In the Matter of Providing a
One Time Only Retroactive Lump
Sum COLA Payment to Child
Development Division Management
and Designated Represented Employees
WHEREAS the Community Services Department projects expect that
there will be unspent, unobligated funds available for FY 94-95 .
However, the exact amount of each funds shall not be known prior to
the reconciliation of all revenues, expenditures, and encumbrances,
to be completed no later than September 30, 1995 .
WHEREAS, Board approval of the allocation of the unspent,
currently unobligated funds must be made prior to June 30, 1995 .
NOW THEREFORE,
The Contra Costa County Board of Supervisors in its capacity as the
governing Board of the County of Contra Costa, and all districts of
which it. is the ex-officio governing Board, RESOLVES THAT:
A one-time-only lump sum payment will be made to all Child
Development, Title IV-A and Preschool management and represented
Community Services Departmental employees in an amount not to
exceed two (2) % of the gross wage earned for each eligible Child
Development Division employee for the period of July 1, 1994,
through June 30, 1995, subject to the availability of unspent,
unobligated funds remaining from the 1994-95 Child Development,
Title IV-A and Preschool contracts.

Any employee who believes that an underpayment has been made
may contact the Community Services Department' s Personnel Officer
to request a review of their one-time-only lump sum COLA payment .
Upon such a request, the Auditor-Controller' s Office will
investigate and issue any additional pay, if owed, as soon as
possible.

Association, Local No. 1, re
Child Development Unit
BE IT RESOLVED that the Board of Supervisors of Contra Costa County
APPROVES the side letter(copy attached and included as part of this
document) , jointly signed by Richard Heyne, Employee Relations
Manager, and Henry Clarke, General Manager, Contra Costa County
Employees' Association, Local 1, and Joan Sparks, Director,
Community Services Department, regarding a one-time-only lump sum
payment to employees in the Child Development Representation Unit .
The proposed salary adjustment has been reviewed by the County
Administrator who has determined that it will have no impact on the
funding status of the County Employees: Retirement System.

Dear Ms. Mueller:
This side letter memorializes agreement between the parties for a
one-time-only, lump sum, cost of living payment to eligible
permanent and temporary project employees in the Child Development
and Preschool Program of the Community Services Department for the
period of July 1, 1994 through June 30, 1995 .
It is understood and agreed by the parties that"this one-time-only
lump sum cost of living payment in no way sets a precedent for the
allocation of monies in future fiscal contract years between the
State of California and the Contra Costa County Community Services
Department .
Lump sum cost of living payments will be made to eligible employees
inaccordance with the following criteria:
1 . Eligibility is based solely on employment earning history in
the 1994-1995' Child Development, Title IV-A and Preschool
programs for the period of . July 1, 1994, through June 30,
1995 .
2 . The amount of lump sum, costof living payment for each
eligible employee will be calculated by first dividing an
employee' s July 1, 1994 , through June 30, 1995 employment
earnings by the total Child Development, Title IV-A and
Preschool payroll for the above referenced time period to
arrive at a percent . For purposes of illustration, only, the
following formula is shown:

3 . The percentage derived by the formula shown in paragraph two
(2) above will then be multiplied by the net balance of
unexpended/unobligated funds remaining in the 1994-1995 Child
Development/Title IV-A contract budget . All 1994-1995
contract expenditures and encumbrances will be liquidated
first before the net balance of unexpended/unobligated funds
is determined.
4 . The payment amount computed will be issued as soon as possible
by the County Auditor-Controller shown on an employee' s
regular 10th of the month pay check as a Lump Sum payment,
subject to normal tax withholding deduction requirements.
Any employee believing there is an underpayment resulting from
the payment . methodology described above, may contact the
Community Services Department' s Personnel Officer to request
a review of her/his lump sum payment . Upon such a request,
the Auditor-Controller' s Office will investigate and issue any
additional pay, if owed, as soon as possible.
If the foregoing conforms to your understanding, please
indicate your approval and acceptance in the space provided
