AYES: Supervisors Rogers, Bishop, De Saulnier, Torlakson and Smith NOES: None ABSENT: None ABSTAIN: None SUBJECT: Abatement of non permitted Recreational Vehicle ) RESOLUTION 96/42 Park, mobile home and utility structures at: ) Contra Costa County Code 3460 Sandmound Blvd. ) Div. 712; Sec. 712-4.006 Oakley CA ) OWNER: Jonathan Scheitel APN: 032-280-009 The Board of Supervisors of Contra Costa County Resolves That: It appears from evidence presented by the County Building Inspector that the above subject property has a substandard recreational vehicle park development. The non-permitted development includes structures and installations for providing electrical power, water supply, and sewage disposal utilities to travel trailer occupants and a mobilehome installation which are in violation of zoning and building ordinance codes. The non-permitted installations including any occupied or stored travel trailers and vehicles are hereby declared sub-standard and/or public nuisances. The owner of the subject property is hereby ordered to remove all vehicles and structures from the site and to clear the site of all debris and to leave the property in a clear graded condition. If the subject property has not been cleared as ordered within thirty(30)days from the date of this hearing,the Board hereby grants authority to the Building Inspection Department to contract for the clearing of the subject property. In the event the County must contract for the work to be done, a lien shall be placed against the subject property for the cost of the abatement. The Building Inspection Department is directed to post and mail notices of this resolution directing abatement of the nuisance in the manner required by law and for the period required prior to any actual abatement. On July 11, 1995, the Board of Supervisors continued to this date the hearing on the proposed abatement of real property at 3460 Sandmound Boulevard, Oakley, Jonathan Scheitel, owner. Dennis Barry, Community Development Department, commented on the reason that the Board had continued the hearing in order to give the applicant the opportunity to file and process a land use permit application to legalize the non-conforming use of the property, and he advised that the applicant had filed land use permit application 952057, and that the applicant has been sent a letter by staff on 'July 26, 1995, indicating the items that were needed to make the application complete . Mr. Barry advised that the department had recently received a revised plan and that they had not had an opportunity to completely review it, but it is the department' s position that there are a number of details still to be completed on that, and he recommended a continuance of the hearing on the abatement for a period of four months to give staff time to process the application and conclude the matter. The following person spoke : John Coker, 525 Marina Boulevard, Pittsburg, representing Jonathan Scheitel, owner, concurred with the continuance request . Supervisor Torlakson moved to continue the above matter for four months . On June 6, 1995, the Board of Supervisors continued to this date the hearing on the proposed abatement of real property at 3460 Sandmound Boulevard, Oakley, Jonathan Scheitel, owner. Henry Cox, Building Inspection Department, presented the staff report . John Coker, 525 Marina Boulevard, Pittsburg, representing the owner, Jonathan Scheitel, requested that the Board defer this matter to allow the owner to proceed with his permit application process, and he commented on his position that the condemnation hearing was not finished. Supervisor Torlakson moved to continue the matter to the afternoon calendar to allow him time to work with the parties . The Board continued the matter to the afternoon calendar. Supervisor Torlakson advised that the parties had met, and he moved to continue this matter to October 10, 1995, at 9 :45 a.m. in the Board Chambers, and to obtain a progress report from the Health Services Department and Building Inspection Department on issues related to the proposal . This is the time heretofore noticed for hearing on the proposed abatement of real property at 3460 Sandmound Boulevard, Oakley area, Jonathan Scheitel, owner. Henry Cox, Building Inspection Department, presented the staff report on the matter explaining that the property is being used as a recreational vehicle park with no permits of record, and is therefore, in violation of land use regulations as well as building code ordinances . He requested that jurisdiction be granted to the Building Inspection Department to abate the nuisance of the property if the property owner does not have the violations corrected within the next forty-five days . John Coker, 525 Marina Boulevard, Pittsburg, representing Jonathan Scheitel, commented on the recreational vehicle park not being a nuisance and that it is character with the area, and that the problem was a permitting problem. Supervisor Torlakson moved to continue the matter for thirty days and requested a report from staff as to whether the owner has filed applications and paid fees to follow through on the permits . IT IS BY THE BOARD ORDERED that the hearing on the above matter is continued to July 11, 1995, at 11 a.m. in the Board Chambers .
