The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330.
This vacation request is for a portion of 3rd Street located in Richmond. A description of
the portion to be vacated is attached hereto as Exhibits "A" and "B" and incorporated herein by
reference.
This vacation request is for excess right of way of a street or highway not required for
street or highway purposes. (S. & H. Code Section 8334).
RESOLUTION NO. 95/ 307
This Board hereby FINDS that the proposed vacation will not have a significant effect on
the environment, and that it has been determined to be exempt from the California Environmental
Quality Act under State CEQA guidelines Section 15061(b)(3) and DIRECTS the Director of
Community Development to file a Notice of Exemption with the County Clerk.
This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer
constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in
the office of the County Recorder,

THIRD STREET ABANDONMENT
All that real property situated in Contra Costa County, State of California, described as follows:
A portion of the parcel of land described in the deed from Antonio Bruzzone and Lina Bruzzone
to Contra Costa County recorded September 30, 1952 in Book 1999 Official Records of Contra
Costa County at Page 316, described as follows:
COMMENCING at the northwesterly corner of the aforementioned County parcel; thence along
the westerly line thereof South 03°06'28" West (the bearing South 03°06'28" West being taken for
the purpose of this description), 42.01 feet to the POINT OF BEGINNING; thence leaving said
westerly line South 42°51'29" East 13.91 feet; thence South 03°06'28" West 82.18 feet; thence
South 01°41'37" West 405.23 feet; thence South 03°06'28" West 318.84 feet; thence South
02008102" West 29.51 feet to the northerly line of the parcel of land described in the deed to
Contra Costa County Flood Control and Water Conservation District recorded November 18, 1987
in Book 14025 Official Records of Contra Costa County at Page 833; thence along said line
thereof North 88°41'00" West 20.51 feet to the westerly line of said County parcel (1999 or 316);
thence along said line North 03°06'28" East 845.95 feet to the POINT OF BEGINNING.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and
Highways Code, the easement and right at any time, or from time to time, to construct, enlarge,
maintain, operate, replace, remove, and renew those existing and in place utilities, as of the date
of recording this instrument, in, upon, over and across any highway or part thereof proposed to
be vacated, including access to protect the property from all hazards in, upon and over the area
herein before described to be vacated.
Containing 13928 square feet more or less.

Project Description, Common Name (if any) and Location: VACATE A PORTION OF 3RD STREET - NORTH
RICHMOND County File #CP 95-38: The purpose of the activity is to vacate the County's interest in a linear
strip of 3rd Street totalling approximately 13,928 square feet. The Transportation Engineering Division of
the Public Works Department has identified this portion of 3rd Street as surplus road right of way and
determined it unnecessary for present or prospective public use. No new parcel will be created as a result
of vacating this portion of the road. Location: 3rd Street is located in an unincorporated area of North
Richmond in west County.
This project is exempt from CEOA as a:
Ministerial Project (Sec. 15268) _ Other Statutory Exemption, Section
Declared Emergency (Sec. 15269(a)) ✓ General Rule of Applicability(Section 15061(b)(3))
Emergency Project (Sec. 15269(b) or (c))

The Contra Costa County Community Development Department has completed an initial study of the environmental
significance of the project represented by your pending application bearing County File Number CP 95-38(Vacate
a Portion of 3rd Street-North Richmond). In conformance with Contra Costa County Guidelines for implementing
the California Environmental Quality Act of 1970(CEQA), it has been determined that your project will not have
a significant effect on the environment. Your project falls within the following category:
(✓) AN ENVIRONMENTAL IMPACT REPORT (EIR) IS NOT REQUIRED.
( ) The project is categorically exempt (Class 1.
( ) The CEQA requirements are accommodated by the EIR previously prepared for

been filed by the Community Development Department [unless appealed]).
