FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS The subject property is located in the El Sobrante Area and. consists of approximately 3 . 76 acres, more or less. The property is designated Single Family Residential - High Density in the Land. Use Element of the General Plan and is zoned R-7 , single family residential (7 , 000 square foot minimum lot size) . A review of records in the Community Development Department does not reveal any prior recognition by the County of the existence of a non-conform- ing horse and dog facility at the subject property. No information submitted by the applicant, or the interested potential buyer, a Mr. Chauncey Wilson, supports the required finding that the proposed use for the keeping of horses and dogs was established and has been continuously maintained since a time prior to the adoption of the County Zoning Ordinance. Even if the County had previously recognized such a non-conforming use to have existed, the cessation of the .use would prohibit its resump- tion under Article 82-8 . 002 : "Any lawful use of land or building existing at the time Divisions 82 and 84 becomes effective, which use does not conform to the provisions of Division 82 and 84 , shall be a non-conforming use and shall not be in violation of Divisions 82 and 84 until the use is discontinued or ceases for any reason. " Based upon the foregoing, staff finds that the subject appeal of The Sells Group Realtors should be denied. We wish to appeal the administrative decision of the Dept. Of Community Development that states that we will not be able to continue the use of 5196 San Pablo Dam Rd. EI Sobrante as horse and animal property due to the fact that the animals have been off of this property for over six months. We request the county legal council advise us rather than having a staff person do so. The reasons for our convictions are the following: 1. the previous owner had horses, dogs, cattle and other farm animals 2. the barns and dog pens are stilt on the property, the previous owner had over 50 dogs on the property and also boarded dogs, the new pi irrrhacar is only a dog fancier/breeder and does not wish to board any dogs 3. we do not wish to use any of this prnperty for commercial 1 Q,= 4. this property has been marketed as a mini farm and horse property every since it has been vacant for approximately 3 years 5. there was a previous offer to build 6 homes on the property and the City of EI Sobrante stopped that completely and the buyer invent away 6. Miss Rosie Warda had several estimates and concluded it was cost prohibitive to build only 2 homes on the acres due to the rolling hills tharafnra chin withrireyu her offer, and she had $100,000. down payment, 7. The house on this property is way up near the street and all of the rest of the vacant land and barns, pens lie behind the house and away from all of the neighbors. 8. This land bac4s up to open space. Each Office Is Independently Owned And Operated 9. The new buyer is willing to use R-30 insulation in his dog house. 10. The property is deteriorating and the owner is being greatly-damaged by the ruling of the administration as we have a purchaser who is ready willing and able to close the transaction within a week. Use of this property is being severely restricted. This parcel contains 3.76 acres. Please reconsider the use zoning and or Grandfather Clause on this property and allow the new buyer to have horses, dogs and farm animals as did the previous owner. ' I need a commitment from the County, and the Planning, Zoning, the County Officials that should I decide to purchase the property that you would not become vindictive and file a Lawsuit of and Injunction against me because of whatever reason, be it neighbours or whatever to move the animals off of the property. I also need to know what the entire PROTOCOL would be and the costs involved in changing the zoning to R 20 or R 40 to ' keep my personal property of Collie Colony and Purebred horses .there and live peacefully perhaps in spite of neighbours. Chauncey Wilson 4900 San Pablo Dam Road EI Sobrante, CA 94803 Dear Mr. Wilson: Recently you wrote us a letter asking for some information on possible uses of a 3.76 acre site located at #5196 San Pablo Dam Road in the El Sobrante area. You gave the Assessor's parcel for the site as #435-090-007 & -008. As I have told you before the present zoning on the particular site is R-6. You asked whether or not you could keep horses (3 to 6) and purebred registered dogs (20 to 40) on the site. Under the present zoning you could not keep horses or that number of dogs on the site. The County Zoning Ordinance does not allow for the keeping of horses on properties zoned R-6 through R-15. Properties zoned R-20 to R-100 can keep horses on the property at the rate of one horse per 20,000 square feet of area subject to the requirement that the lot have at least 40,000 square feet of area. Enclosed for your review are copies of the R-6 section of the Zoning Ordinance and also R-20 section of the Zoning Ordinance. You also inquired whether or not you could keep to 20 to 40 purebred registered dogs on the site. I have enclosed a copy'of Ordinance 92-25 which is the County Ordinance regarding the keeping of dogs on a piece of property. Normally you could keep up to 3 dogs on a site. If you have over 3 dogs then you must file for a dog fancier's license. The zoning districts in which that use can be located do not include the R-6 zoning district. On page 2 of Ordinance No. 92-25 there is a list of zoning districts which allow the approval of a dog fanciers use. The establishment of a dog fancier use on a piece of property, in the appropriate zoning district, does require the approval of a Land Use Permit which brings the application to a public hearing. If you are raising dogs for commercial and sale, then that type of use is not allowed in any residential zone. 2. You also asked the question of what it would take to rezone the site from Single Family. Residential - R-6 to some other zoning district such as Single Family Residential - R-20 or R- 40. The General Plan designates this site as Single Family Residential-High Density. Under the General Pian designation, zoning of the site to R-40 or R-20 would be contrary to the present General Plan designation for the site. Therefore, if you were to file to rezone this site from R-6 to R-20 or R-40, staff would recommend denial of that due to incompatibility with the General Plan. You can take one step further back and attempt to have the General Plan changed on the site. The filing fee for that request is much more expensive. If you note on the Fee Schedule the filing fee for a General Plan Amendment is $10,000 plus $100 per acre. There is also a requirement that if staff expends more than 120% of the fee, that you will be charged for time and materials. If you do have a real wish to pursue the matter, you can contact James Cutler at 646-2035 to discuss the matter of changing the General Plan designation for the subject property. Mr. Cutler is the head of the Advanced Planning Section for the department. I hope that this answers your questions and I am sorry to inform you at this time that it would appears that under the present County General Plan designation and present zoning on the site you could not keep horses on the site or to have a dog fanciers permit issued.
