HomeMy WebLinkAboutMINUTES - 06061995 - 1.85 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Directing Century to Keep ) Certain Accounting Records and to Submit ) RESOLUTION NO. 95/242 Additional Documentation and Extending ) (ACCOUNTING ORDER) the Time for County Review of Century's Rates) WHEREAS, the County of Contra Costa ( "County) is certified to regulate basic cable service rates pursuant to the 1992 Cable Act ( "the Act" ) and FCC Rules, and WHEREAS, the County adopted an Ordinance ( "Ordinance" ) prescribing procedures for rate regulation consistent with the Act and FCC Rules, and is regulating basic cable rates, and WHEREAS, on or about March, 1995, Century submitted to the County an FCC Form 1210, which is a quarterly pass through of certain external costs for the basic service tier, and the County ordered the tolling of the review of such rates as set forth in a previous board order, and WHEREAS, staff is currently reviewing the initial submission of Century's Form 1200 upon which these rates are based, and WHEREAS, this review is scheduled for completion in July, 1995, and WHEREAS, the County requires this additional time to review the documentation following the FCC Form 1200 review and protect the its regulatory discretion. NOW, THEREFORE, the Board resolves as follows : 1 . Pursuant to the authority, provisions and requirements of section 76 . 933(c) of the FCC Rules, the County does hereby direct Century to keep an accurate account of all amounts received by reason of the rates in issue and on whose behalf the amounts were paid. 2 . Pursuant to the authority, provisions and requirements of section 76 . 937 (e) of the FCC Rules, the Board does hereby direct Century to submit any . additional requested documentation to the Cable TV Administrator by June 30, 1995 . 3 . The Cable TV Administrator is authorized and directed to receive the requested documentation from Century, to analyze the documentation with assistance from the County Auditor's Office, and to prepare a report and recommendations to the Board. 4 . In the event that the requested documentation is not received by June 30, 1995, the Cable TV Administrator is directed to prepare a report and recommendations to the Board using the best information available, as provided in Section 76 . 937 (e) of the FCC Rules . 5 . Whether or not the requested documentation is received from Century, the Board shall have until July 25, 1995 to issue a written decision on Century' s rates, as provided in section 76 . 936 of the FCC Rules . 6 . The Clerk of the Board is hereby directed to mail a copy of this resolution' by first class mail to Century. I hereby certify that the foregoing is a true and correct copy of a resolution entered on the minutes of said Board of Supervisors on the date aforesaid. By: Deputy Clerk Resoluti.Century IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Directing Viacom to Keep ) Certain Accounting Records and to Submit )RESOLUTION NO. 95/240 Additional Documentation and Extending ) (ACCOUNTING ORDER) the Time for County Review of Viacom's Rates) WHEREAS, the County of Contra Costa ( "County) is certified to regulate basic cable service rates pursuant to the 1992 Cable Act ( "the Act" ) and FCC Rules, and WHEREAS, the County adopted an Ordinance ( "Ordinance" ) prescribing procedures for rate regulation consistent with the Act and FCC Rules, and is regulating basic cable rates, and WHEREAS, in March, 1995 , Viacom systems submitted to the County FCC Form 1205s to update regulated equipment and installation charges, and the County ordered the tolling of the review of such rates as set forth in a previous board order, and WHEREAS, staff is currently reviewing the initial review of Viacom' s 1200 and 1220 upon which these new increases are based, and WHEREAS, the review of Viacom' s (Pinole system) is scheduled for completion in July, 1995 and Viacom' s (Pittsburg system) 1220 is scheduled for completion in February, 1996, and WHEREAS, the County requires this additional time to review the documentation following the FCC Form 1200 and 1220 review and to maintain its authority to regulate these additional rate increases . NOW, THEREFORE, the Board resolves as follows : 1 . Pursuant to the authority, provisions and requirements of section 76 . 933(c) of the FCC Rules, the County does hereby direct Viacom systems to keep an accurate account of all amounts received by reason of the rates in issue and on whose behalf the amounts were paid. 2 . Whether or not the requested documentation is received from Viacom, the Board shall have until July 25, 1995 to issue a written decision . on Viacom' s (Pinole system) rates and until February 26 , 1996 to issue a written decision on Viacom' s (Pittsburg system) rates, as provided in section 76 . 936 of the FCC Rules . 6 . By. 61 Deputy Clerk Resoluti.V i a IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Directing TCI to Keep ) Certain Accounting Records and to Submit ) RESOLUTION NO. 95/241 Additional Documentation and Extending ) (ACCOUNTING ORDER) the Time for County Review of TCI 's Rates) WHEREAS, the County of Contra Costa ( "County) is certified to regulate basic cable service rates pursuant to the 1992 Cable Act ( "the Act" ) and FCC Rules, and WHEREAS, the County adopted an Ordinance ( "Ordinance" ) prescribing procedures for rate regulation consistent with the Act and FCC Rules, and is regulating basic cable rates, and WHEREAS, in late February and early March, 1995 , TCI systems submitted to the County FCC Form 1205s to update regulated equipment and installation charges, and the County ordered the tolling of the review of such rates as. set forth in a previous board order, and WHEREAS, in early March, TCI systems submitted appropriate FCC Forms to adjust basic rates to reflect the net of a 5 . 21% inflation adjustment, minus any inflation adjustments already received, and the County ordered the tolling of the review of such rates as set forth in a previous board order, and WHEREAS, staff is currently reviewing the initial review of TCI ' s 1200s upon which these new increases are based, and WHEREAS, this review is scheduled for completion in August, 1995, and WHEREAS, the County requires this additional time to review the documentation following the FCC Form 1200 review and to maintain its authority to regulate these additional rate increases . Whether or not the requested documentation is received from TCI, the Board shall have until August 29, 1995 to issue a written decision on TCI 's rates, as provided in section 76 . 936 of the FCC Rules . 6 . The Clerk of the Board is hereby directed to mail a copy of this resolution by first class mail to TCI systems .
