HomeMy WebLinkAboutMINUTES - 03261996 - D7 V D.7 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 26, 1996, by the following vote: AYES: Supervisors Bishop, DeSaulnier and Smith NOES: None ABSENT: Supervisors Rogers and Torlakson ABSTAIN: None SUBJECT: Cash Bond for Bettencourt Ranch, Subdivision 7280 On this date, the Board considered the request of Michael Rupprecht, Vice President- Counsel of Dame' Construction Company for release of the cash improvement bond in the amount of $8,400 for Bettencourt Ranch, Subdivision 7280. Mitch Avalon, Public Works Department, advised that the improvements including public road and drainage relative to this cash bond for the Bettencourt Ranch development were accepted as complete on September 13, 1994. The detention basin outfall structure, was completed and put under a one year warranty, and has since been inspected and cleared. Supervisor Bishop expressed her concern that some of the development improvements might not be complete, and stated that she wanted the homeowners to receive what they thought they were receiving when they bought their homes, and that those improvements were consistent with the conditions of approval. Mr. Avalon advised that the improvement bond being considered for release on this day covers particular improvements, not necessarily all improvements, and the improvements under this bond are complete. Supervisor Bishop moved that the cash bond be released. Supervisor DeSaulnier seconded the motion. IT IS BY THE BOARD ORDERED that the cash bond in the amount of $8,400 for improvements at Bettencourt Ranch, Subdivision 7280 is RELEASED. Board of Supervisors Contra Costa County 725 Court Street Martinez, CA 94553 Re: Subdivision 7280 Dear Dr. Smith: There has been a delay in releasing an Eight Thousand, Four Hundred Dollar ($8, 400) cash bond for improvement at the Bettencourt Ranch, which improvements have been approved by the Public Works Department. See a copy of the memo of Public Works dated October 16, 1995 enclosed with this letter. Also enclosed is a copy of my November. 16, 1995 letter to Rich Lierly of Public Works requesting the release of the Eight Thousand, Four Hundred Dollar ($8,400) cash deposit' for subdivision of 7280. That still has not occurred. I would ' appreciate the Board expediting the release of that cash bond. I had a conversation with the Public Works Department and they indicated that there was no request on the part of the Public Works Department to withhold release of that Bond. However, it seems that I am not able to get the matter on the Board's agenda so that the funds can be released. Any help you can give in that regard would be appreciated once again.
