 53 . A similar application has been filed with the Town of Danville for joint processing with the County. The application is currently being reviewed for CEQA compliance. In staff's judgment, the applicant has shown adequate cause to justify the requested extension. DJC/aa BDIV/3006-93 .DJC
