MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: July 11, 1995 SUBJECT: Subdivision 7686; Approval of Conditions for Annexation of Discovery Bay West Development to County Sanitation District No. 19, Discovery Bay Area. SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION I. Recommended Action: 1. ACCEPT the June 21, 1995 letter from the Hofmann Co. and Approve the proposed conditions outlined in the letter related to the reconstruction of Well #4 in County Sanitation District No. 19. 2. AUTHORIZE the General Manager of the Delta Diablo Sanitation District on behalf of the Sanitation District to issue a "will serve" letter to LAFCO for purposes of allowing the annexation of the development to move forward with appropriate conditions. H. Financial Impact: There will be no financial impact to the County General Fund. Ultimately the development will require expansion of the operations and maintenance budget of the district due to the expansion of service into the new development. These costs will be offset by increases in operating revenues from the new homes and other facilities in the expanded service area. The approval of this action should have a revenue neutral affect upon the operation of the District as all revenue and expenditure requirements will be met by the enterprise. M. Reasons for Recommendations and Background: The Hofmann Co. has been pursuing the development of an expanded area to the Discovery Bay community to be served for water and wastewater by County Sanitation District No. 19. This process has been moving through the planning process for several years. Reasons for Recommendations and Background (continued): Additionally, the Hofmann Co. has been the developer of the existing Discovery Bay area and at various times during the development has been required to expand water and wastewater facilities to provide all services to that area. Several years ago, the developer was required to install additional water supply facilities for additional subdivisions in the development. This additional well was to have been capable of meeting the maximum day plus fire flow requirements for the added homes in the area. The Company did construct a well that ultimately did not meet the specified capacity required of the development. For the past several years the District has attempted to have this well replaced with one of appropriate capacity. These attempts ultimately resulted in conditions on two remaining subdivisions inside the original Discovery Bay area that until an acceptable well was constructed no new permits of approvals of new development would be allowed. These conditions were likewise presented to the appropriate officials during the entire planning process for the Discovery Bay West project. The District staff has now negotiated and the Discovery Bay Municipal Advisory Council approved conditions that would require the developer to bond for the reconstruction of the well immediately following the approval of annexation to the reconstruction of the well immediately following the approval of annexation to the District. The MAC now recommends that the Board of Supervisors, acting as ex-officio, the Board of Directors of County Sanitation District No. 19 approve the conditions and allow the annexation to proceed subject to the negotiated conditions and the mitigation requirements of the environmental work for the development. IV. Consequences of Negative Action: Water and wastewater service to the area would not be logically developed and fragmented and uncontrolled development of water and wastewater facilities could adversely affect the existing Discovery Bay service area of Sanitation District#19.
