MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: June 6, 1995 SUBJECT: Amendment No. 3 to the Consulting Services Agreement with AGI Technologies for Storm Damage Repairs on Alhambra Valley Road (Pinole Valley Road) and San Pablo Dam Road, Sta. 252+00 and Sta. 272+00 Project Nos.: 0672-6R6523-93, 0672-6R6529-93 and 0672-6R6530-93 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Public Works Director to execute Amendment No. 3 to the Consulting Services Agreement with AGI Technologies to provide payment for additional geotechnical services on the storm damage repairs at Alhambra Valley Road and San Pablo Dam Road - Sta. 252+00 and Sta. 272+00. II. Financial Impact: There will be no.,impact to the County General Fund. The estimated additional cost is $1,788 funded by Federal aid storm damage repair funds (88.5%) and County gas tax (11.5%). III. Reasons for Recommendations and Background: On February 15, 1994, the Board of Supervisors authorized the Public Works Director to execute a Consulting Services Agreement with AGI Technologies to provide geotechnical investigation and recommendations regarding repair of the storm damage along Alhambra Valley Road and San Pablo Dam Road - Sta. 252+00 and Sta. 272+00. This amendment is required to provide payment for necessary additional services as negotiated with the Consultant to complete the contract. IV. Parties: Effective on June 6,1995, the County of Contra Costa, a political subdivision of the State of California, hereinafter referred to as"Public Agency," and AGI Technologies hereinafter referred to as "Consultant," mutually agree and promise as follows: 2. Purpose: The parties desire to amend the agreement they entered into effective February 15, 1994, entitled "Consulting Services Agreement," hereinafter referred to as the "Agreement." The Agreement is for geotechnical investigation and design recommendations regarding repair of storm damage along Alhambra Valley Road and San Pablo Dam Road, Sta. 252 and Sta. 272. This Amendment provides for additional payment to the Consultant for negotiated extra work. The Agreement has previously been amended as follows: First Amendment (letter agreement) dated March 14, 1994; Second Amendment provides for on-call services during construction. 3. Amendment(s) to Agreement: A. Section 1. (e) (Payment Limit) is amended to read: Geotechnical Site Investigation: $23.459 On-call services during construction: $5,292 4. Remaining Provisions: Except for the changes made by this Amendment, all provisions of the Agreement shall remain in full force and effect. 5.
