ADJUST the terms of office for members of the Fish and Wildlife Committee so that those terms which now expire October 31, 1996 will instead expire February 28, 1997 and those terms of office which now expire October 31, 1997 will instead expire February 28, 1998. 2. REVISE the role of the Fish and Wildlife Committee, as set forth in the Board's Order on this subject dated December 13, 1994, so that the charge will henceforth read as follows: • Advise the Board of Supervisors on fish and wildlife issues that may affect Contra Costa County. • Make recommendations to the Board of Supervisors for the expenditure of funds from the Fish and Wildlife Propagation Fund pursuant to Fish and Game Code Section 13103. • Address issues surrounding the enforcement of fish and game laws and regulations in Contra Costa County. • Consider other issues which may from time to time be referred to the Committee by the Board of Supervisors. AUTHORIZE the Community Development Department to be reimbursed, subject to submitting the necessary appropriation adjustment documents to the Board of Supervisors for approval, from the Fish and Wildlife Propagation Fund for actual and necessary expenses in connection with staffing the Fish and Wildlife Committee, in an amount not to exceed $3,000 per fiscal year, effective July 1, 1996, and in an amount not to exceed $1,250 for the period February 1, 1996 through June 30, 1996 ($250 per month), as is provided for in Fish and Game Code Section 13103 Q). 4. REMOVE this item as a referral to the Internal Operations Committee. BACKGROUND: On February 5, 1996, our Committee authorized the Community Development Department to meet not more than three times with the Fish and Wildlife Committee, help the Committee to get organized, set a regular meeting time, elect officers, review the charge to the Committee and suggest any changes, review the bylaws and suggest any changes which are necessary and make recommendations to your Committee. The County Administrator's Office was asked to provide a report on the available funds for staffing the Fish and Wildlife Committee on an ongoing basis. This request was confirmed by a referral of this subject to our Committee by the Board of Supervisors on February 6,1996. On April 1, 1996, our Committee met with John Kopchik, staff to the Fish and Wildlife Committee and reviewed the attached staff reports from Mr. Kopchik and Mr. Van Marter. On the basis of our review of these staff reports we are prepared to make the above recommendations for action by the Board of Supervisors. We are specifically not recommending that the Board of Supervisors approve the bylaws for the Fish and Wildlife Committee since it then is necessary to have the Board of , Supervisors approve each and every subsequent change to the bylaws. cc: County Administrator Auditor-Controller Community Development Director John Kopchik, Staff, Fish and Wildlife Committee, CDD Tony Enea, Senior Deputy County Administrator -2- i e .10 Contra Costa County Community Development Department Date: March 27, 1996 To: Internal Operations Committee From: ohn Kopchik, Water Agency Planner and staff to the Fish and Wildlife Committee Re: Update on Fish and Wildlife Committee activities and recommendations from the Fish Wildlife Committee regarding its official role, bylaws, and terms of office The Fish and Wildlife Committee(FWC) has held two meetings since the February 5, 1996 meeting of the Internal Operations Committee which established an interim staffing arrangement for the FWC and enabled the FWC to begin its work. Both meetings were extremely productive. Among other things, the FWC established a regular time and place for its meetings (the 2nd Wednesday of every month from 3 to 5 p.m. at the Summit Centre in Martinez), elected officers, reviewed the role assigned to the FWC by the Board of Supervisors, reviewed its bylaws, reviewed and discussed a packet of information on the Brown Act and Better Government Ordinance, discussed staffing, and discussed issues relating to fish and wildlife in an attempt to define goals for future FWC work. A workplan for the FWC will be submitted to the Internal Operations.Committee in the near future. Relative to the issues listed above, the Fish and Wildlife Committee has three recommendations for the Board of Supervisors: • Change the expiration date for current appointments to the FWC from October 31, 1996/1997 to February 28, 1997/1998 so that members may serve their full one or two year terms (the first meeting of the FWC since it was reconstituted in 1994 was February 28, 1996) • Revise the Board-mandated role for the FWC to specify Contra Costa County as the proper geographical scope for the activities of the FWC;a specific recommendation for changing the language of FWC role is attached • Revise the "Procedural Guidelines" or bylaws for the FWC as is recommended in an attachment which contains a set of revised bylaws approved by the FWC on March 13, 1996 (an additional attachment documents the changes which have been made to the previous bylaws) Should any of these recommendations require further explanation, staff will be happy to answer any questions. The role of the Fish and Wildlife Committee