SUBJECT: Clayton Community Library Facilities Use and Operating Agreement
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
1. APPROVE and AUTHORIZE the Chair to execute the Facilities Use and Operating Agreement
between the City of Clayton and the County of Contra Costa for the Clayton Community
Library.
2. ADOPT resolution to approve the Letters of Understanding between the County and AFSCME
2700 and Public Employees Union Local 1 regarding the expanded use of volunteers in the
Library.
FINANCIAL IMPACT:
The City and County are responsible for annually mutually establishing a budget for the library. According
to the operating agreement the County will be responsible for the following:
a. cost of staffing at the Clayton Community Library other than the volunteer coordinator and
library student assistant/ library aide position
b. data lines for automated library system
C. County owned furniture and equipment
The City will be responsible for:
a. exterior and interior building maintenance
b. city-owned furniture and equipment maintenance
C. utilities
d. materials and supplies
e. collection materials
f. volunteer recruitment and coordination
g. one part-time paid library student assistant/library aide position
h. janitorial services
j. landscape and grounds services
It is estimated the the annual cost to the County for FY 1995/96 will be $176,000. Estimated costs to the City
of Clayton for FY 1995/96 will be $125,000.

BACKGROUND:
In February 1991 the Board of Supervisors agreed to approve the approve the application of the City of
Clayton for state Prop 85 building funds to construct a new county library branch in Clayton. As part of that
agreement a Memorandum of Understanding was entered into between the County and the City about cost-
sharing for the operational cost of the new facility. The Memorandum of Understanding stated that the
County and City mutually agreed to attempt to achieve a 2/3 County and 1/3 City sharing of the annual cost
of the program operation of the library. In addition, the City agreed to provide all building maintenance and
provide a minimum of $50,000 annually to the program operation of the library.
Subsequently, the City of Clayton received a$2.7 million state grant to construct a 15,000 square foot library.
The library was completed in early 1995 and has been open and operating since March 6, 1995 for 40 hours
of service per week.
Negotiations have been ongoing with the City of Clayton regarding the facilities use and operating agreement
over the past year. Issues relating to cost-sharing and the use of volunteers have been the primary issues
that have delayed the completion of negotiations. On May 22, 1995 letters of understanding with AFSCME
2700, representing library clerical employees, and Public Employees Union Local 1, representing library para-
professional and professional employees, were signed which will expand the use of volunteers in all library
operations. The AFSCME letter includes the statement that trained volunteers may assist Clerks as needed.
The Local 1 letter includes a list of 104 volunteer tasks, which expands on the current list of 32 volunteer
tasks. The Clayton agreement reflects the intent of those newly signed letters of understanding. In addition,
the city will be providing a paid volunteer coordinator to recruit and schedule volunteers for the Clayton
Community Library.
The term of the agreement is through June 30, 1996 with automatic renewal for one year terms, unless a
written notice to cancel the agreement effective the next June 30 is given prior to October 1 st preceding the
effective date of termination. A six month evaluation of the effectiveness, appropriateness and fairness of
the agreement is included, as well as annual evaluations thereafter.

1' PARTIES
Effective on 7 the CITY OF CLAYTON, hereinafter called
"CITY", and the COUNTY OF CONTRA COSTA , a political subdivision of the State of California,
hereinafter called "COUNTY", mutually agree and promise as follows:
2. PURPOSE OF THIS AGREEMENT:
The Clayton Community Library facility located at 6125 Clayton Road in Clayton is owned by
the City ofClayton. This agreement will provide and establish conditions for the operation of the facility
as a Branch library by the Contra Costa County Library.
3' CONTROL OF FACILITIES:
A. The City shall retain overall ownership, control and management of the facility at all times. The
City ahoU establish policies for the use of the community meeting room and will schedule all
uses and collect and retain any user fees. Library programs shall have priority for scheduling
as outlined in the City of Clayton Library Meeting Room Use Policies, attached as "Exhibit A";
and shall not be charged for the use of the rnamUng room.
B. The County Library shall be granted use ofthe facility os obelnch |ibnary, and shall provide day
to day supervision and operation of the building and the library patrons, within general use
guidelines established by the City (example: energy management, building security, etc.).

