RECOMMENDED ACTION: ADOPT Resolution No. 3752 adopting the amended Project Agreement for the Home Investment Partnership Program and AUTHORIZING execution by the Executive Director of the Housing Authority of the County of Contra Costa,as recommended by the Advisory Housing Commission. II. FINANCIAL IMPACT: Adoption of this Resolution will transfer$30,000 in Home Program Funding for the project located at 935 East Street in Pittsburg from the City of Pittsburg to the Housing Authority of the County of Contra Costa. III. REASONS FOR RECOMMENDATION/BACKGROUND Federal funds from the Contra Costa County HOME Program have been provided for the Rental Rehabilitation Program to make loans for rehab of privately owned rental properties. One project is an eight unit apartment rehab in Pittsburg for rental by AIDS infected individuals. The City of Pittsburg committed$30,00 of its HOME Program allocation to the project but did not want to be involved in joint supervision of the work with the Housing Authority of the County of Contra Costa. As a result,the Housing Authority will be administering the disbursement of the HOME funds from its own allocation and$30,000 of the City of Pittsburg allocation,which will be transferred to the Housing Authority by an Administrative Amendment to the Project Agreement. The reason for the funding shift is that the Housing Authority's Rental Rehab Program is providing$95,000 for the rehab project and has key responsibilities for its funding. At its Regular Meeting on Monday,July 17, 1995 ,the Advisory Housing Commission voted to recommend adoption of Resolution No.3752,approving the Amendment to the Project Agreement for the Home Investment Partnership Program and authorizing execution of said amended Agreement by the Executive Director of the Housing Authority of the County of Contra Costa. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not adopt the Resolution No. 3752 the/ Authority would be unable to complete the rehabilitation of the eight unit apartment building in Pittsburg for:rental by AIDS infected individuals. ATTESTED 9 95 PJ L UATCIfELOR, CLERK Or- THE FTHE BOARD OF COMMISSIONERS AND COUNTY .ADMINISTRATOR i BY DEPUTY THE BOARD OF COMMISSIONERS HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA RESOLUTION NO. 3752 RESOLUTION AMENDING PROJECT AGREEMENT HOME INVESTMENT PARTNERSHIP PROGRAM WHEREAS, the Housing Authority of the County of Contra Costa operates a Rental Rehabilitation Program which makes loans from Federal funds from the HOME INVESTMENT PARTNERSHIP PROGRAM for housing rehabilitation; and WHEREAS, an amendment of the PROJECT AGREEMENT HOME INVESTMENT PARTNERSHIP PROGRAM dated August 11, 1993 is needed to allow the allocation of an additional $30,000 in funding from the County of Contra Costa to be administered by the Housing Authority of the County of Contra Costa, and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS of the Housing Authority of the County of Contra Costa that the attached ADMINISTRATIVE AMENDMENT TO PROJECT AGREEMENT HOME INVESTMENT PARTNERSHIP PROGRAM is hereby made a part of this Resolution and the Executive Director of the Housing Authority of the County of Contra Costa is hereby authorized to sign the document. Parties -Effective December 13, 1994, the County of Contra Costa, a political subdivision of the State of California, hereinafter referred to as the "County", and the Housing Authority of Contra Costa Countv, hereinafter referred to as "Subrecipient" hereby amend their August 11, 1993 agreement entitled "PROJECT AGREEMENT HOME INVESTMENT PARTNERSHIP PROGRAM HM 92-02", as follows: Section 2. As per agreement between the County, the City of Pittsburg (the City), and the Housing Authority of Contra Costa County(HACCC), the City has agreed to contribute $30,000 in FY 93 HOME funds previously allocated to the City by the County(contract HM 93-07 effective June 22, 1994, amended affective December 13, 1994) plus required matching funds in the form of City fee waivers in the amount of$10,000 to the rehabilitation of the property located at 935 East Street in Pittsburg. This property was acquired by Shelter, Inc. with Housing Opportunities for Persons with AIDS (HOPWA) funds under HOPWA Agreement 93-01. The purpose of the project is to provide 8 units of housing affordable to and occupied by very-low and low-income people, including four units reserved for persons with HIV/AIDS. This project represents a cooperative effort between the County, the City, HACCC, and project sponsor, Shelter, Inc. Work specifications are detailed in the HOME Rehabilitation Loan Agreement for Rental Housing entered into as of December 21, 1994 between the Housing Authority of Contra Costa County and Shelter, Inc. Section 3. Reaffirmance,- Said August 11, 1993 agreement entitled "PROJECT AGREEMENT HOME INVESTMENT PARTNERSHIP PROGRAM HM 92-02" except as hereinabove amended shall remain in full force and effect.
