BACKGROUND: In the past, the Board of Supervisors has been very supportive of bond measures which propose to sell bonds to construct additional library facilities. In 1995, the Board supported AB 309 (Alpert) which would have placed a $500 million bond measure on the ballot for libraries. AB 309 failed passage in the Assembly Appropriations Committee. Senator Marks has introduced SB 1531 in an effort to try to get additional support to place a somewhat reduced bond measure on the ballot. As introduced, SB 1531 would provide for a grant program for library construction. The bill requires a 35% local match in either cash or the donation of land. The bill provides that it would be submitted to the voters at the November 5, 1996 General Election. I In view of the Board's past support for similar measures, it appears appropriate for the Board to also indicate its support for. SB 1531. . LEGISLATIVE COUNSEL'S DIGEST I. SB 1.531, as introduced, Marks. Public Library Learning. and Literacy Expansion Act of 1996. Existing . law provides, under the California Library Construction and Renovation Bond Act of 1988, for the issuance of $75,000;000 in state general obligation bonds to provide funds for grants to any city, county, city and county, or district for the acquisition, construction, .remodeling, or rehabilitation of facilities for public library services. This bill would enact : the Public Library Learning and Literacy Expansion ansion Act of 1996 which if :adopted b the � p Y voters, would authorize the issuance, pursuant to the State General Obligation. Bond Law, of bonds in the amount of $250,000,000, exclusive of refunding bonds, as specified, for the purpose of financing a. similar library construction and renovation program. The bill would, among other :things, authorize the use of proceeds from those bonds to fund certain project,applications that were submitted under the California i E. 99 c1q SB 1531 — 2 — Library Construction and Renovation Bond Act of 1988, but did not receive funding under that act. This bill would provide for the submission of the bond act to the voters at the November 5, 1996, general election in accordance with specified law. The people of the State of California do enact as follows. 1 SECTION 1. Chapter 12 (commencing with Section 2 19985) is added to Part 11 of the Education Code, to read: 3 4 CHAPTER 12. PUBLIC LIBRARY LEARNING AND LITERACY 5 EXPANSION ACT of 1996 6 7 Article 1. General Provisions 8 9 19985. This chapter"shall be known and may be cited 10 as the Public Library Learning and Literacy Expansion 11 Act of 1996. 12 19986. As used in this chapter, the following terms ,,v 13 have the following meanings: 14 (a) "Committee" means the California Library 15 Construction and Renovation Finance Committee 16 created pursuant to Section 19972. 4 17 (bj' "Fund" means the California Library 18 Construction and Renovation Fund created pursuant to 19 Section 19955. 20 (c) : "Board" means the California Library 21 Construction and Renovation Board created pursuant to 22 Section 19952. 23 24 Article 2. For that purpose, 2 the eligible cost of acquisition shall be the fair market 3 value of the property as defined by Article 4 4 (commencing with Section 1263.310) of Chapter 9 of Title 5 7 of Part 3 of the Code of Civil Procedure, except that, if 6 title to the land will not. be transferred until after the 7 application is submitted for a grant for the acquisition of 8 the land the eligible cost of acquisition may not exceed 9 the appraised value of the land. j 10 19991. No grant funds authorized pursuant to Section j 11 19988, or matching funds provided pursuant. to Section i 12 19995, may be used by a recipient for any.of the following 1 13 purposes: 1 14 (a). Books and other library,materials: 1 15 (b) Administrative costs of the project, including, but 1 16 not limited to, the costs of any of the following: 1 17 (1) Preparation of the grant application: . 1 18 (2) Procurement of matching funds. le 19 (3) Conduct -.of an election- for obtaining voter 2( 20 approval of the project: 2i 21 (c) Interest or other carrying charges for financing the 2 22 project-; including; but not limited to, costs =of loans or 2 23 lease p , agreements in excess of the direct costs of 24 24 any of the authorized purposes specified in Section 19989. } . � 25 25 (d) Any ongoing operating expenses for the,fa.cility, its 26 26 personnel, supplies, or any other library operations. 