The resolution also requests consolidation of the District's special tax election with any other election that will be held on November 7, in the same territory (or territory that is in part the same). Pursuant to Elections Code Section 10402, we are delivering a copy of the resolution to you and to the Registrars of Voters of Alameda and Contra Costa Counties. Enclosure: Resolution Ordering Election . /o RESOLUTION NO. 127-94/95 Ordering A Parcel Tax Election, Establishing Specifications Of The Election Order And Requestine Consolidation With Other Elections WHEREAS, the present revenues of the Livermore Valley Joint Unified School District (the "District") are not adequate to meet the expenses of(a)providing modern information and communications technology for use in the classroom and (b) properly maintaining the District's school buildings for a healthy and safe learning environment; WHEREAS, in the judgment of the Governing Board (the "Board") of the District, following consideration of comments received at a noticed public hearing on the subject, it is necessary and advisable to propose to the voters the adoption of a special tax within the District for the purpose of raising additional revenue for specific programs and services for the District; WHEREAS, the Board is generally authorized to order elections within the District and to designate the specifications thereof, pursuant to Education Code Sections 5304 and 5322; WHEREAS, the Board is specifically authorized to submit to the voters the question of the adoption of a special tax pursuant to Government Code Sections 50079 and 50077; WHEREAS, it is desirable that the election be consolidated with such other election or elections as may be held on the same day in the same territory or in territory that is in part the same; NOW, THEREFORE, BE IT HEREBY RESOLVED by the Governing Board of the Livermore Valley Joint Unified School District as follows; 1. ELECTION ORDER; BALLOT PROPOSITION: Pursuant to Government Code Sections 50079 and 50077, an election shall be held within the boundaries of the Livermore Valley Joint Unified School District on November 7, 1995, submitting to the voters of the District the question whether a special tax shall be levied in the District, at the rate of 7cuelut-FmRdollars per assessor's parcel per year, for a period of five fiscal years (commencing July 1, 1996), for the purpose of raising money for: (a) acquiring up-to-date computer technology and (b) providing necessary site safety improvements and maintenance. The parcel tax would be collected and administered in the same manner as ad valorem taxes are fixed and collected. 2. TEXT OF BALLOT PROPOSITION: Pursuant to Elections Code Section 13247, the statement of the proposition submitted to the voters shall be abbreviated on the ballot as follows: LIVERMORE VALLEY JOINT UNIFIED SCHOOL DISTRICT PARCEL TAX FOR COMPUTER TECHNOLOGY AND SAFETY IMPROVEMENTS "In order to acquire up-to-date computer technology and to provide necessary site safety improvements and maintenance, shall the Livermore Valley Joint Unified School District adopt a special tax to be levied at the rate of % -Foch dollars per assessor's parcel per year for a period of five fiscal years beginning July 1, 19 6, and ending June 30, 2001?" RESOLUTION NO. 127-94/95 -2- 3. VOTE REQUIRED: Pursuant to Section 50077 of the Government Code and Section 4 of Article XMA of the Constitution of the State of California, the above proposition shall become effective only upon the affirmative vote of two thirds of those electors voting on the measure. 4. COUNTY OFFICIALS TO CALL AND CONDUCT ELECTION: Pursuant to Sections 5302 and 5303 of the Education Code, the County Superintendent of Schools of Alameda County and the Registrars of Voters of the Counties of Alameda and Contra Costa are hereby requested to take all steps to call and hold the election in accordance with law and these specifications. 5. CONSOLIDATION WITH OTHER ELECTIONS: Pursuant to Section 5342 of the Education Code and Part 3 (commencing with Section 10400) of Division 10 of the Elections Code, the Boards of Supervisors of the Counties of Alameda and Contra Costa are requested to order consolidation of the school tax election with such other election or elections as may be held on the same day in the same territory or in territory that is in part the same. 6. CANVASS OF RETURNS: The Boards of Supervisors of the Counties of Alameda and Contra Costa are authorized to canvass the returns of the election pursuant to Section 10411 of the Elections Code. 7. SERVICES OF REGISTRAR OF VOTERS: Pursuant to Section 5303 of the Education Code and Section 10002 of the Elections Code, the Boards of Supervisors of the