SUBJECT: CHANGE IN BENEFITS AND ADMINISTRATION FOR ACTIVE MUNICIPAL
COURT JUDGES
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT resolution amending Resolution 92/107 covering compensation for County officers,
management and unrepresented employees to reflect a change in health, vision and dental
benefits and benefits administration for active municipal court judges, making those benefits
the same*as those provided by the state to superior court judges.
BACKGROUND:
The state has previously had no role in the administration of health, dental, vision and life
insurance benefits for municipal court judges because those payroll services and benefits
have been provided by county government. Assembly Bill 2544 (Isenberg - Chapter 308,
Statutes of 1994) and Assembly Bill 1084 (Isenberg - Chapter 389, Statutes of 1994),
effective July and August, 1994, requires that each sitting and retired municipal court judge
be provided the same health, dental and vision benefits as the state provides to each
superior court judge and transfers to the Administrative Office of the Courts (AOC) the
responsibility for administering the system to provide these benefits.
As a result of these changes, effective August 1, 1995, the Public Employees Retirement
System (PERS) and the Judges' Retirement System will enroll active municipal court judges
in the state health and dental benefit plans and corresponding County provided benefits will
be cancelled. County Municipal Court Administration will assume the coordinating role
for judges benefits administration, previously performed by the County Personnel
Department. A cost analysis revealed no additional County costs as a result of the new
benefits configuration.

WHEREAS health and dental benefits are being made available to all active
Municipal Court judges effective August 1, 1995 through the State
PERS/PEMCA benefits plan, which will be administered by the
State's Administrative Office of the Courts; and
WHEREAS this change in health and dental plan administration to the State
will not result in any increased costs for the County; be it
RESOLVED that the existing contractual agreement with the State PERS, for
health coverage -for active Municipal Court judges will be cancelled
effective August 1, 1995; and be it further
RESOLVED that dental coverage through the County for active Municipal Court
judges will be cancelled effective August 1, 1995; and be it further
RESOLVED that subvention by the Municipal Courts will be at the same rate
subvented by the State for Superior Court judges; and be it further
RESOLVED that Resolution 92/107 covering compensation for County officers and
management and unrepresented employees is hereby amended to reflect
these changes in benefits for Municipal Court judges; be it further
RESOLVED that new judges hired on or after November 9, 1994 will not be
offered benefits through the County that are provided by the State;
and be it further
RESOLVED should the State subsequently offer the same type of coverage for
benefits now provided by the County, Municipal Court judges will be
required to transfer to the State coverage and County coverage
subsequently cancelled; and be it further
RESOLVED that the administration of current health and dental benefits for
active Municipal Court judges, and future 'benefit programs provided
by the State, will be handled by the Central Administration Office
of this county's Municipal Courts effective August 1, 1995.
