Recommended Action: APPROVE and AUTHORIZE the Public Works Director to execute a license agreement with Contra Costa Public Works Early Childhood Center, a California non-profit corporation, for the development and operation, of a child care facility for care of children of County employees, in a County owned facility, for a term of ten years . II . Financial Impact: None III . Reasons for Recommendations and Background: On December 13, 1994, the Board of Supervisors approved a grant of up to $90, 000 to the Public Works. Department, to be used to cover start-up costs for a child care center for infant, toddler, and preschool children of County employees . A private, non-profit corporation, Contra Costa Public Works Early Childhood Center, has been formed to develop and operate the child care center and a license agreement between the County and the corporation is necessary to allow the County funds to flow to the corporation for expenditure on start-up costs, including, but not limited to, building modifications, exterior play area development, toys and supplies, first year insurance, and professional services . The agreement also provides for license fee payments by the Corporation to the County for the use of the County owned facility where the child care center will be located. IV. Consequences of Negative Action: The funding which the Board of Supervisors has authorized cannot be implemented and about $30, 000 in building modification and professional services expenditures already incurred cannot be c ered. COUNTY is the owner of certain real property shown in green in Exhibit "A" attached hereto (the "Property"). LICENSEE desires to obtain COUNTY's permission to use the Property and COUNTY is willing to grant a license to use the property upon the terms and conditions contained herein. Now, therefore, the parties agree as follows: 1. Grant of License. Subject to the terms and conditions of this Agreement, COUNTY hereby grants to LICENSEE, a nonexclusive license to use the Property, a portion of the premises commonly known as 255 Glacier Dr., Martinez, California, containing a 36' x 60' building and necessary appurtenances, including non-exclusive use of the existing parking lot, for the purpose of providing child care services to the children of employees of Contra Costa County. 2. Term. The term of this Agreement shall be for the period commencing March 1, 1995 and ending December 31, 2005. 3. County's Obligations. The COUNTY has determined that the program to be operated on the Property is necessary to meet the social needs of the population of the County and its employees. In consideration of the faithful performance and observance by the LICENSEE of all of the terms and conditions contained herein, the COUNTY does hereby grant and advance to LICENSEE the sum of $90,000 to establish and provide the program ("Grant"). 4. Licensee's Obligations. Licensee shall provide services and carry out the work described in the "Budget of Estimated Program Expenditures" attached hereto as Exhibit"B" and made a part hereof. Licensee agrees to administer and operate an infant/preschool program for eligible children in accordance with Title 22, Division 12, of the California Code of Regulations which is incorporated herein by reference, and in accordance with the "Kids At Work Parents Handbook" and with the "Service Plan", both attached hereto as Exhibits "C" and "D" and made a part hereof. 1 5. Fee. As consideration for the granting of this License to use the Property, LICENSEE agrees to pay COUNTY a License Fee of $800 per month, payable in advance on the first day of each month beginning January 1, 1996. LICENSEE has the right to prepay any License Fee prior to the month in which it would otherwise become due. 6. Licensee's Right to Terminate. LICENSEE shall have the right to terminate the License at any time upon 30 days prior written notice to COUNTY subject to the terms and conditions of this Section. In the event that LICENSEE elects to terminate the License prior to December 31, 2005, LICENSEE shall pay a Termination Fee to COUNTY in the amount of the remaining License Fee payments that would otherwise have been due through December 31, 2005. Any portion of the License Fee, over and above the amount of the required monthly License Fee payments, which has been prepaid by LICENSEE to COUNTY prior to the Termination Date will be deducted from the Termination Fee along with 5% per annum simple interest from the date of said prepayment. 7. Use of Premises. LICENSEE covenants and agrees that the Property shall be used only for the operation of an infant/preschool program pursuant to the Service Plan and not for any other purpose. 8. Pennits and Approvals. LICENSEE shall be responsible for obtaining any program permits or approvals from any agency having jurisdiction. This Agreement does not constitute governmental approval by Contra Costa County of this use or program. 9. Pollution: LICENSEE, at its expense, shall comply with all applicable laws, regulations, rules, and others, with respect to the use of the Property, regardless of when they become or became effective, including, without limitation, those relating to health, safety, noise, environmental protection, waste disposal, and water and air quality, and furnish satisfactory evidence of such compliance upon request of COUNTY. No hazardous materials shall be handled at any time upon the Property. Should any discharge, leakage, spillage, emission or pollution of any type occur upon or from the Property due to LICENSEE's use and occupancy thereof, LICENSEE, at its expense, shall be obligated to clean all the property affected thereby, whether owned or controlled by COUNTY or any third person, to the satisfaction of COUNTY (insofar as the property owned or controlled by COUNTY is concerned) and any governmental body having jurisdiction thereover. 