RECOMMENDATION A. EXTEND the contract completion time for construction of Elevated Walkway Replacement, Merrithew Memorial Hospital, 2500 Alhambra Avenue, Martinez by 51 calendar days from December 8, 1994 to January 28, 1995 . B. ASSESS liquidated damages, pursuant to Sections 1 and 5 of the contract, for the period from January 28, 1995 to February 17, 1995, the date on which the County took possession of the walkway and began to use it for its intended purpose, in the amount, of $5, 000.. 00 and DIRECT the Auditor-Controller to withhold said amount from the final payment. C. WAIVE liquidated damages between February 17, 1995 and March 14, 1995, the date on which the Board accepted the contract as complete. II . . FINANCIAL IMPACT This action will result in a credit to be applied to the capital project account for this project. III . RECOMMENDATIONS/BACKGROUND A. On December 14, 1993 the Board awarded a contract to Tyler Construction, Inc. for removal and reconstruction of a deteriorated elevated walkway at Merrithew Memorial Hospital . A notice to proceed was issued with a starting date of January 10, 1994 and a contract completion date of March 11, 1994 . On February 11, 1994 the Contractor was directed to postpone the work until further notice because of potential interference with work under a separate contract the County Administrator and Health Services Department considered a higher priority, Bid Package No. 2 , Site Preparation for the Replacement Hospital project. C. A second notice to proceed was issued to resume the work with a new starting date of August 9, 1994 and a new contract completion date of October 8, 1994 . Subsequently, that new contract completion date was extended 61 calendar days to December 8, 1994 by various change orders . D. The Director of General Services recommends that an extension of 51 calendar days be granted for delays due to unforeseeable causes beyond the control of the Contractor, which will extend the new contract completion date from December 8, 1994 to January 28, 1995 . E . The Director of General Services also recommends assessing liquidated damages in the amount of $5,000 . 00, which is $250 . 00 per calendar day for 20 days, for the period from January 28, 1995 to February 17, 1995, the date on which the contract was substantially complete and the replacement walkway was available for use. F. On March 14, 1995 the Board accepted the work of the contract as complete with the exception of certain incidental withhold items pursuant to a letter dated March 1, 1995 .