Counties of Alameda and Contra Costa are requested to permit the Registrar of Voters of their respective counties to render all services specified by Section 10418 of the Elections Code relating to the election, for which services the District agrees to reimburse each County, such services to include the publication of a formal notice of election (as described herein) and the mailing of the sample ballot pursuant to the terms of Section 5363 of the Education Code and Sections 12115 and 12118 of the Elections Code. 8. FORMAL NOTICE OF ELECTION: The County Superintendent of Schools of Alameda County is hereby requested to prepare a formal notice of election containing the information specified in Section 5361 of the Education Code, in substantially the form attached hereto as Exhibit A. 9. SPECIFICATIONS OF THE ELECTION ORDER: The foregoing specifications of the election order are made pursuant to Section 5322 of the Education Code. 10. DELIVERY OF SPECIFICATIONS OF THE ELECTION ORDER. The Clerk of the Board shall, not less than 123 days prior to the date set for the election, deliver two certified copies of this resolution and order to the County Superintendent of Schools of Alameda County, one certified copy hereof each to the Registrars of Voters of Alameda and Contra Costa Counties, and one certified copy hereof each to the Boards of Supervisors of Alameda and Contra Costa Counties. 11. REQUEST TO COUNTY SUPERINTENDENT TO DELIVER ELECTION ORDER AND NOTICE: The County Superintendent of Schools of Alameda County is hereby requested to deliver, not less than 120 days prior to the date set for the election, a copy of this Resolution (which serves as the order of election) and a formal notice of election (as described above) to the Registrars of Voters of Alameda and Contra Costa Counties. GENERAL AUTHORIZATION WITH RESPECT TO THE ELECTION: The members of the Board, the Superintendent, and the other officers of the District are hereby authorized and directed, individually and collectively, to do any and all things and to execute, deliver, and perform any and all agreements and documents that they deem necessary or advisable in order to effectuate the purposes of this Resolution, including, without limitation, to prepare and submit for inclusion in the voter information pamphlet an argument in favor of passage of the proposition. All actions heretofore taken by the officers and agents of the District that are in conformity with the purposes and intent of this Resolution are hereby ratified, confirmed, and approved in all respects. RESOLUTION NO. 127-94/95 -4- EXHIBIT A FORMAL NOTICE OF SCHOOL TAX ELECTION 1. NOTICE IS HEREBY GIVEN to the qualified electors of the Livermore Valley Joint Unified School District of Alameda and Contra Costa Counties, California (the "District"), that in accordance with the provisions of the Education Code of the State of California, a school tax election will be held on Tuesday, November 7, 1995, in the District. 2. At the election the following proposition will be submitted to the qualified electors of the District and voted upon: MEASURE: LIVERMORE VALLEY JOINT UNIFIED SCHOOL DISTRICT PARCEL TAX FOR COMPUTER TECHNOLOGY AND SAFETY IMPROVEMENTS "In order to acquire up-to-date computer technology and to provide necessary site safety improvements and maintenance, shall the Livermore Valley Joint Unified School District adopt a special tax to be levied at the rate of 7a-j fL-&.ik dollars per assessor's parcel per year for a period of five fiscal years beginning July 1, 1996, and ending June 30, 2001?" The proposition shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Section 13116 of the Elections Code of the State of California. 3. If two-thirds of the qualified electors voting on the proposition vote "YES," the proposition is approved. 4. The polls at the polling places will be open from 7:00 a.m. until 8 00 p.m. on the day of the election. The boundaries of the voting precincts within the District, the location of the polling places and the names of the officers selected to conduct the election shall be determined by the Registrars of Voters of Alameda and Contra Costa Counties. 5. The Governing Board of the Livermore Valley Joint Unified School District, by adoption of Resolution No. 127-94/95 (the "Resolution"), on June 20, 1995, has ordered the election, and the County Superintendent of Schools, by execution of this formal notice of election, has called the election ordered by the Resolution in accordance with the provisions of Sections 5302, 5322, 5325, and 5361 of the Education Code. In all particulars not recited in this notice, the election shall be held and conducted as provided by law for holding school district elections.
