SUBJECT: LEGISLATION: AB 3284 (Davis) - GENERAL ASSISTANCE PROGRAM
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT a position in SUPPORT of AB 3284 by Assemblywoman Susan Davis,
which, as introduced, would eliminate the sunset date on two provisions of the
General Assistance Program having to do with residency requirements and
sanctions.
BACKGROUND:
Under current law, which is due to expire January 1, 1997, a county may do the
following in regard to the General Assistance Program:
✓ Adopt a residency requirement prior to granting General Assistance which
may not exceed 15 days.
✓ Adopt sanctions of not to exceed 180 days for the following violations by a
General Assistance recipient who is able-bodied, mentally competent and has
received aid for at least three months where the recipient:
Fails, or refuses, without good cause, to participate in a qualified job
training program where participation is a condition of assistance.

After completion of a job training program, fails, or refuses, without
good cause, to accept an offer of appropriate employment.
Persistently fails, or refuses, without good cause, to cooperate with the
County in its efforts to do any of the following:
❑ Enroll the recipient in a job training program.
❑ After completion of a job training program, locate and secure
appropriate employment for the recipient.
✓ Discontinue aid to, or sanction, recipients for failure or refusal without good
cause to follow program requirements.
AB 3284 would simply repeal the sunset date of January 1, 1997, thereby leaving
these options available to the Board of Supervisors to assist in managing the
General Assistance Program.
Since the enactment of AB 3284 would provide the Board of Supervisors additional
options for the management of the General Assistance Program, it is recommended
that the Board indicate its support of AB 3284.

An act to amend Section 17001.5 of the Welfare and
Institutions Code, relating to public social services.
LEGISLATIVE COUNSEL'S DIGEST
AB 3284, as introduced, Davis. General assistance
programs.
Existing law requires each county to support its indigent
population not supported by other means, with these
programs commonly referred to as county general assistance
programs.
Existing law, effective until January 1, 1997, permits each
county, in administering its general assistance program, to
adopt residency requirements for purposes of determining a

person's eligibility and to discontinue aid under other
specified circumstances.
Existing law requires the Legislative Analyst to conduct an
evaluation of the impact of this authority on general assistance
recipients and applicants.
This bill would indefinitely extend these provisions.
Vote: majority. Appropriation: no. Fiscal committee: yes.

The people of the State of California do enact as follows.
1 SECTION 1. Section 17001.5 of the Welfare and
2 Institutions Code is.amended to read:
3 17001.5. (a) Notwithstanding any other provision of
4 law, including, but not limited to, Section 17000.5, the
5 board of supervisors of each county, or the agency
6 authorized by the county charter, may do any of the
7 following:
8 (1) (A) Adopt residency requirements for purposes
9 of determining a persons' eligibility for general
10 assistance. Any residence requirement under this
11 paragraph shall not exceed 15 days.
12 (B) Nothing in this paragraph shall be construed to
13 authorize the adoption of a requirement that an applicant
14 or recipient have an address or to require a homeless
15 person to acquire an address.
16 (2) Discontinue aid under this part for a period of not
17 more than 180 days with respect to any recipient who is
18 able-bodied and mentally competent and has received
19 aid under this part for three months if the recipient
20 engages in any of the following conduct:
21 (A) Fails, or refuses, without good cause, to participate
22 in a qualified job training program, participation of which
23 is a condition .of receipt of assistance.
24 (B) After completion of a job training program, fails,
25 or refuses, without good cause, to accept an offer of
26 appropriate employment.
;:....� 27 (C) Persistently fails, or refuses,without good cause, to
28 cooperate with the county in its efforts to do any of the
29 following:
30 (i) Enroll the recipient in a job training program.
31 (ii) After completion of a job training program, locate
32 and secure appropriate employment for the recipient.
33 (D) For purposes of this paragraph, lack of good cause
34 may be demonstrated by a . showing of any of the
35 following:
36 (i) The willful failure, or refusal, of the recipient to
37 participate in a job training program, accept appropriate

4 failure of the recipient to engage in any of the activities
of 5 described in clause (i) .

17 (2) The evaluation required by paragraph (1) shall

is 19 (A) The impact on the extent of homelessness among
ed 20 applicants and recipients of general assistance.
:nt 21 (B) The rate at which recipients of general assistance
22 are sanctioned by county welfare departments.

25 including how often the requirement is invoked.