shall be to: Advise the Board of Supervisors on fish and wildlife issues that may affect Contra Costa County • Make recommendations to the Board of Supervisors for the expenditure of funds from the Fish and Wildlife Propagation Fund pursuant to Fish and Game Code § 13103 • Address issues surrounding the enforcement of fish and game laws and regulations in Contra Costa County • Consider other issues which may from time to time be referred to the Committee by the Board of Supervisors ARTICLE The Fish and Wildlife Committee will have nine members, one nominated by each member of the Board of Supervisors and four nominated by the Internal Operations Committee. The only exceptions are the initial appointments from the Supervisors of Districts Il, lll, and V plus two at-large seats, which shall expire February 28, 1997. These seats shall expire every two years thereafter. The initial appointments from the Supervisors of Districts I and IV, plus the other two at-large seats, shall expire February 28, 1998 and every two years thereafter. If any member is unable to complete his or her term, the Committee shall notify the Chair of the Board of Supervisors. In consideration of a recommendation from the Fish and Wildlife Committee, an appointment will be made by the Board of Supervisors to complete the term that was vacated. 1 Procedural Guidelines for the FWC as revised by the FWC on March 13, 1996 -7D ARTICLE 11 The Officers of the Committee shall consist of the following: Chair? Secret-a : The Secretary, in coordination with staff, shall: 1. Keep a full and complete record of proceedings of Fish and Wildlife Committee meetings. 2. Maintain an accurate record of attendance at all meetings. 3. Issue all correspondence as authorized by the Fish and Wildlife Committee. ARTICLE III The Fish and Wildlife Committee shall elect officers annually, no later than April 31. The method of election of officers will be left to the discretion of the Committee. ARTICLE IV The Committee shall meet regularly, once each month at a pre-designated meeting place. 2 i .. x.41 •• Procedural Guidelines for the FWC as'revised by the FWC on March 13, 1996 All Special Meetings shall be called at least seven days before such a meeting, at the discretion of the Chair or a majority of the membership. All meetings shall be open to the public. The Committee shall provide to the Board of Supervisors by February of each year a summary of the activities of the previous year and a Work Plan for the upcoming year. ARTICLE V A quorum shall consist of a majority of all members appointed to the Committee and officially serving, one of whom shall be a duly elected officer or, in their absence, a temporary Chair appointed by the members present. Each Committee Member shall have one vote. No action or vote of the committee shall be valid unless approved by a majority of appointed and officially serving members. ARTICLE VI Members of the Committee are required to be diligent and prompt in attendance of meetings. Members shall serve without compensation When a member cannot attend a regular or special meeting, he or she shall notify a Committee member or staff of this fact either verbally or in writing at least 24 hours prior to the meeting time. Three absences from regularly scheduled meetings by a member during any twelve month period shall require the Committee to consider whether to request the Board of Supervisors to declare the,member's office vacant and appoint a new member in his or her place. ARTICLE VII The procedural guidelines may be amended by the Committee by a majority vote at a regular meeting, a quorum being present, provided notice of such amendment has been given at a previous regular meeting and the amendment has been approved:by the Board of Supervisors. Van Mart istant County Administrator SUBJECT: FUNDING AVAILABLE TO.STAFF THE FISH AND WILDLIFE COMMITTEE From the fines and forfeitures imposed pursuant to any violation of the Fish and Game Code, one-half is transmitted to the State. The other half is deposited in a local Fish and Game Propagation Fund. Section 13103 of the Fish and Game Code outlines the purposes for which expenditures may be made from the local Fish and Game Propagation Fund. A copy of Section 10103 is attached. Subdivision Q) reads as follows: Reasonable administrative costs, excluding the costs of audits required by Section 10104, for secretarial service, travel, and postage by the county fish and wildlife commission when authorized by the county board of supervisors. For purposes of this subdivision, "reasonable cost' means an amount which does not exceed 3 percent of the average amount received by the fund during the previous three-year period, or three thousand dollars ($3,000) annually, whichever.Is greater, excluding any funds carried over from a previous fiscal year. As of July 1, 1995, the fund had a balance of $45,300:and revenue of$5,000 was budgeted for the 1995-96 fiscal year. It is clear that at a level of $5,000 a year in new revenue, the 3% figure will never come close to $3,000. We are, therefore, limited to spending $3,000 from the Fish and Game Propagation Fund for the administrative expenses of the Fish and Wildlife Committee.
