Gayle Bishop Chair, Board of Supervisors Contra Costa County County Administration Building 651 Pine Street, Room 106 Martinez, - CA 94553-1293 REQUEST TO OPPOSE COMPLETION OF THE SAN LUIS DRAIN Dear Ms . Bishop: Thank you for your letter of May 1, 1995 regarding the completion of the San Luis Drain and the recent Court Order directing the U.S . Bureau of Reclamation (USBR) to apply for a discharge permit . You have raised some interesting points about the discharge of agricultural drainage to the Bay-.Delta Estuary. If an application for a discharge permit is forthcoming, such issues will be .considered in detail and will be subject to considerable public review before any permit might be issued. I would like to clarify some of the issues surrounding two specific points made in your letter: 1 . The impacts to wildlife at Kesterson Reservoir (not Kesterson Refuge) were exacerbated by the design and management of the facility. When the USBR and the U.S . Fish and Wildlife Service agreed in 1969 to operate Kesterson Reservoir as a Waterfowl Management Area, the toxic effects of selenium in the food chain were unknown; thus, it was designed to provide attractive habitat and to encourage nesting and feeding by waterfowl . The state of knowledge has increased considerably in the past ten years and I would expect the potential impacts could be determined now with more certainty and perhaps could be mitigated more effectively than they could in 1969 . 2 . The 1990 final report of the San Joaquin Valley Drainage Program considered only in-valley drainage management options and made no recommendation pertaining to drainage export . It did, however, recognize that agriculture could not be sustained indefinitely with in-valley options and C �� A Ms . Gayle Bishop -2- MAY 22 19% that drainage export would ultimately be required. The 1979 final report of the San Joaquin Valley Interagency Drainage Program did make a recommendation for export to the Delta. The reopening of this issue after 12 years is bound to be problematic and controversial . I appreciate your input on this matter; however, with regard to your specific request, it is not appropriate for the State Water Resources Control Board (SWRCB) to take an a priori position. If the USBR proceeds with an application for a permit for this facility, the SWRCB will provide the necessary forum for all sides to be heard and will impartially consider all the evidence as required by State law.