C. The'Citv. in conjunction with the Clayton Community Library Foundation, reserves the right to
develop programs of compatible uses insofar as such programs du not directly interfere with
normal branch library functions. Compatible uses ino|udm, but are not limited to: computer
instruction; homework help center; children's entertainment and education; business support
activities, etc. All such programs will bmcoordinated with the County's Branch Manager prior to
starting.

4. RESPONSIBILITIES, BUDGETING, AND COST SHARING: �
The City and County shall mutually establish an annual budget for the library by June 1st of
every year. It is recognized that each party will provide indirect benefits tnthe library, such as the
provision of central library sen/icaa, city administrative oewiceo, and volunteers, for which no budget will
bedeveloped nor cost sharing provided. For the direct costs associated with the library building and
operation, the parties agree to the following assignment of responsibilities:

• The County will be responsible for:
a. All staffing not included in items f and g of City responsibilities.
b. Data lines for automated library system.
C. County-owned furniture and equipment.
For purposes of this agreement:
Utility costs will include:
(a) natural gas
(b) electricity
(c) water
(d) sewer
(e) telephone (except for long distance charges)
(f) garbage collection and disposal
Consideration for this agreement is the faithful performance of the terms and conditions of the
agreement. No rent shall be due or payable during the term of this agreement. Any costs paid by one
party that are the responsibility of the other party, shall be reimbursed within 60 days of receipt of a
written demand for payment.
5. HOURS OF OPERATION
The Library shall be open to the public 40 hours per week; provided that the level of paid and
volunteer staffing is adequate. A normal standard of adequacy shall be a minimum staffing during
public access hours of three paid and/or trained volunteer staff, one of which shall be a paid
professional or supervisory level staff member. If staffing falls below that level, the County's staff
supervisor will assess the level of use, control and security issues, and shall have the authority at
his/her sole discretion to close the library early or for a period of time until additional staffing is
available.
The schedule of Library public hours shall be established as follows:
Monday 1:00 p.m. to 9:00 p.m. Tuesday 10:00 a.m. to 6:00 p.m.
Wednesday 1:00 p.m. to 9:00 p.m. Thursday 10:00 a.m. to 6:00 p.m.
Friday Closed Saturday 9:00 a.m. to 5:00 p.m.
Sunday Closed
Changes to the schedule must be agreed to by both parties.
6. LIBRARY STAFF
The County shall provide a minimum paid staffing level of 2.55 full time equivalent staff. A
Branch Manager shall be appointed by the County as the supervisor of the Clayton Library, and shall
have primary authority and responsibility for the provision of library services in the branch. The
County's Branch Manager shall arrange a quarterly meeting of representatives of the Branch Library
management, County Library Administration, Clayton Community Library Foundation, and City of
Clayton to review relevant library issues; and shall meet weekly with the City Volunteer Coordinator to
review schedules, assignments, and other relevant issues.
The County will recruit for and appoint the City-funded part-time library student assistant/ library
aide ("Aide"). The position shall be advertised locally, and preference given to residents of the City of
Clayton. The Aide shall be an employee of the County and the County shall provide the sole
supervision of the Aide.