2 To the extent permitted by law, LICENSEE shall indemnify, hold harmless, and defend COUNTY and such holders of user rights against all liability, cost, and expense (including, without limitation, any fines, penalties, judgments, litigation costs, and attorneys' fees) incurred by COUNTY and such other users as a result of LICENSEE's breach of this section or as a result of any such discharge, leakage, spillage, emission or pollution, regard- less of whether such liability, cost or expense arises during or after the term of this License, unless such liability, cost or expense is proximately caused solely by the active negligence of COUNTY. LICENSEE shall pay all amounts due COUNTY under this section within ten (10) days after any such amounts become due. 10. Hold Harmless. LICENSEE shall defend, indemnify, save, and keep harmless the COUNTY and its agents against all liabilities, judgments, costs, and expenses which may in any way accrue against COUNTY in conse- quence of the granting of this License, save and except claims or litigation arising from the sole negligence or sole willful misconduct of COUNTY. 11. Insurance. LICENSEE agrees, at no cost to the COUNTY, to obtain and maintain during term of this License, comprehensive liability insurance with a minimum combined single-limit coverage of $1,000,000 for all claims or losses due to bodily injury, sickness or disease or death to any person, or damage to property, including loss of use thereof arising out of each accident or occurrence, and to name Contra Costa County, its officers, agents, and employees as additional insured thereunder. Such insurance for additional insureds shall apply as primary insurance, and any other insurance maintained by COUNTY, its officers, agents, and employees shall be excess only and not contributing with the insurance required under this section. Throughout the term of this License, LICENSEE, at its sole cost and expense, shall maintain in full force and effect, insurance for statutory California Workers' Compensation coverage, including a broad form all- states endorsement, and Employer's Liability coverage for not less than one million dollars ($1,000,000) per occurrence for all employees engaged in services or operations under this License. All said coverages shall provide for a thirty (30) day written notice to COUNTY of cancellation or lapse. Evidence of such coverage shall be furnished to COUNTY prior to execution of this License. All policies shall be issued by companies which hold a current policy holder's alphabetic and 3 financial size category rating of not less that A:XII according to the current Best's Key Rating Guide, unless otherwise approved by COUNTY. 12. Utilities, Maintenance and Repairs. LICENSEE agrees to provide its own janitorial services or contract for same at its own expense, unless otherwise directed by COUNTY. LICENSEE shall maintain the interior of the Property in good order, condition, and repair, and shall not commit, suffer, or permit any waste on or to the Property. COUNTY agrees to provide maintenance of the roof, exterior and structural integrity of the building, including doors, locks and windows, except LICENSEE shall pay for the cost of such work if the damage is caused by LICENSEE'S use. COUNTY shall repair and maintain the electrical, lighting, water, plumbing, heating and ventilating systems. COUNTY shall be responsible for correcting any code violations existing on the Property except those arising out of and directly related to LICENSEE'S use of the Property. 13. Possessory Interest Tax. The Contra Costa County Assessor has invoked a possessory interest tax on all rentals of COUNTY and other publicly- owned properties. This tax is mandatory by law and is levied on the LICENSEE and not the property. The occupant of the property on the lien date, March 1 of the current year, is liable for full payment, even if LI- CENSEE subsequently vacates the premises. LICENSEE, therefore, must recognize and understand, in accepting this License, that its interest therein may be subject to a possible possessory interest tax that the County Assessor may legally impose on such possessory interest held by the LICENSEE, and that such tax payment shall not reduce any fee due the COUNTY hereunder and such tax shall be the liability of, and be paid promptly by, the LICENSEE when due. 14. Assignment - Subletting. LICENSEE shall not assign or sublet LICEN- SEE's rights under this Agreement. 15. Revocable Use. The COUNTY at its sole discretion may, at any time, immediately revoke this License upon 30 days prior written notice. The installation or construction of any equipment or fixtures by LICENSEE shall not render this revocable license irrevocable and shall not be construed to effect a conveyance of any property right. 