27 27 19992. All construction contracts for projects. funded 28 28 in part.through grants awarded pursuant to.thischapter 29 29 shall be awarded through competitive.bidding pursuant 30 30 to Part 3 (commencing with Section 20100} of Division 2 31 31 of the Public Contract Code,'' 32 32 19993. If 2 the amount of funding that is provided is greater than the 3 cost of the project, the applicant shall return that portion 4 of the funding that exceeds the cost of the project to the 5 fund. If an applicant.has been awarded funding by the 6 board, but chooses' not to proceed with the project, the 7 applicant shall return all of the funding to the fund. 8 19998. In reviewing applications, the board shall 9 consider all of the following factors: 10 (a) Needs of urban and .rural areas. 11 (b) Population growth. 12 (c) Changing concepts of public library service. 13 (d) Distance of the proposed project from other 14 existing and proposed facilities. 15 (e) Age and condition of the facility. 16 (f) 'Demonstrated ability to support the ongoing 17 operating expenses of the facility. 18 If, after an .application has been submitted, material 19 changes occur .that would alter the evaluation of an 20 application, the State Librarian may accept an additional >' ; 21 ' written statement from the applicant for the board's 22 consideration. 23 19999. (a) A facility, or the part thereof, acquired, 24constructed, remodeled, or rehabilitated with grants 25 received pursuant to this chapter shall be. dedicated to 26 public library direct service use for a period of not less 27 than 20 years following completion of theproject. 28 (b) The interest of the state in land or a facility, or 29 both, pursuant to the funding of .a project under this 30 chapter, as described in subdivision (a) ; may be ! 31 transferred ,by the State Librarian from .the land or 32 facility, or both, for which that funding was granted to a 33. replacement site and facility acquired or constructed for '1F 34 the purpose of providing public library direct service. 35 (c). If the facility, or any part thereof, acquired, 36 constructed, remodeled, or, rehabilitated with grants 37 received pursuant to this chapter ceases to be used for 38 public library direct service prior to the expiration of the . 39 period specified in. subdivision (a) ,' the board is entitled _ 40 to recover, from the grant recipient or the recipient's ( ( 99 - 7 — SB 1531 )licant. (a) In addition to the purposes authorized in 2 Section 20000, the board may use,proceeds from. the sale 3 of bonds pursuant to this chapter to fund a project for 4 which both of the following conditions are met: 5 (1) The applicant previously applied for funding for , 6 that same project under Chapter 11 (commencing with 7 Section 19950) , and the State Librarian found the project 8 to be eligible for funding under that chapter, but the 9 project was not funded under that chapter. 10 (2) Not later than a date 60 days after the effective 1 11 date of this chapter, the governing body, of the applicant 1 12 certifies to the State Librarian by resolution, supported 1 13 by official action taken at an open meeting of the 1 14 -governing body, that the applicant requests funding for 1 15 the application under this section. The State Librarian. 1 16 may, for good cause, accept certifications pursuant to this 1 17 paragraph after 60 days. 1 18 (b) Any project that is funded pursuant to this section 1 19. shall comply with the regulations .set forth in Chapter. 1 l : 1 20 (commencing with Section 20410) of Division 2 of Title :.. { 2 21 5 of, and. Chapter 16 (commencing with Section 16-101) '� ® 2 22 of Part 1 of Title 24 of,the California Code of Regulations, 2 . 23 and with'any additional requirements set forth in-Article 2. 24 2 (commencing with Section 19955) of Chapter 11, but 2- 25 shall be exempt from Article 2. The board may request the Pooled Money 7 Investment Board to make a loan from the Pooled Money 8 Investment Account, in accordance with Section 16312 of 9 the Government Code, for the purposes of carrying out 10 this chapter. The amount of the request shall not exceed 1 11 the amount of the unsold bonds that the committee has, 1 12 . by resolution, authorized to be sold for the purpose of 1 13 carrying out this chapter. The board shall execute any 1 .14 documents required by the Pooled Money Investment 1 15Board to obtain and repay the loan. Any amounts loaned 1, 16 shall be deposited in the fund to be allocated by the board 1 17 in accordance with this chapter. 1 18 20009. Any bonds issued and sold pursuant to this 1 19 chapter may be refunded by the issuance of refunding 1' 20 bonds in accordance with Article 6 (commencing with E`:?>.?, ® Z. 21 Section 16780) of Chapter 4 of Part 3 of Division 2 of Title 2 22 . 2 of,the Government Code. Approval by the electors of 2- 23 the state for the issuance of bonds under this chapter shall 2 24 include the approval of the issuance of any.bonds issued 2 25 to,refund any bonds originally issued or any previously 2: 26 issued refunding bonds. 2k 27 20010.