7. USE OF VOLUNTEERS
Volunteers shall be considered a vital and welcomed partner in the operation of the Library.
The City shall provide a coordinator to recruit and schedule volunteers to assist with the
operation of the library, and shall provide workers compensation coverage for such volunteers.
Volunteers will be supervised, and work tasks assigned, by the Branch Manager and/or the supervising
professional staff in the absence of the Branch Manager. Paid staff, other than as designated above,
will not have supervisory authority over volunteers, nor will volunteers be placed in supervisory roles
over staff. Volunteers may, however, be used in supervisory roles over other volunteers, as needed.
The Branch Manager and Volunteer Coordinator shall identify and address days and times of most
critical need to maintain the required minimum staffing.
Three levels of volunteers shall be recognized:
Public Services Supplemental: This level of volunteers shall have or receive training to perform
relevant and needed public service library duties, including circulation and information services. The
City shall provide a minimum of 28 hours per week at specific critical days and times; and shall have an
additional goal of providing at least 21 additional hours per week.
Support Services Supplemental: This level of volunteer will have or receive minimal
training, and may be used for any clerical, book handling, cleaning, security, etc. tasks. The City shall
provide a minimum of 35 hours per week on specific days; and shall have an additional goal of
providing at least 10 additional hours per week.
Program Services Supplemental: Special volunteers may be used for specific program
needs, such as children's story hour, homework help, adult literacy, etc., which may be under the
direction of the library staff, the City, or the Clayton Community Library Foundation. All special
programs shall be coordinated with the Branch Manager to avoid program redundancy or scheduling
conflicts. The City shall provide volunteers as needed by specific programs.
8. TERM AND TERMINATION
The initial term of this agreement shall extend from the effective date through June 30, 1996.
The City and County shall evaluate the effectiveness, appropriateness, and fairness of the agreement
after the first six months of operation, and annually thereafter.
This agreement shall automatically renew each year for subsequent one year terms, except that
either party may terminate the agreement upon 60 days prior written notice to the other party.
In the event of termination, the County shall remove only equipment and materials provided
directly by the County, and shall leave in good working order all equipment and materials provided by
the City or the Clayton Community Library Foundation. It is agreed that all collection materials shall
remain in the facility upon termination, provided the facility continues to be operated as a community
library.
9. IMPROVEMENTS OR ALTERATIONS
No improvements or alterations shall be made to the building, furniture, equipment,
other building contents or library premises without the prior written approval of the City.

10. CONDITION OF FACILITIES
The County shall make reasonable efforts to operate the facility in a safe condition, and
to advise the City of any condition requiring maintenance attention. The County shall be responsible for
any damages to the facility caused by County staff.
The Library shall be kept free of clutter and unsightly advertising, notices, etc.
Temporary paper signs/notices shall not be used (on shelving, furniture, counters, walls, etc.), except
for brief-duration notices properly secured on tackable surfaces and built-in bulletin boards.
11. NON-ASSIGNABILITY
The County may not assign nor sublet an portion of the facility without the City's prior
written consent.
12. INDEMNIFICATION
County agrees to indemnify and hold harmless City and the Clayton Community Library
Foundation, their officers and employees from the County's share of all liability, losses, costs or
expenses, including attorney's fees arising out of the negligent acts, errors and omissions of County, its
officers, agents, employees or contractors. City agrees to indemnify and hold harmless County and the
Clayton Community Library Foundation, their respective officers and employees from the City's share of
all liability, losses, costs or expenses arising out of the negligent acts, errors or omissions of the City,
its officers, employees, agents or contractors.
13. INSURANCE
County is self-insured and shall maintain coverage under its self-insurance program for public
liability and for County-owned furniture and equipment.
City shall maintain adequate comprehensive property and public liability coverage for the
building, grounds, and contents excluding County-owned furniture and equipment.
14. DEFAULTS
In the event of County's material breach of any of the covenants or conditions herein, City may
re-enter and repossess the premises after giving County written notice of default and in accordance with
due process of law. In the event of a material breach by City, County may terminate the agreement
and quit the premises without further cost or obligation.

Dear Mr. Hicks:
During the recently concluded meet and confer sessions regarding the Contra
Costa County Library proposal to AFSCME, Local 270.0 to expand the use of
volunteers in the various branches of the County Library the following
understandings were achieved:
1 . The Library will make every reasonable effort to fill authorized positions
with permanent employees. Authorized positions currently filled by
temporary employees will be filled with permanent employees as soon as
possible.
2. The merger of all Library Clerk positions into the Clerk Deep Class will be
concluded as quickly as possible.
3. The County and the Union recognize that full staffing of the libraries
provides better service to communities and is a necessary goal. The
parties therefore agree that a reasonable staffing goal to work towards is
the level of staffing of AFSCME represented positions in place as of January
1 , 1993. The parties agree further to work towards the achievement of
this staffing goal by July 1 , 1997. The parties also agree that the
achievement of this staffing goal depends on additional funding source(s)
for the operation of the libraries.
4. It is agreed that trained volunteers may assist Clerks as needed.
Volunteers will be assigned tasks by the Branch Librarian after
consultation with the clerical staff in whose area the volunteer(s) is to be
assigned.
S. In the event that the goal established by #3 above cannot be reached by
the target date of July 1 , 1997 this agreement will terminate, unless it is
extended or modified by mutual consent of the parties. It is understood
that nothing in this agreement shall be precedent setting for either party.
If the foregoing is in conformance with your understanding, please indicate your
approval and acceptance in the space provided below.

