AYES: Rogers, Smith, DeSaulnier, Torlakson NOES: ABSENT: Bishop ABSTAIN: SUBJECT: Existing Litigation: The People of the State of California v. Gayle Bishop, CCC Sup. Ct. #960519-7 The matter of Supervisor Gayle Bishop's request that the County provide for her - defense in the above entitled proceeding pursuant to Government Code section 995.8, having come before the Board for discussion in closed session with legal counsel; IT IS BY THE BOARD ORDERED: 1. The Board having considered the request of Supervisor Bishop that the County provide under Government Code section 995.8 for the defense of an accusation against her under Government Code section 3060, 2. Section 995.8 requiring as a condition precedent to such defense that the Board find: a) That the accusation proceeding is brought on account of acts or omissions in the scope of her employment as a county supervisor; and b) That the defense of Supervisor Bishop by the County would be in the best interests of the County and that Supervisor Bishop acted, or failed to act 'in good faith, without actual malice, and in the apparent interests of the County, 3. The accusation charging twelve counts of willful misconduct in office, 4. The Board being unable as to all counts to make the findings required by section 995.8, 5. The request that the County provide for Supervisor Bishop's defense pursuant to section 995.8 is not sufficiently supported by the evidence presented and is therefore denied at this time. I hereby certify that the foregoing is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
