REQUEST the West Contra Costa Integrated Waste Management Authority to approve release of transition surcharge reserve fund amount and interest collected from unincorporated County ratepayers in West County and AUTHORIZE said funds to be used to reduce the waste collection rate over a period of twelve months. 2. ACCEPT Richmond Sanitary Service offer to extend the repayment period of retroactive amount due RSS from four years to ten years with no additional interest. 3. APPROVE reduction of solid waste collection rate amount by $1.81 per can for a twelve month period (subject to the above reimbursement and retroactive repayment actions). 4. AUTHORIZE the Director of GMEDA to take any ministerial actions necessary to effectuate the above rate reduction. FISCAL IMPACT: With reserves returned, there are no readily available funds to respond to emergent demands. BACKGROUND/REASONS FOR RECOMMENDATIONS: The Ad Hoc Solid Waste Committee recommends the above actions following their meeting on March 28, 1996 where a request by Supervisor Rogers was considered. The background for this item is attached. The reduction is proposed to come from two sources. One is to double the length of time that repayment will take place to Richmond Sanitary Service (RSS) for previously deferred costs. The other will be to return the reserve that has accumulated in the County's account. To extend repayment of money owed RSS can reduce current rates by 87¢ per can, but will extend the charge from four years to ten years. Return of the reserves will provide a rate decrease of 94¢ per can for one year, but will eliminate the $113,000 reserves. As the Integrated Resource Recycling Facility (IRRF) has come on-line in West County, the cost of refuse collection and disposal has increased substantially. Most jurisdictions are scrambling to meet the objections of ratepayers. The rates in West County are among the highest in Contra Costa. Each jurisdiction is attempting to negotiate with RSS to reduce rates. In some cases, this has meant-some reduction in service. The single issue regarding return of the reserves is that some amount should remain in the event of an unexpected cost, such as the County may elect to perform any studies or reviews of rates in the future years. Based on information from the Authority, RSS may request an increase in rates and there is concern on the part of other public agencies that a rate review is warranted. If the County participate in this rate review, its share would be between $20-35,000. The County doesn't have any reserves; the funds would have to come from the General Fund or fromm-a-,rate increase or the County would have to pass on participation. Based on this, retention of some amount of the reserves appears prudent, but it is up to the Solid Waste Committee and the Board to determine how much or whether the pressing need for rate relief should override opportunities for future study funding. CRSS-)have entered into an exclusive collection franchise agreement dated July 1, 1986, as amended an Jamiary 24, 1.994 ("Franchise Agreement"); and W.EMMAS, Section 8.12.090 of the San Pablo Amicipal Code allows the City Councfl to adjust garbage Collection rates by resolution followed by muural agreement with the contractor. The Franchise Agreement with RSS contains essentially the same provision;and WHEREAS, City Resolution 92-108 authorized a rate for collection of one 32 gallon garbage can of$18.00 per can per month,of additional cans at$16.24 per can per month, and of mini-cans at$15.00,effective July 1, 1993. In addition to these base rates, a transition surcharge of $2.02 per receptacle has been authorized by City Resolution 95-61 on bebalf of the West Contra Costa lutegrated Waste Management_Authozity C"Authorit,/), meaning that in 1995 residential customers in San Pablo with one can were pay'mg a total of$20.02 per can per month; and WIM£AS, the Franchise Agreement between the City and RSS requires that collection rates established by the Authority related to the West County Integrated Resource Recoveay Facility ("ERRF") be collected from ratepayers served under the Agreement.Tie Authority has approved rates to be charged at the IRRTr, and has established EW-related conecfion rates of$7.33/month per 32-gallon can equivalent for the period January 1, 1996 through.December 31, 1996; and WHEREAS, effective January 1, 1996,therefore,RSS has been collecting$22.26 per can from San Pablo residential customers,reflecting the increased RW rates minis a voluntary reduction by RSS for business reasons and to account for certain costs in. the collection rates previously approved by the City which are aLso included in MRF-related collection rates. RSS has advised that those costs total 54.19/month per 32-gallon can, exclusive of any MS profit margin; and WHEREAS, discussions were therefore had with RSS about reducing the collection rate. Agreement was reached to reduce the rate from 52226(a 52.24 increase from last year),to $19.80 (a$.22 reduction from last year). This rate includes the$733 MRF fee. Section 2 of Resolution 92-108 is amended to the extent inconsistent herewith: 3. Sections 133 and 2B of Resolution 92-108 are hereby deleted. 4. In the event that RSS has already mailed out billwg_,s without such adjustments, RSS shall make Wopriate adjustments in the uext bffmg cycle to i=ure that the lower rates are implemented as of January 1, 1996. 5. The City Council of the City of San Pablo declares its strong support for the'West Contra Costa Integrated Waste Ivfaaagemerl Authonty as the most cost effective meas for complying with State law requiring reductiou in waste disposal,addressing solid waste and recycling matters on a coordinated regional basis, and for providing oversight and regulation of the UMF. 6. It is the intent of the City Council tial the assistance of the Authority be obtained in evalrmting cbzages in solid waste and recyclable collection seances to be proposed by RSS. The City Manager is hereby authorized to take all actions necessary to secure the assistance of the Authority. . RSS is directed to give complete cooperation to,andtimely response to any inquiries made by the City or Authority in any analysis undertaken regarding San Pablo rates. Table 1 attached lists the data used to plot the charts and Table 2 attached is an explanation of terms. Please'recall that I previously provided the same information for rates as billed January 1, 1996 by my memo dated February 7, 1996. Since that time changes have occurred in residential rates for the Cities of Richmond, San Pablo and Hercules. El Cerrito, Pinole and Contra Costa County have not changed since the February 7th memo. The attached incorporates the updated rates which are understood to be effective as of the dates shown on Table 1. . The attached charts do not show a significantly different picture from the charts provided by my February 7th memo. I am proposing that your committee and the Board approve a reduction of$L81 per can for the West County unincorporated residents served by RSS. The$1.81 reduction is composed of two pa,t;: FSS has agreed to delay the repayment of money owed to RSS by the ratepayers. Instead of repayment being made over a four year period,RSS has agreed to be repaid over a 10 year period, with no additional interest being added. This accounts for S.87 per can per month rPductlon. The other part of the$1.81 reduction is a reduction of$.94 per can Per aronth f,)r a one year period due to returning to the ratepayers the$113,000 which is in t=,je Ji A's account. This is money which was collected from the ratepayers to pay for the new!Rr" transfer station,but was not used. A single can is currently $23.08. TOTAL SAVINGS $ 2.46 To my understanding, unincorporated County already eliminated the subsidized bulky pickup East of 1-80, but not West of 1-80, so some movement is possible there. (#1 ) Our retroactivity rate is approximately $1.70 per month. Ten cents of it will be paid off within a year, the remainder has a four-year life that could possibly be extended for another six years. RSS is working on the potential savings. (#2) We have already converted two communitywide cleanups. (#3) -_We_have already equalized the charge for multiple and single cans. (#4) There is no unincorporated commercial adjustment due to lack of commercial base within the unincorporated area. (#5) We also have a reserve of $113,000 which could represent a subsidy of $1 .00 per can over a period of one year. It should be noted that this would deplete the reserve,-and any desired study or emergency would require an increase in rates.