Dear Ms. Falk:
During the recently concluded meet and confer sessions regarding the Contra
Costa County Library proposal to Local 1 to expand the use of volunteers in the
various branches of the County Library, the following understandings were
achieved:
1 . Two Branch Librarian positions currently designated as .8 FTE each will be
changed to a 1 .0 FTE each with .2 FTE of each being Absent Without Pay
(AWOP) time. These positions will be filled permanently as soon as
possible.
2. The Library will work with Local 1 to develop better communications
internally and improved public relations externally.
3. Staffing at the Clayton Branch for Local 1 represented positions will be a
total of 2.55 - 2.75 FTE's in the following configuration: .8 - 1 .0 Branch
Librarian, .5 Librarian, 1 .25 Library Assistant. The .25 Library Assistant
will be assigned .25 FTE at another location. The Branch Librarian may
chose to work 32 hours per week in a 1 .0 FTE position of which .2 FTE will
be defined as AWOP; or work 32 hours one week and 40 hours the second
week including working every other Saturday in a 1 .0 FTE positions of
which .1 FTE will be defined as AWOP; or work 40 hours per week including
working every Saturday unless and until the allocation of this position is
permanently changed.
4. ,fob descriptions for volunteers will be developed in consultation with Local
1 and a new identification badge for volunteers will be designed by the
Library.
5. Public Employees Union, Local 1 has in the past recognized the value of
the contributions of volunteers to enhancing Library programs. Further,
both the County and the Union recognize that over 69,000 hours of
volunteer time were contributed by dedicated volunteers to the Library
during 1994.
In an effort to encourage the use of volunteers in a manner that is consistent
with the delivery of professional services by trained paid staff, the County and
the Union agree that effective .June 1 , 1995 the list of volunteer duties shown
below will be implemented and remain in effect so long as there are no layoffs
of Library staff unless caused by revenue decisions outside of the County's
control. In the event that layoffs caused by events outside of the County's
control do occur during the term of this Letter of Understanding the parties will
meet and confer regarding the use of volunteers in the libraries.
6. Implementation of this list of volunteer duties will be discussed with the
Union at the regular monthly Labor-Management meetings. During the
term of this Letter of Understanding, the Policy Statement on Volunteer
Programs contained in the Library's Volunteer Handbook will be
maintained in effect. Job descriptions for volunteers will be developed in
consultation with Local 1 . The Library will design a new identification
badge for volunteers.
7. The County and the Union recognize that full staffing of the libraries
provides better service to communities and is a desirable goal. The
parties therefore agree that a reasonable minimum staffing goal to work
towards is the level of staffing of Local 1 represented positions in place as
of January 1 , 1993. The parties agree further to work towards the
achievement of this staffing goal by July 1 , 1997. The parties also agree
that the achievement of this staffing goal depends on additional funding
source(s) for the operation of the librariesand are committed to working
together to secure such additional funding source(s). In the event that
this goal cannot be reached by the target date of July 1 , 1997, this Letter
of Understanding may be extended by mutual agreement only.
If the foregoing is in conformance with your understanding, please indicate your
approval and acceptance in the space provided below.

