Bragdon, Director of Community Development DATE: June 27, 1995 SUBJECT: Service Agreement Between County Redevelopment Agency and County SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS As the Contra Costa County Board of Supervisors, APPROVE AND AUTHORIZE the Director of Community Development to execute a Service Agreement with the Contra Costa County Redevelopment Agency; and as the Governing Board of the Contra Costa County Redevelopment Agency, APPROVE AND AUTHORIZE the Deputy Director - Redevelopment to execute a Service Agreement with the County of Contra Costa. FISCAL IMPACT None. The Service Agreement formalizes current practice. County pays administrative expenses associated With the Redevelopment Agency and then bills the Agency for payment. BACKGROUND/REASONS FOR RECOMMENDATIONS Staff services to the Contra Costa County Redevelopment Agency are provided primarily by personnel of the Contra Costa County Community Development Department. Other services to the Agency are provided by other County departments, including the County Administrator's Office, County Counsel, and Public Works, among others. In order for the Agency to declare its debt and thereby qualify for its receipt of tax increments, the Agency and the County should formalize this arrangement in contractual form. The Service Agreement will accomplish that task. THE BOARD OF SUPERVISORS Public Works AND COUNTY ADMINISTRATOR BY f4—( a , DEPUTY JK:Ih sra18/svcagr2bos SERVICE AGREEMENT This Agreement is made w ofJuly 1, 1995 by and between the Contra Costa County Redevelopment Agency("Agency")and the County of Contra Costa("County")with reference to the following facts: A. Pursuant to Heath&Safety Code Sections 33126(b), 33127 and 33128,the Agency desires to utilize the services of County in connection with the implementation and administration of the Agency's redevelopment projects for the Pleasant Hill BART Station Area, North Richmond, Bay Point, Oakley and Rodeo (collectively the "Projects"). B. County desires to provide the services of County staff and other County services to the Agency in connection with the implementation and administration of the Projects, THEREFORE,the Agency and County agree as follows: 1. Provision of Services. For the fiscal year beginning on July 1, 1995 and ending on June 30, 1996, County shall,at the request of the Agency, provide to the Agency the services of County departments,including but not limited to Community Development Department,Office of the County Administrator, Office of the County Counsel,and Public Works,and other overhead expenses. 2. Payment for Services. In consideration for the services to be provided pursuant to Paragraph l above,Agency shall pay County an amount not to exceed$750,00. That amount shall be paid periodically as billed,but in no event later than June 30, 1996, and if not paid by that date the Agency shall thereafter also pay interest on any unpaid balance remaining after June 30, 1996 at an annual rate equal to the County's average return on its short term investments during the period for which the interest is earned. The County will bill the Agency on a period basis throughout the term of this Agreement, and the Agency will provide for payment in a timely fashion. 3. Determination of Amount of Sedge and�P,a, ent. The Agency and County recognize that the amount the Agency is to pay the County pursuant to this Agreement represents an estimate of the County's costs of providing the estimated amount of County services the Agency will utilize during the 1995-96 fiscal year and that a determination ofthe precise amount of services provided and the cost of those services would be administratively difficult and expensive. Therefore, the County agrees to provide services as set forth in Paragraph 1 even if the cost of such services exceeds the estimated cost of those services at the time of execution of this Agreement, and the Agency agrees to pay the amount set forth in Paragraph 2 even if the cost of such services is less than the estimated cost of such service at the time of execution of this Agreement. 4. Subordination. The right of the County to payment by the Agency pursuant to this Agreement shall be subordinate to the Agency's obligation to pay principal,interest, or other payments on the Agency's existing or future bonds which are secured by a pledge oftax increment revenue payable to the Agency pursuant to Health& Safety Code Section 33670 or any other revenue source.
