SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Health Services Director, or his designee (Wendel Brunner, M.D. ) , to execute on behalf of the County, Contract Amendment Agreement #22-033-34, effective May 1, 1995, to amend Novation Contract #22-033-33 with Family and Community Services, Inc. , to increase the payment limit by $9, 079, from $52,540 to a new total payment limit of $61, 619. This Contract includes a three-month automatic extension through September 30, 1995, and this Contract Amendment Agreement provides for a $2, 270 increase in the extension period payment limit from $13, 135 to a new three-month payment limit of $15,405. This Contractor provides congregate meal services for the County's Senior Nutrition Program. II. FINANCIAL IMPACT: This contract is 100% federally funded under Title III-C(1) of the Older Americans Act of 1965. No County funding is required. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: On August 2 , 1994 the Board of Supervisors approved Novation Contract #22-033-33 (effective for the period from July 1, 1994 through June 30, 1995) , with Family and Community Services, Inc. for Congregate Meal Services for the County's Senior Nutrition Program. The Contractor inadvertently included in its FY 1994/95 budget, projected income collections from Senior participants from a Senior Nutrition site which it no longer managed. The Contractor had reduced expenses accordingly but had failed to also reduce revenue, therefore, meal income was overstated. The purpose of this Contract Amendment Agreement is to increase the amount funded by Federal Grant funds instead of voluntary contributions from Senior participants. Approval of Contract Amendment Agreement #22-033-34 will reform the Contract to remedy the mutual mistake of the County and Contractor and to accurately reflect the intent of the parties.
