APPROVE Waiver of Claim dated May 29, 1995, from Jun Ko Ka and Song Su Ka. B. AUTHORIZE the Public Works Director or his designee to execute said Waiver of Claim on behalf of the County. C. APPROVE payment of$500 and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to Jun Ko Ka and Song Su Ka, 308 Verona Avenue, Danville, CA., 94526, to be forwarded to the Real Property Division for delivery. Financial Impact: $500.00 from the Southern Pacific Right of Way Trust Fund. III. Reasons for Recommendations and Background: Mr. and Mrs. Ka own property at 308 Verona Avenue, Danville, adjacent to the former Southern Pacific right of way. They claim that a thirty-foot section of their redwood fence was destroyed by a tree falling from County-owned property. In consideration of$500 as compensation for the damaged fence, the Kas waive all further claims against the County for property damages. IV. Consequences of Negative Action: The County will be exposed to potentially greater losses.
