SUBJECT: HEARING ON THE 80FMANN DISCOVERY BAY REST PROJECT, REZONING 2963-RZ,
TO REZONE APPROXIMATELY 756.19 ACRES OF LAND TO THE PLANNED .UNIT
DISTRICT FOR 2,000' RESIDENTIAL UNITS, A 10 ACRE SCHOOL SITE,A 6.5 ACRE
PARR SITE, A COMMERCIAL RECREATIONAL CENTER, A SENIOR HOUSING VILLAGE,
A MARINA, LAKES, FIRE STATION, OPEN SPACE AREAS, TRAILS AND OTHER
LANDSCAPED AREAS. ',
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) i BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept as adequate and in compliance with CEQA the previously
certified Final Environmental Impact Report and Addendum.
2 . Approve Rezoning 12963-RZ along with the preliminary
development plan, subject to conditions as recommended by the
East County Regional Planning Commission and as amended
(Attachment A) .
J. Adopt the Final EIR and Addendum and CEQA Findings (Attachment
B) and approve '' the related Mitigation Monitoring Program
(Attachment C) .
4. Adopt the East County Regional Planning Commission's Findings
as set forth in Resolution X14-1995 as basis for the Board's
determination for this action.
5. Adopt the ordinance giving effect to the aforesaid rezoning.
6. Direct Staff to'! post the Notice of Determination with the
County Clerk andljthe Office of Planning and Research for the
above actions'.

The Board RESCHEDULED the matter of the Hofmann Company Discovery Bay West Project rezoning
issues to July 11, 1995, and AUTHORIZED the Director, Growth Management and Economic Development
Agency,to re-open the publichearings on the matter, if necessary.

BACKGROUND/REASONS FOR RECOMMENDATIONS
On May 23, 1995, the Board closed the hearing on 2963-RZ (Discovery
Bay West) and directed 'staff to prepare final documentation for the
rezoning project.
The Developer and the interested school districts were to provide
documentation that suitable school mitigation agreements had been
reached. The Board is to then approve the project with revised
conditions (Attachment A) and adopt the Final CEQA Findings and the
EIR Addendum (Attachment B) and ,the Mitigation Monitoring Program
.(Attachment C) .

Dear Dennis:
As you know, the Hofmann Company has been negotiating with the
school districts to resolve the school facilities mitigation issue for the
Discovery Bay West rezone. We still have not been able to come to
terms with the "most favored nation" issue--that no other homebuilder
in the future should have less burdensome school facility mitigation.
Consequently, we would like to scale back the rezone at this time to
only include Village I, which lies south of Point of Timber Rd. We have
informed the school districts of this, and have come to the
understanding that we will sign an agreement only with the high
school district, and only for the rezone in Village I.