4 16. Entire Agreement. This instrument contains the entire agreement between the parties relating to the rights herein granted and the obligations herein assumed. No alteration or variation of this Agreement shall be valid or binding unless made in writing and signed by the parties hereto. We want to be an extension of your family. In doing so, we will provide your child with a developmentally appropriate program with enjoyable and educational choices in a safe, stimulating and nurturing environment, staffed by quality, educated and dedicated staff. We will provide you, the parent, with the security and peace of mind that your child is well cared for and happy. We encourage you to communicate with the staff as much as possible. This Handbook has been complied using the questions most asked by parents. We hope you will find the information and answers about our program that may be of help in choosing the quality care you seek for your child(ren). Please read the information carefully. On the last page, you will find a return form. After reading the material in the Handbook, please sign and return the form to the Director. This will let us know that you have read the information about our program. If you have any questions, please feel free to call or see the Director. PROGRAM PHILOSOPHY AND GOALS CONTRA COSTA PUBLIC WORKS EARLY CHILDHOOD CENTER Contra Costa Public Works Early Childhood Center provides services designed to meet the needs of working parents and their children. The family is the primary influence on children's growth and development. Contra Costa Public Works Early Childhood Center strives to provide both a secure and nurturing environment and a stimulating and intellectually enriching developmental program. Quality child care at Contra Costa Public Works Early Childhood Center means actively assisting in the development of each child's social, emotional, physical and intellectual potential. This is achieved through provision of stable, safe, healthy, and educationally enriching programs designed in a homelike atmosphere. • Children grow and develop in a predictable, sequential manner, though at their own pace. • Children are curious and actively initiate their own learning. The teacher becomes a facilitator who creates and guides them developmentally. • Children learn by observing and interacting with objects and people in their environment. • Children learn through play. • Children's self-esteem and ability to make decisions is rooted in their appreciation of their own cultural heritage and uniqueness. The teachers play*an instrumental role in partnership with the parents to assist in children's development. They help parents to cope, understand, and learn to form healthy relationships with their children. We believe that teachers should be valued, respected, nurtured and provided with support and professional growth opportunities to fulfill their potential. Contra Costa Public Works Early Childhood.Center provides care to families without regard to race, color, religion, national origin, sex or age. ADMISSIONS "Kids at Work" welcomes children between the ages of 8 weeks through 5 years, provided they have not yet entered Kindergarten, and whose parent(s) are employed by Contra Costa County, with first preference going to those parents employed by the Public Works Department. HOURS OF OPERATION "Kids at Work" is open from 6:30 a.m. to 6:00 p.m., Monday through Friday. Children are welcome to attend anytime during standard hours of operation. Children who are enrolled for less than five days may "add" a day, on a space available basis. Please make arrangements with the Director as soon as you know you will need additional hours. HOLIDAYS "Kids at Work" will be closed for the following Holidays: New Year's Day January 1 Martin Luther King Jr. Day 3rd Monday in January President's Day 3rd Monday in February Memorial Day Last Monday in May Independence Day July 4 Labor Day 1 st Monday in September Veteran's Day November 11 Thanksgiving Day and Day After Last Thursday and Day After in November Christmas Day December 25 NOTE: If any of the above holidays fall on a Saturday, we will closed the proceeding Friday. If any of the above holidays fall on a Sunday, we will be closed the following Monday. Because local and State Licensing regulations require that we engage staff based on the number of children enrolled, we are unable to give credits for individual days missed due to illness or holiday. See ABSENCESNACATION for more information. ABSENCESNACATIONS As stated above, we are unable to offer tuition credit for days missed due to illness, holidays, or individual vacation days; however, after one consecutive year of enrollment, your child may take one week of vacation from the Center at a 50 percent discount provided the Director is given two week written notice, whenever possible. This week of vacation cannot be accumulated from year to year. Please inform the Director, as soon as possible, if your child will not be in school due to illness or vacation. ARRIVAL AND DEPARTURE In the entry way is a binder with sign in and out sheets for each child. It is imperative that you sign your child in and out upon arrival and departure each day with the time and your full signature, as these binders are taken with us in the event of an evacuation so we can account for each child in our care. NOTE: if you will be unable to pick your child(ren) up from school, PLEASE let the Director know who will. Your child(ren) will NOT be released to anyone not previously authorized by the parent(s). FEES There will be a $50 non-refundable registration fee when you register your child(ren). This is not a annual fee and is per family, if all children are registered at the same time. Our Center closes at 6:00 p.m. and children need to be picked up by then. In the event you are late, there is a fee of $1 per minute, payable when you arrive to pick up your child(ren) up. Consistent late pick ups may result in disenrollment. Tuition is due each Monday,.or on your first day of attendance. A $20 late payment