Clack, Esq., 2500 Old Crow Canyon Road, Suite 121, San Ramon 94583, requested reconsideration of the Board's decision on June 27, 1995, granting jurisdiction to the Building Inspection Department for-the abatement of a travel trailer on the property of Dennis and Katherine Bennett, Bethel Island. The Board received a July 13, 1995, report from Henry Cox of the Building Inspection Department, advising that the recreational vehicle (travel trailer) has connections to the electrical service, water piping, and sewer which do not have the required building permit or approvals. The Board determined to take no action on the request for reconsideration. THIS IS A MATTER FOR RECORD PURPOSES ONLY. The recreational vehicle (travel trailer) has connections to the electrical service, water piping, and sewer which do not have required building permits nor approvals. Such non-permitted work may be substandard or contain hazards to health and safety. 2. If zoning ordinances were to change in the future to allow this use, utility connections presently installed without required building permits and inspection approvals would still be in violation of our building ordinance codes. Resolution 95/305 orders abatement of non-permitted utility equipment as well as the recreational vehicles. Reconsidering the existing resolution may extend the time limits in place for removing non-permitted electrical and plumbing construction which could be substandard or hazardous. 3. Recreational vehicles on this property are portable in nature. The owner has stated they can be readily disconnected and removed. The 45 day time limit issued during the June 27th hearing is a reasonable (if not generous) amount of time for compliance. Forthcoming recommendations of the local municipal advisory committee should not interfere with the time limit established for clearing these violations of our county ordinance codes. cc: Supervisor Tom Powers - District 1 Supervisor Jeff Smith - District 2 Supervisor Gayle Bishop - District 3 Supervisor Mark Desaulnier- District 4 Jeanne Maglio, Chief Clerk 225. :a, 1. The Request for Rehearing is based upon the fact that the Bethel Island Municipal Advisory Council has scheduled a hearing on July 10, 1995 wherein it is expected that a recommendation will be made to the Board of Supervisors to amend its ordinance regarding recreational, vehicles on Bethel Island. If the Municipal Advisory Council makes such a recommendation as is expected, and if the Board of Supervisors acts favorably upon such a request, then it would be inequitable to require Mr. & Mrs. Bennett to remove their travel trailer at the end of the forty five (45 ) day period originally given for compliance. Thank you very much for your consideration. Very truly yours, LAW OFFICES OF TIMOTHY L. CLACK JCS ' Timothy L. Clack, Esq.
