SUBJECT: SUPERVISORS TO IMPOSE A SALES TAX OF 1/8¢ TO FUND LIBRARY
PROGRAMS WITH 2/3 VOTER APPROVAL
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT a position of SUPPORT for SB 1958 by Senator Henry Mello which, as
introduced, would permit a board of supervisors to impose a sales tax increase at
a rate of 1/8¢ to fund library programs, subject to a 2/s voter approval.
BACKGROUND:
Existing law allows various local government entities to impose various sales tax
rates subject to various requirements and limitations. None of these are specifically
targeted to support library programs.
Senator Henry Mello has introduced SB 1958 which would permit a board of
supervisors to impose a sales tax at a 1/a¢ rate, but would require a 2/3 voter approval
for the tax. The Board has previously supported funding for the library, especially
when the voters have an opportunity to vote on whether the tax should be imposed.
As a special tax, this would require 2/3 voter approval. This bill does not mandate the
tax and requires no action by the Board of Supervisors. It simply permits the tax to
be imposed by the Board with voter approval.
The County Librarian recommends that the Board of Supervisors support SB 1958
and this office concurs with that recommendation.

An act to add Chapter 2.98 (commencing with Section
7286.59) to Part 1.7 of Division 2 of the Revenue and Taxation
Code, relating to taxation.
LEGISLATIVE COUNSEL'S DIGEST
SB 1958, as introduced, Mello. Transactions and use taxes:
i counties: libraries.
Existing law authorizes various local governmental entities,
in accordance with certain requirements and limitations, to
levy transactions and use taxes pursuant to the Transactions
and Use Tax Law.
This bill would additionally authorize the board of
supervisors of a county to impose a transactions and use tax at
a rate of 0.125% by the adoption of an ordinance, as specified,
if specified conditions are met, as provided. Revenues from
dthe tax would be used only for funding library programs and
r ..t,.. .. operations within the county.
Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.
The people of the State of California do enact as follows:
1 SECTION 1. Chapter 2.98 (commencing . with
2 Section 7286.59) is added to Part 1.7 of Division 2 of the
3 Revenue and Taxation Code, to read:

4 7286.59. (a) In addition to the tax levied pursuant to
5 Part 1.5 (commencing with Section 7200), and any other
6 tax authorized by this part, a board of supervisors of a
7 county may impose a transactions and use tax by adoption
8 of an ordinance in accordance with this part if each of the
9 following conditions are met:
10 (1) The ordinance imposing the tax is submitted to and
11 approved by the voters of the county in accordance with
12 Article 3.7 (commencing with Section 53720) of Chapter
13 4 of Part 1 of Division 2 of Title 5 of the Government Code.
14 (2) The tax is imposed at a rate of 0.125 percent for a
15 period not to exceed 10 years.
16 (3) The revenues collected from the tax are used only
17 for funding library programs and operations within the
18 county.
19 (b) The board of supervisors may impose a
20 transactions and use tax in any succeeding period not to
21 exceed 10 years per period if all of the conditions specified
22 in subdivision (a) are met for that succeeding period.
