Martipez,Executive Director DATE: March 26, 1996 SUBJECT: ADOPT RESOLUTION NO.3771 AUTHORIZING THE HOUSING AUTHORITY TO IMPLEMENT MINIMUM RENT FOR PUBLIC HOUSING AND SECTION 8 PROGRAMS AS REQUIRED BY HUD. SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: ADOPT Resolution No. 3771 approving Minimum Rents for Public Housing and Section 8 program as required by HUD and AUTHORIZING the Executive Director of the Housing Authority of the County of Contra Costa to execute implementation of Minimum Rents for Public Housing and Section 8 Program, (Notices PIH 96-6 and 96-7). II. FINANCIAL IMPACT: Marginal increase from rental income. III. REASONS FOR RECOMMENDATIONBACKGROUND On March 1, 1996,the Housing Authority of the County of Contra Costa received notice from HUD that Section 402 (a)(1) and(2)of the Continuing Resolution requires that each family assisted under the Public or Indian Housing Rental and Section 8 Programs pay a monthly"Minimum Rent" of not less than $25.00 for the Federal Fiscal Year 1996, which ends September 30, 1996. Unless the Minimum Rent authorization is extended in additional legislation,Minimum Rents may only be charged until September 30, 1996. The Housing Authority of the County of Contra Costa must immediately charge the minimum rent for all applicants admitted to the Public Housing or Section 8 Programs. As soon as practicable in accordance with applicable laws and lease notice provisions, but no later than April 1, 1996, unless applicable laws or lease notice provisions require otherwise,the Housing Authority of the County of Contra Costa must charge the Minimum Rent prospectively for all tenants in Public Housing and the Section 8 Program. The H A C C C must send a notice to the tenants advising them of any changes in their rent. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not approve"Minimum Rent"for Public Housing and Section 8 Programs, the Housing Authority will not be in compliance with HUD regulations. S.Department of Housing&Urban Development has established requirements establishing a Minimum Rent of$25.00 for Public Housing and Section 8 Programs under the management of Public Housing Authorities(PIH Notices PIH 96-6 and 96-7); and WHEREAS,all Housing Authorities are required to comply with this HUD requirement; and NOW,THEREFORE,BE IT RESOLVED THAT THE BOARD OF COMMISSIONERS of the Housing Authority of the County of Contra Costa hereby adopts a$25.00 Minimum Rent for Public Housing and Section 8 Programs. PASSED AND ADOPTED ON March 26- 1996 by the following vote of the Commissioners. AYES: COMMISSIONERS BISHOP, DeSAULNIER, TORLAKSON, SMITH NOES: NONE ABSENT: COMMISSIONER ROGERS ABSTAIN: NONE
