SUBJECT: al to the Board by Mr. Karl Strnad to request suspension of the enforcement
of Abandoned Vehicle Ordinance, 95-2.
SPECIFIC REQUESTS) OR,RECOMMENDATION(S) A BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
Authorize the Sheriff to proceed with enforcement of County Ordinance 86-58(formerly)and 95-2(currently) requiring
the removal of an inoperable vehicle or parts thereof from private property, located at 240 Yale Ave., Kensington.
The Sheriff requests the Board deny the appeal and direct the Sheriff to proceed with the abatement action as
scheduled.
II. BACKGROUND INFORMATION:
The original complaint came from the Building Inspection during the month of May, 1994.
The first site inspection was conducted on 5/26/94. A 1964 Lincoln Continental, 4 door tan, was observed sitting
sideways in the driveway with all four tires flat and curled under the vehicle.
June 20, 1994, Mr. Karl Strnad requested a hearing regarding the planned abatement.
June 23, 1994, Supervisor Tom Powers responded in writing to Mr. Strnad's inquiry as follows:
"There has been a complaint about your car so we must enforce the ordinance, and there is no motivation to change
this law. I suggest you take efforts to store your car in a proper location."
Mr. Strnad requested a hearing in writing by mail on July 28, 1994. Our department replied by mail on August 11,
1994. Our decision was the vehicle is inoperable, motor frozen, and the vehicle has to be removed from the
driveway.
Mr. Strnad wrote another letter dated October 7, 1994, stating the vehicle is still inoperable, but he wanted us to
suspend enforcement of the ordinance.
On October 31, 1994, Mr. Strnad requested a date for a hearing before the full Board of Supervisors.
On Monday, February 13, 1995, a site inspection was conducted and the vehicle was found parked in exactly the
same conditionrand position as it was on the first site inspection on May 26, 1994. Photos,were taken at this time.
An Administrative Hearing was conducted to consider the appeal on March 13, 1995, in front of the Zoning
Administrator. The Hearing Officer denied the appeal and advised the property owner to immediately remove the
inoperable vehicle.
