RESOLUTION NO. 96/139
SUBJECT: Approval of the Final Map, Subdivision Agreement, Road Improvement Agreement
and three Right of Way Landscaping Agreements for Subdivision 7629, Discovery
Bay Area.
The following documents were presented for Board approval this date:
The Final Map of Subdivision 7629, property located in the Discovery Bay area, said map
having been certified by the proper officials.
A Subdivision Agreement with New Discovery, Inc., subdivider, whereby said subdivider
agrees to complete all improvements as required in said Subdivision Agreement within one year from
the date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the completion of road and drainage improvements as required
by Title 9 of the County Ordinance Code, as follows:
A. Cash deposit(Auditor's Deposit Permit No. 275320, dated March 20, 1996)
in the amount of$3,400 made by New Discovery, Inc.
B. Additional security in the form of a corporate surety bond dated April 2,
1996, and issued by The American Insurance Company (Bond No.
11133238151) with New Discovery, Inc. as principal, in'the amount of
$336,100 for faithful performance and $169,700 for labor and materials.
II. Letter from the County Tax Collector stating that there are no unpaid County taxes
heretofore levied on the property included in said map and that the 1995-96 tax lien has been
paid in full and the 1996-97 tax lien, which became a lien on the first day of March, 1996, is
estimated to be $9,900.
III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance
Code, in the form of a surety bond, No. 11127305214, issued by The American Insurance
Company with New Discovery, Inc. as principal, in the amount of$9,900 guaranteeing the
payment of the estimated tax;
A Road Improvement Agreement with New Discovery, Inc., subdivider, whereby said
subdivider agrees to complete all improvements as required in said Road Improvement Agreement
within one year from the date of said agreement. Improvements Consist of the construction of a
traffic signal at Discovery Bay Boulevard and State Route 4.
Said documents were accompanied by:
I. Security to guarantee the completion of the traffic signal improvements as required
by Title 9 of the County Ordinance Code, as follows:
A. Cash deposit(Auditor's Deposit Permit No. 275320, dated March 20, 1996)
in the amount of$1,500 made by New Discovery Bay.
B. Additional security in the form of a corporate surety bond dated April 2,
1996, and issued by The American Insurance Company (Bond No.
11133238151) with New Discovery, Inc. as principal, in the amount of
$150,000 for faithful performance and $75,000 for labor and materials.
A Right of Way Landscaping Agreement for the State Route 4 Landscaping with New
Discovery,Inc., subdivider,whereby said subdivider agrees to complete all improvements as required
in said Right of Way Landscaping Agreement within one year from the date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the completion of the Right of Way Landscaping improvements
as required by Title 9 of the County Ordinance Code, as follows:
A. Security in the form of a corporate surety bond dated April 2, 1996, and
issued by The American Insurance Company (Bond No. 11141577319) with
New Discovery, Inc. as principal, in the amount of $75,919 for faithful
performance and $37,960 for labor and materials (for Highway 4 frontage).
A second Right of Way Landscaping Agreement for the Clipper Drive Frontage Landscaping
with New Discovery,Inc., subdivider, whereby said subdivider agrees to complete all improvements
as required in said Subdivision Agreement within one year from the date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the completion of the Right of Way Landscaping improvements
as required by Title 9 of the County Ordinance Code, as follows:
A. Security in the form of a corporate surety bond dated April 2, 1996, and
issued by The American Insurance Company (Bond No. 11133238169)with
New Discovery, Inc. as principal, in the amount of $29,763 for faithful
performance and $14,882 for labor and materials(for Clipper Drive frontage).
A third Right of Way Landscaping Agreement for the installation of playground equipment
within the Clipper Drive Frontage with New Discovery, Inc., subdivider, whereby said subdivider
agrees to complete all improvements as required in said Subdivision Agreement within one year from
the date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the completion of the Right of Way Landscaping improvements
as required by Title 9 of the County Ordinance Code, as follows:
A. Cash desposit(Auditor's Deposit Permit No. 275528, dated March 25, 1996)
in the amount of $14,832.23 ($9,888.15 for faithful performance and
$4,944.08 for labor and materials) made by New Discovery, Inc.
NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions
for its design and improvement, is DETERMINED to be consistent with the County's general and
specific plans.
BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not
accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as
dedicated to public use.
BE IT FURTHER RESOLVED that said Subdivision Agreement, Road Improvement
Agreement and three Right of Way Landscaping Agreements are also APPROVED.
