SPECIFIC REQUEST(S)OR RECOMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
It is important that the Board of Supervisors discuss Senate Bill 437, and its implications on the Bay Area Air
Quality Management District. The Board should continue to watch this bill as it progresses through Senate
committees. The Board should also consider taking a position regarding this bill, after discussing it.
BACKGROUND / JUSTIFICATION
Existing law requires air districts,with serious air pollution problems,to implement transportation control
measures that result•in no net increase in automobile emissions by 1997. Existing law also requires that these
air districts achieve an average vehicle ridership (AVR) of 1.4 passengers by 1999.
Senate Bill 437 would prohibit any district from implementing an employer-based trip reduction program unless
it is specifically required to do so by federal law, and unless it would result in monetary sanctions if the
program is eliminated.
The existing law provides the most effective means of achieving California Clean Air Act Requirements.
Employer based trip reduction (EBTR) programs are the most effective means of achieving AVR requirements
established in the California Clean Air Act. Absent EBTR programs, districts would have little ability to
monitor actual AVR. Districts would have no authority to implement programs to achieve AVR requirements.
Time must be allowed to assess the effectiveness of the programs that are presently in place before elimination
of them. EBTR programs in the Bay Area have only recently entered implementation stages. The Bay Area
Air Quality Management District has not been able to assess whether or not it has achieved the reductions in
auto emissions it expected. Prior to eliminating the entire program, the district should be allowed to assess'each
program's effectiveness in changing driving behavior and reducing emissions.

the Boatwright amendment that would remove the Bay Area from its provisions.
