SUBJECT: Establishment of Contra Costa County Operational Area
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
ADOPT resolution establishing the Contra Costa County Operational Area,
as required by State regulations, to be used for the management of
emergencies involving multiple jurisdictions or multiple response
agencies and designating the county as the lead agency.
APPROVE Memorandum of Understanding to be used for the participation of
cities and special districts in the operational area.
AUTHORIZE County Emergency Services Director to sign the Memoranda of
Understanding with the cities and special districts.
BACKGROUND
Following the October 1991 Oakland/Berkeley Hills Fire, S.B. 1841 was
introduced into the State legislature. One of the provisions of the
bill required the State Office of Emergency Services to establish, by
regulation, a standardized emergency management system (SEMS) to be used
by all emergency response agencies within the state. S.B. 1841 was
approved by the Governor in September 1992 and the provisions of the
bill related to SEMS were codified as Section 8607 of the government
code. Subsequent SEMS ; regulations developed by the State Office of
Emergency Services are set forth in Chapter 1 (Sections 2400-2450) of
Division 2 of Title 19 of the California Code of Regulations.
As of December 1, 1996, a local agency included in a Governor's state of
emergency proclamation must be in compliance with the SEMS regulations
in order to be eligible for state funding of emergency response-related
personnel costs. Section 2409 (b) of the SEMS regulations requires the
Board of Supervisors to establish an "operational area” by December 1,
1995. An "operational area" is defined as an intermediate level of the
state emergency services organization, consisting of a county and all
political subdivisions within the county area. The purpose of the
operational area is to coordinate emergency response activities within
the county and to serve as the communications link between the political
subdivisions and the State Office of Emergency Services.

This matter has been discussed by the County Disaster Council, which
includes representation from all cities, and the council agrees with •
establishment of the operational area, approval of the memorandum of
understanding and designation of the county as the lead agency for the
operational area.
Approval of the above recommendations will assure compliance with the
SEMS regulations and fulfill one of the eligibility requirements for
receipt of state disaster financial assistance.

WHEREAS, pursuant to Government Code Section 8607, the State Office
of Emergency Services has established by regulation a Standardized
Emergency Management System (SEMS) which sets forth basic
principles and components of emergency management to be used in
responding to and managing emergencies involving multiple
jurisdictions or multiple agency responses; and
WHEREAS, as of December 1, 1996, when a local agency is included in
a Governor's state of emergency proclamation that agency must be in
compliance with the SEMS regulations in order to be eligible for
state funding of personnel costs incurred as the result of
undertaking measures to save lives and to protect public health,
safety and property; and
WHEREAS, the SEMS regulations are set forth in Chapter 1 (Sections
2400-2450) of Division 2 of Title 19 of the California Code of
Regulations; and,
WHEREAS, Section 2409 of the aforesaid regulations: 1) defines an
"operational area" as an intermediate level of the state emergency
services organization, consisting of a county and all political
subdivisions within the county area, 2) requires the Board of
Supervisors to establish an operational area by December 1, 1995,
and 3) provides that the county government shall serve as the lead
agency of the operational area unless another member agency assumes
that responsibility by written agreement with the county
government; and
WHEREAS, the Contra Costa County Disaster Council has determined
that it is appropriate for the county to serve as the lead agency
of the operational area,
NOW, THEREFORE, BE IT BY THIS BOARD RESOLVED that the Contra Costa
County Operational Area, including the county and all cities and
special districts within the county area, is hereby established and
that the county government shall serve as the lead agency for the
operational area and, as the lead agency, shall perform the
following functions during emergencies involving multiple
jurisdictions or multiple agency response: 1) coordinate
information, resources and priorities among the local governments
within the operational area; 2) coordinate information, resources
and priorities between the regional level and the local government
level; and, 3) use multi-agency or inter-agency coordination to
facilitate decisions for overall operational area level emergency
response activities; and
BE IT FURTHER RESOLVED THAT the County Emergency Operations Center
located at 50 Glacier Drive, Martinez, California, shall serve as
the Contra Costa County Operational Area Emergency Operations
Center; and
BE IT FURTHER RESOLVED that a memorandum of understanding for
participation in the Operational Area will be offered to all cities
and special districts within the county.

AGREEMENT FOR PARTICIPATION IN
CONTRA COSTA COUNTY OPERATIONAL AREA ORGANIZATION
1. Parties
The parties to this agreement are the County of Contra Costa,
hereinafter referred to as "County" and the cities and special
districts which are signatories to this agreement.
2 . Recitals
The parties acknowledge the following:
a. The potential for a natural or human caused disaster
requires all public agencies within Contra Costa County
to be prepared to share resources and information among
themselves and with the State of California in a timely
and efficient manner in order to protect the public
welfare.
b. The County, cities and special districts recognize the
need to coordinate their disaster mitigation, planning,
response and recovery efforts in order to provide the
highest level of emergency management capability on
behalf of the residents of Contra Costa County.
C. In accordance with Section 8607 of the Government Code,
the State Office of Emergency Services has established,
by regulation, a Standardized Emergency Management System
(SEMS) for use by all emergency response agencies.
The Standardized Emergency Management System regulations
are set forth in Chapter 1 (Sections 2400-2450) of
Division 2 of Title 19 of the California Code of
Regulations.
Section 2409 (a) of the aforementioned regulations defines
"Operational Area Level" as an intermediate level of the
state emergency services organization, consisting of a
county and all political subdivisions within the county
area and Section 2409 (b) requires the County Board of
Supervisors to establish an Operational Area by December
1, 1995.
d. The Contra Costa County Board of Supervisors, on
adopted Resolution Number which
established the Contra Costa County Operational Area to
coordinate emergency information, resources and
priorities among the political subdivisions within the
county and to serve as the communications and
coordination link between the emergency operations
centers of the political subdivisions and those of the
state.
In accordance with Section 2409 (d) of the Standardized
Emergency Management System regulations the county
government shall serve as the lead agency of the Contra
Costa County Operational Area.
3 . Purposes
Participation in this agreement is for the purposes of
promoting efficient communication of information related
to intelligence, mutual aid requests and priorities and
fostering cooperative disaster mitigation, preparedness,
response and recovery efforts among the parties.
4 . Consideration
The 'consideration under this agreement is the mutual
benefit each party derives from cooperating with each
other to fulfill the purposes of this agreement. There
shall be no monetary compensation required from any party
to another party.
5. Emergency Operations Center
The County Emergency Operations Center, located at 50
Glacier Drive, Martinez, shall serve as the Emergency
Operations Center for the Contra Costa County Operational
Area.
6. Staffing
When the Operational Area Emergency Operations Center is
activated in response to a disaster or emergency incident
parties to this agreement shall, as needed, assign
trained personnel to assist with the emergency management
functions being performed at the Operational Area
Emergency Operations Center.
7. Steering Committee
An Operational Area Steering Committee is hereby
established consisting of representatives from the
parties or categories of parties to this agreement. The
Steering Committee will develop the Operational Area
organizational structure, policies and procedures for
approval by the respective parties. On an ongoing basis
the Steering Committee shall work to fulfill the purposes
of this agreement.
8. Term
The term of this agreement shall be effective from the
date executed by the parties until rescinded by formal
agreement.
9 . Withdrawal
Any party may withdraw from this agreement by giving
thirty days written notice to the other parties.
