SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
CONSIDER taking a position on the following legislation:
AB 1995 (Cortese) - Local Public Water Systems.
Water Committee recommendations: Support and Watch.
AB 584 (Rainey) - General Plans; Revisions: Water Planning Information.
Water Committee recommendations: Support and Watch.
AB 1332 (Sweeney) - Environmental Quality: Public Water Systems.
Water Committee recommendations: Watch.
SB 901 (Costa) - Water Supply Assessments.
Water Committee recommendations: Support and Watch.
REASON FOR RECOMMENDATION/BACKGROUND
The Board's Water Committee discussed the above-mentioned legislation at their last meeting. Full
agreement on one recommended position to the Board was not forthcoming, with the exception of AB
1332. A summary of this legislation and County Water Agency rationale for recommendations is on
file with the Community Development Department.
This item was pulled from the May 23, 1995 Board agenda, and Water Agency recommendations were
removed in accordance with Board member request.

BACKGROUND ON PROPOSED WATER-RELATED LEGISLATION
AB 1005 CORTESE: LOCAL PUBLIC WATER SYSTEMS: SERVICE NEEDS
Background
This proposed legislation requires specific information to be included in local
government General Plans and would require a local agency to refer proposed General
Plan or General Plan Amendments to the respective water district for projects outside
water district current service boundaries. The Water district would then make specific
findings; if no findings are forthcoming within a prescribed time limit, the project may
proceed. Water district findings must include the ability to serve categorical hierarchy;
1) existing customers in service area, 2) future customers in service area, 3) future
customers outside service area, 4) future customers outside the district sphere of
influence. If the development is outside the water district service area, water needs
for the first three categories need to be examined; if outside the district sphere of
influence as well, then category 4 must be included. The local government may not
adopt a General Plan or General Plan amendment unless a finding of consistency is
made with the water district, or another source of water is found.
AB 584 RAINEY• GENERAL PLANS• REVISIONS: WATER PLANNING INFORMATION
Background
At the time of General Plan revision (after January 1, 1996) or substantial
amendment, local government must consider information from water districts, and
include this information in the General Plan. Information regarding water supply
availability, such as the Urban Water Management Plan, water supply sources,
quantities of surface and groundwater, and other sources of potential supply must be
provided from water suppliers with 3,000 or more service connections. Also required
would be a list of total customers, by type (agricultural, commercial, industrial, and
residential) and quantification of any expected reduction in total water demand by
type. Local government shall consider this information in review of any proposed
general plan amendments.

AB 1332 SWEENEY: ENVIRONMENTAL QUALITY: PUBLIC WATER SYSTEMS
Background
If a public water district with more than 3,000 service connections may be affected
by a proposed project, this legislation requires the lead agency to consult with the
respective water district to obtain information. Information required of the water
district would include effects of the proposed project on the water district service
ability, both in terms of existing customers and reasonably foreseeable projects.
SB 901 COSTA: WATER SUPPLY ASSESSMENTS
Background
Where an Environmental Impact Report (EIR) is required in connection with a general
plan or general plan amendment, this proposed legislation would require local
government to identify proposed water systems which may provide service to any
new development. Local government must request from these agencies a prescribed
water supply and demand reliability assessment within 120 days. If the water district
finds that water supplies are insufficient, this will be considered a significant impact
under the California Environmental Quality Act (CEQA).
