;UBJECT; REQUEST TO MAKE DETERMINATION REGARDING UNOCAL' S CLEAN PULES LAND
USE PERMIT
;PECiFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommendation:
1. Consistent with Conditions 477 and #78 of the Clean Fuels Land Use Permlit, make a
finding that more public input and County involvement in the Good Neighbor Agreement
is required. Direct the Zoning Administrator to incorporate the following action into the
review and approval process.
2. Direct County Counsel, County Health Services Department, County Administrator,
the Bay Area Air Quality Management District and the Community Development
Department to draft a contract between Contra Costa County and UNCAL to define a
scope of a thorough Safety Audit of the Rodeo facility to include the following:
a. Evaluation of actions required toprevent future failures such as operation
changes, policy changes, increased or focused maintenance, new training or
certification of employees and other appropriate actions. The County should
,work closely with the Audit Committee established by the Good Neighbor
Agreement in order to review their work and input.
b. Assurance of methods for proper prioritization of actions and accomplishment
monitoring required to attain these goals.
C. Determine a process to appoint an outside independent auditor.
3. Ask the District Attorney, Central Labor Council, Building Trades, the Industrial
Association, COLAB, Contra Costa Council-'Building Industry Association and,
community groups such as the Good Neighbor Audit Committee, Citizens For a B'etter
Environment, Shoreline Environmental Alliance and the Crockett/Rodeo Coalition to
participate in the above process to identify appropriate scoping issues. Allow 30 days for
input on scoping and audit issues.
4. Put on hold exercising any public nuisance legal action option duringtheabov'e process,
but direct the County Counsel to advise the Board of Supervisors of the statute of
limitation requirements for such action, The District Attorney should be requested to
report back to the Board of Supervisors concerning the possibility of a lawsuit if the
safety audit contract conditions are not met in a timely manner.
5. Return to the Board of Supervisors in 60 days for ajV" of the 'contract,
