SUBJECT: Ratification of the Zoning Administrator's Decision Regarding Shell Oil
Company's Compliance with Conditions of Approval (LUP 2009-92)

RECOMMENDATIONS
1 . Ratify. the Zoning Administrator' s decision that Shell Oil
Company has complied with Condition of Approval #22 for the
Heavy Gasoline Hydrotreater, the Vent Gas Treater, the Caustic
Regenerator Unit No. 2 and the Distillate Hydrotreater.
2 . Ratify the Zoning Administrator' s decision that Shell Oil
Company has complied with Condition of Approval #35.A for the
Coke Handling Facility.

None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
When the Board of Supervisors approved the Land Use Permit for
Shell Oil Company's Clean Fuels Project (County LUP 42009-92) , the
Board specified that the Zoning Administrator' s decision regarding
several conditions of approval be placed on the Boar s nsent

calendar for ratification. As directed by the Board at the October
4, 1994 meeting, the County Zoning Administrator decisions
discussed herein have been placed on the Zoning Administrator' s
agenda for April 15, 1996. Any comments received at the meeting
will be forwarded to the Board.
Conditions of Approval #35.A: Noise Calculations
This condition requires Shell Oil Company to submit noise level
calculations which demonstrate that the project units will comply
with the noise performance standard of 77 dBA when measured five
feet above the ground and 100 feet from the equipment. This noise
performance standard assures that the project will not increase
noise levels at the nearby residences .
Shell Oil Company submitted noise calculations for the Coke
Handling Facility. As required by the land use permit, the report
was prepared by an individual who is a member of the Institute of
Noise Control Engineering and who has at least five years
experience in noise control engineering (33 years experience
cited) .
Condition of Approval #22 : Hazard and Operability Study
This condition requires Shell Oil to prepare a Hazard and
Operability Study and accident consequence analysis for all
elements of the Clean Fuels Project with the exception of the
office building, the control rooms and the maintenance/warehouse
buildings .
Shell Oil Company completed the required study for the Heavy
Gasoline Hydrotreater, the Vent Gas Treater, the Caustic
Regenerator Unit No.2 and the Distillate Hydrotreater. This
information was evaluated by the Risk Management and Prevention
Program Team of the Health Services Department. Their review
included a detailed line-by-line examination of the Hazard and
Operability Studies for these units which includes a review of the
safety system designs and operational and maintenance programs .
The Health Services Department staff has field checked the units,
which are still under construction, to verify that they conform to
the design presented in the Hazard and Operability Studies.

SUBJECT: CONSENT ITEM FOR SHELL REFINERY CLEAN FUELS PROJECT
CONDITION #22, FOR THE:
HEAVY GASOLINE HYDROTREATER,
VENT GAS TREATER,
CAUSTIC REGENERATOR UNIT NO. 2, AND
DISTILLATE HYDROREATER
Executive Summary:
The Contra Costa County Health Services Department (CCCHSD) Hazardous Materials Risk
Management and Prevention Program team has completed the Clean Fuels Project review for the
Heavy Gasoline Hydrotreater (HGHT), Vent Gas Treater (VGT), Caustic Regenerator Unit
No. 2 (CR#2) and the Distillate Hydrotreater (DHT). Shell plans to start-up the HGHT, VGT
and CR#2 about July 1, 1996 and the DHT about October 1, 1996. Shell submitted a summary
of the Hazard and Operability Studies (HAZOP) to you and CCCHSD on July 13, 1995
(HGHT), September 24, 1995 (VGT), July 5, 1995(CR-2) and January 2, 1996 (DHT).
CCCHSD Findings:
My staff has performed a detailed line-by-line examination of the HAZOP studies for these units
that included our reviewing the design of safety systems as well as operational and maintenance
issues. Additionally, my staff has field checked the units, which are still under construction, to
verify that they basically conform to the design presented in the HAZOP.

We find that the Shell HAZOP studies adequately identify process hazards and safeguards, and
that additional engineering or operational controls are not required.
CCCHSD Recommendation:
We recommend your approval of the HAZOP studies for the Heavy Gasoline Hydrotreater, Vent
Gas Treater, Caustic Regenerator Unit No. 2 and the Distillate Hydrotreater in accordance with
Condition 22.
Condition 23:
Prior to start-up my staff will ensure that, consistent with Condition #23, Shell demonstrates to
our satisfaction that the measures detailed in the approved HAZOP studies have been
implemented. We will notify you in writing of our findings so you can seek Board of
Supervisors ratification of compliance with Condition 23.
