The Human Relations Director advised that the matter had been resolved to the parties satisfaction. OFFICE OF THE SHERIFF Contra Costa County Administration Division 646-2402 Date: July 17, 1995 To: Gayle Bish , Chai an Board of Srnervisors From: We S eriff Subject: PERSONNEL ISSUE On Tuesday, July 11, 1995 Jim Hicks, Business Agent, AFSCME, appeared before the Board of Supervisors in open forum and alleged that the Sheriff's Department had made a decision affecting a clerical employee's schedule in conflict with the requirements of the Family Medical Leave Act. The Board had asked for a response and review by this Department. That report will be properly submitted by the Employee Relations Officer and include the results of our discussions surrounding this issue. I find it troubling that Mr. Hicks chose to appear before the Board in an attempt to air a grievance without first completing the process of meet and confer discussions since he had already had a preliminary discussion on this matter with representatives of our Department and that there was every intent for immediate future meetings because of the complexity of the question. As Sheriff, I am committed to ensuring that all employees enjoy the rights and privileges covered under the various laws and Memorandums of Understanding and at the same time I am committed to operating the Department based on good management principles. Any questions on this issue are certainly open for discussion, but should be done within the context of established procedures related to accepted labor management relations; particularly grievance protocols.
