RECOMMENDATION:
APPROVE the Side Letter with the Contra Costa County Employees' Association, Local No. 1
allowing for the continuation of safety retirement benefits for Probation Department employees
in exchange for a two percent reduction in prospective pay equity salary adjustments and ratify
Leslie Knight's (Director of Human Resources) signing of the Side Letter on behalf of the County
BACKGROUND:
In 1989, a number of employees of the Probation Department who were members of Local No.
1 sought safety membership in the retirement system. At that time, the law provided authority
for the County to offer safety retirement to certain Probation Department employees, but did not
allow the County to require the affected employees to pay all or a part of the increased employer
costs that could result from participation in the Safety Retirement Program. In 1990, the
Legislature amended Government Code Section 31639.9 and authorized the Board of Supervisors
to meet and confer with recognized employee organizations to allow certain Probation Department
employees to become safety members of the retirement system, including authorizing employees
to pay all or part of the employer's increased retirement contributions resulting from the
employees becoming safety retirement members. On January 8, 1991, the Board of Supervisors
by resolution, made the provisions of Section 31639.9 effective in Contra Costa County.
On November 14, 1989, in anticipation of the amendment to Government Code Section 31639.9,
the Board approved a side letter with Local No. 1 regarding the possible extension of safety
retirement membership for eligible Probation Department employees represented by Local No.
1. On December 14, 1989, the same provisions were extended to eligible management employees
in the Probation Department. The agreement provided a one-time election into the safety
retirement system for eligible Probation Department employees on the condition that the additional
costs of safety membership would be borne by the participating employees. The County recovered
the costs through payroll deductions for each employee whose safety membership costs exceeded

In July 1993, a transfer of surplus earnings to the County by the County Retirement Association
resulted in an unexpected increase in the monthly retirement charge for some Probation
Department safety members.
The County and Contra Costa County Employees Association, Local No.1 have reached an
agreement that provides for the County paying the employer's share of safety retirement effective
October 1, 1995, as determined by the Board of Retirement for Probation Unit employees in the
following classes: Deputy Probation Officer I, Deputy Probation Officer II, Deputy Probation
Officer III, Probation Counselor I, Probation Counselor 11, and Probation Counselor 111. In return
for the County paying the employer's share of safety retirement, Contra Costa County Employees
Association, Local #1, on behalf of the employees in the above classifications, agrees to a 2%
reduction in pay equity for those classes listed in the attached Side Letter dated March 21, 1996,
that are below the regression line, as shown in Exhibit A of Resolution No. 93/71. NOW
THEREFORE:
The Contra Costa County Board of Supervisors in its capacity as governing Board of the County
of Contra Costa, and all districts of which it is the ex-officio governing Board, RESOLVES
THAT:
The attached Side Letter between the County and Contra Costa County Employees Association,
Local No.1, dated March 21, 1996.is approved and adopted.

The settlement of outstanding pay equity and safety retirement issues is described below.
This confirms our agreement reached by the parties regarding safety retirement for Probation Unit
employees in the Probation Department in the classes listed in Table A.

Effective October 1, 1995 the County,will pay the employer's share of safety retirement as
determined by the Board of Retirement for employees in the above classifications.
Contra Costa County Employees Association, Local #1, on behalf of the employees in the above
classifications, agrees to the following:
(1) For those classes listed in Table A which have not achieved pay equity, as shown in
Exhibit A of Resolution No. 93/71, the amount that the salaries are below the regression
line, as determined by the Pay Equity Study (Table A, Col. 2), shall be reduced by 2%

• as shown in Table A, Col.3. For example; Probation Counselor I is currently 8.95%
below the regression line for Pay Equity purposes. The total percent amount below the
line will be adjusted to 6.95%
(2) The 2% reduction in the amount that the salaries are below the regression line shall be
achieved by the employees in the job classifications listed in Table A foregoing future Pay
Equity. adjustments until the above 2% reduction has been attained. For example,
employees in the class of Probation Counselor I will not receive the next 2% in Pay Equity
adjustments provided to other eligible classes. Thereafter, they will receive 6.95% in Pay
Equity adjustments in accordance with the provisions of the Pay Equity Master Agreement
between the County and Local #l.
