RECOMMENDED ACTION:
DETERMINE that Bauman Landscape, Inc. ("Bauman"), as the lowest responsive and responsible bidder, has
complied with the minority business enterprise(MBE)and women business enterprise (WBE) goals and requirements
for this project and WAIVE any irregularities in such compliance.
AWARD the contract for the furnishing of labor and materials for this project to Bauman in the amount of
$183,000.00 and at the unit prices submitted in the bid and DIRECT that the contractor present two good and
sufficient surety bonds for payment and performance in the amounts of$91,500.00 and $183,000.00, respectively.
DIRECT the Public Works Director to prepare the contract for the project, and after the contractor has signed the
contract and returned it, together with the bonds as noted above and any required certificates of insurance or other
required documents, and after the Public Works Director has reviewed and found them to be sufficient,
AUTHORIZE the Public Works Director to sign the contract for the Board.
DIRECT that, in accordance with the project specifications and/or upon signature of the contract by the Public
Works Director, any bid bonds posted by the bidders be exonerated and any checks or cash submitted for security
be returned.
AUTHORIZE the Public Works Director to sign any escrow agreements prepared for this project to permit the
substitution of securities for moneys withheld by the County to ensure performance under the contract, pursuant to
Public Contract Code Section 22300.
Pursuant to Public Contract Code Section 4114, DELEGATE to the Public Works Director or his designee the
Board's functions under Public Contract Code Sections 4107 and 4110.
Pursuant to Labor Code Section 6705, DELEGATE to the Public Works Director or to any registered civil or
structural engineer designated by him the authority to accept detailed plans showing the desig o shoring, bracing,
sloping or other provisions to be made for worker protection during trench excavatin cove y that section.

FINANCIAL IMPACT:
The project, including engineering and appropriate overhead charges, is funded by Measure C (100%).
RECOMMENDATION/BACKGROUND:
The plans and specifications were approved and the project advertised for bids by the Board of
Supervisors on May 16, 1995. The bids were received and opened at 255 Glacier Drive, Martinez,
California, on June 15, 1995. The construction bids received were as follows-