fee will be charged at noon, Tuesday, or the day after your first day of attendance, for any tuition not paid. Outstanding balances cannot be "carried' for more than two weeks and will result in disenrollment. Although tuition is charged weekly, payment may be made monthly, or bi-monthly, as long as your account is always kept current. DISCIPLINE Maintaining a peaceful flow in the classroom has many contributing factors. We offer a variety of developmentally appropriate, creative activities to interest your child(ren), which also serve as a tool for redirection, when necessary. Teachers consistently monitor the classroom activities so they can prevent an event before it happens. We do not use "time- out" as a method of discipline, but believe in positive methods of discipline and communication. TOILET LEARNING When to start?! Your child will probably exhibit some key indicators to let you and our staff know that he/she may be ready to begin the process. Does your child stay dry for several hours? Is your child able to communicate his/her need to use the toilet, either verbally or otherwise? Does your child have an awareness of wetting or soiling his/her diaper? ,Is your child in a cooperative sprit? Some children may oscillate between periods of cooperativeness and negativism. It is best to begin the process while he/she seems in a period of cooperativeness. Once you have decided it is TIME, please keep our staff informed so we can work tnnathar MEDICATION Prescription Medication: Must be in the original prescription bottle, clearly labeled with the child's name and exact dosage. Medications must be signed into the binder in the entry way. Children who require on-going medication will need a physician's release form on file. ILLNESS POLICIES It is never easy to determine how ill a child is. It is very important that you, or someone else, noted in your child's file, is always available to pick your child up in the event of illness. Your child must be picked up within one hour from the time of notification. Please remember that it is for the health and safety of all the children in our care that we adopt these polices. The following guidelines are based on recommendations by the Health Department. Your child will be excluded from school if one or more of the following conditions exists: Fever at or above 100.0 ' 'Fever at or above 99.8 for more than two 2 days Three (3) episodes of diarrhea in one (1) day OR once accompanied by fever. Vomiting once with fever or two (2) times without fever Excessive coughing, sneezing or thick, cloudy, yellow/green mucus with a fever or that which persists for three (3) days. There may be times your child doesn't necessarily exhibit any of the above symptoms, yet he/she just doesn't feel well enough to participate or appears lethargic. In cases such as these, we will call the parent to keep you informed, so you can decide if you can pick your child up. If your child is sent home for any of the exclusion symptoms, they must remain home from school for a minimum of 24 hours after symptoms have abated. Children sent home from school will be accompanied with a note, stating conditions for return. COMMUNICABLE DISEASES It is very important that you notify us immediately if your child has been diagnosed with a communicable disease so we can immediately notify parents of the other children. Should your child be exposed to a communicable disease, a note will be posted explaining what your child has been exposed to and what symptoms to look for. EMERGENCY PROCEDURES If a child is mildly injured, first aid will be administered. The injury will be recorded on an accident form sent home at the time of pick up. In some cases, the parent may be called. If a child needs medical attention, but it is not an emergency, the parent will be contacted. If the parent cannot be reached, we will make every attempt to contact one of the people listed on the emergency forms in your child's file. In the case of a severe injury, 911 will be called and the child will be transported by ambulance to the nearest medical facility. A member of our staff will accompany the child and the parent will be notified immediately. DISASTER PREPAREDNESS In the event of a major catastrophe (i.e., earthquake, fire, etc.) when we must evacuate the building, the children and staff will be evacuated, when safe, to Hidden Valley Elementary School, 500 Glacier Drive, Martinez. Emergency cards will be brought with us so we can contact parents, if possible. It is important to know: All staff will remain with children All staff have current First Aid and CPR training We are equipped with First Aid supplies NOTE: Please be sure emergency information is always kept current. BIRTHDAYS Children are welcome to celebrate their birthdays with us here at school. Typically, parties are held after nap. Because State law regulates that each child receive a nutritious snack, consisting of two or more food group, we will serve party "goodies" after our snack has been served. Parents are welcome to bring nutritional snacks rather than sweets to celebrate your child's birthday, meeting State Licensing regulation, in which case, we will forego the menu snack. SHARE TOYS Labeled books and tapes are always welcome. Share toys should be limited to your child's "share day", posted in his/her classroom. When a child begins day care, it is sometimes comforting to bring a "security item" such as a favorite stuffed animal or a picture of the family. In addition, a "security item" may be brought for nap time. We ask that you avoid bringing "war