In response to your request ot May 24, 1 H5, attached please find the recently signed
letters of understanding with AFSCME 2700 and Public Employees Union Local 1.
These letters will be on the Board of Supervisors agenda on June 6, 1995 with a
recommendation that they be approved.
AFSCME 2700
The AFSCME agreement covers library clerical job classifications and the job tasks
performed by staff within those classes.
The AFSCME letter in Section 4 states that:
"It is agreed that trained volunteers may assist Clerks as needed. Volunteers will be
assigned tasks by the Branch Librarian after consultation with the clerical staff in whose
area volunteer(s) is to be assigned."
Rather than develop a detailed task list of volunteer tasks AFSCME preferred to take a
less specific view of volunteer tasks. On an as needed basis, volunteers will be able to
assist Clerks in their tasks. The specific clerical tasks that volunteers will do will be
developed county-wide and implemented on a site-specific basis.
PUBLIC EMPLOYEES Ul\1ION LOCAL 1
The Local 1 agreement covers library paraprofessional and professional job classifications
and the job tasks perfonned by staff within those classes.
The Local 1 letter in Section 5 states that:
"...the list of volunteer duties shown below will be implemented..."
Attached to the letter is a four page list of specific duties and a two page explanatory
section with program development for some of the specific duties included on the lists.
On your copies of the task lists I have put an asterisk next to those volunteer tasks

which are already included in the library's volunteer handbook. While some of the
other tasks included on the list which do not have asterisks are currently performed by
some volunteers in some locations, they have not been officially included on any task
list in the past. In addition, any new volunteer task which is spechcally clerical in
nature would not have been included on that list since this is a Local 1 agreement, not
an AFSCME agreement,
The library plans on developing specific volunteer job descriptions and revising the
volunteer handbook as a result of these new agreements. The job descriptions and
handbook will combine the various volunteer tasks that will cover both AFSCME and
Local 1 tasks.

During the recently concluded meet and confer sessions regarding the Contra
Costa County Library proposal to Local I to expand the use of volunteers in the
various branches of the County Library, the following understandings were
achieved:
I Two Branch Librarian positions currently designated as .8 FTE each will be
changed to a 1 .0 FTE each with .2 FTE of each being Absent Without Pay
(AWOP) time. These positions will be filled permanently as soon as
possible.
2. The Library will work with Local I to develop better communications
internally and improved public relations externally.
3. Staffing at the Clayton Branch for Local I represented positions will be-a
total of 2.55 - 2.75 FT-E's in the following configuration: .8 • 1 .0 Branch
Librarian, .5 Librarian, 1.25 Library Assistant. The .25 Library Assistant
will be assigned .25 FTE at another location. The Branch Uibrarian may
chose to work 32 hours per week in a 1.0 FTE position of which .2 FTE will
be defined as AWOP; or work 32 hours one week and 40 hours the second
week including working every other Saturday in a 1 .0 FTE positions of
which .1 FrE will be defined as AWOP, or work 40 hours per week including
working every Saturday unless and until the allocation of this position is
permanently changed.

volunteers in the various branches of the County Library the following
understandings were achieved:
1 . The Library will make every reasonable effort to fill authorized positions
with permanent employees. Authorized positions currently filled by
temporary employees will be filled with.permanent employees as soon as
possible.
2. The merger of all Library Clerk positions into the Clerk Deep Class will be
concluded as quickly as possible.
3. The County and the Union recognize that full staffing of the libraries
provides better service to communities and is a necessary goal. The
parties therefore agree that a reasonable staffing goal to work towards is
the level of staffing of AFSCME represented positions in place as of January
1 , 1993. The parties agree further to work towards the achievement of
this staffing goal by July 1 , 1997. The parties also agree that the
achievement of this staffing goat depends on additional funding source(s)
for the operation of the libraries.
4. 1t is agreed that trained volunteers may assist Clerks as needed.
Volunteers will be assigned tasks by the Branch Librarian after
consultation with the clerical staff in whose area the volunteer(s) is to be
assigned. .

S. in the event that the goal established by #3 above cannot be reached by
the target date of July 1, 1997 this agreement will terminate, unless it is
extended or modified by mutual consent of the parties, it is understood
that nothing in this agreement shall be precedent setting for either party.
If the foregoing is in conformance with your understanding, please indicate your