toys" (i.e., toy guns, etc.) DISENROLLMENT In the event you are no longer employed by Contra Costa County and lose your eligibility with us, we will provide you with a 30-day grace period to find other care for your child(ren) if we have a waiting list. This will enable you to make other arrangements and give your child(ren) a smooth transition. If we do not have a waiting list, your child(ren) may remain enrolled until space is needed for eligible employees, at which time you will be given a 30- day notice to find other care. Should you decide to disenroll for any reason, we require a two (2) week written notice. Should a child pose a threat to him/herself or others, he/she may be disenrolled and ONLY after every attempt has been made to correct the situation. NUTRITION "Kids at Work" provides a mid-morning and afternoon snack. Parents are asked to bring their children to school with a nutritious lunch each day. Our snack menu will be included in the monthly newsletter and will be posted on the Parent Info. Board in the entry way. If your child has a food allergy or dislikes any item on the menu, please send a replacement item with his/her lunch and inform the Director. Should you forget your child's lunch, every attempt will be made to contact you so you can bring a lunch in. If we are unsuccessful, we will provide a lunch and your account will be charged. REST PERIODS All children in our Infant/Toddler and Preschool programs have at least one rest period. This does not mean that children are required to sleep, however, they do need "quite" time. This is a time to unwind and listen to quiet, soothing music as Teachers softly rub the children's backs. "Kids at Work" will provide the cribs/mats and sheets. Parents are asked to bring a small blanket, which we ask you to take home each Friday, or the last day of attendance for the week, to wash. CLOTHING Please bring one complete change of clothing for your child. Children feel more comfortable and secure when they can wear their own clothing in the event of an accident or mishap. Please remember to label each item of clothing with your child's first and last name. Children love to run and climb, so we ask that you bring your child to school in closed toe shoes, with grip soles and no heel. NEWSLETTER Each month a newsletter will be available to parents, hi-lighting the month's activities and upcoming events, in addition to the snack menu and an activity calendar. CONFERENCES Parent/Teacher conference will be offered twice a year for preschool children. Parents or the Director may request a conference any other time throughout the year as necessary. CLASSROOM REPRESENTATIVE Classroom Representatives are parent volunteers who will coordinate, with staff and other parents, upcoming events, parties, etc. In addition, the Classroom Representatives will also coordinate the donation of needed items for the school. Please let the Director know if you are interested in volunteering some time to be a Classroom Representative, PARENT SUPPORT GROUP Once every two months, we welcome all parents and staff to join us for an hour or so, in the evening, where we can "brainstorm," and discuss upcoming events, etc. There is no need to "commit" to any long term obligations. SERVICES This agreement provides a grant and advance for start-up costs, including building and property modifications, supplies, furniture, professional advice and costs of incorporation, permits, licensing, and the first year's insurance coverage. In consideration of the grant, Licensee agrees to administer and operate an infant/preschool program for eligible children in accordance with Title 22, Division 12, of the California Code of Regulations which is incorporated herein by reference, and in accordance with the "Kids At Work Parents Handbook" (attached). 2. ELIGIBLE POPULATION TO BE SERVED Children between the ages of eight weeks and enrollment in kindergarten with one or both parents being employees of Contra Costa County. The facility will be licensed for both infant/toddler care and pre-school care. The number of children in each program may vary, depending on demand, up to the maximums allowed by the respective licenses. 3. CRITERIA FOR RECEIPT OF SERVICE As described in 2. (above) except as limited by the State License, which is expected to be for a maximum of 20 to 25 children. 4. FACILITY, INCLUDING ADDRESS The program will be operated in a single facility, a 36' x 60' building owned by the Public Works Department and located on County-owned land adjacent to the County Public Works Department offices. TIME(S) SERVICE IS TO BE PROVIDED The Center will be operated from 6:30 a.m. to 6:00 p.m., Monday through Friday, and will observe the same holidays as County employees. 6. PERFORMANCE STANDARDS OR GOALS The minimum standards and staffing ratios are as specified in Title 22, Division 12, of the California Code of Regulations. The budget provides for teacher-child and adult-child ratios 30% to 50% smaller than the maximums specified in the Code. Records and reports will be prepared and submitted in accordance with the Code and copies will be available to the County. At the request of County, Licensee shall, in a timely manner, provide to County reports on its criteria for accepting eligible children, charges and rates for such services, and such other and further information as may be requested by County. 7. STATE OR FEDERAL STATUTE OR REGULATIONS The Day Care Center will operate under licenses issued by the State of California in accordance with Title 22, Division 12, of the Code of Regulations.
