(LL-2), OAKLEY AREA. PROJECT NO: 4500-6X5416
Specific Request(s)or Recommendation(s)&Background&Justification
I. Recommended Action:
ADOPT the Resolution confirming the Engineer's Report annexing Subdivision 6927 to Zone 23 of the
Countywide Landscape District and levying the first annual assessment.
II. Financial Impact:
Formation and annexation of proposed zone to the Countywide Landscape District(LL-2) and assessments
for Fiscal Year 1995-1996 will raise funds to be used solely on maintenance work in the zone.
III. Reasons for Recommendations and Background:
The proposed annexation of Subdivision 6927 into the existing Zone 23 of the Countywide Landscape District
is necessary to implement a requirement of the Conditions of Approval for new subdivisions, which require
the inclusion of the subdivision within the Countywide Landscape District. This action will provide the
funding mechanism for maintaining and servicing landscape and irrigation facilities constructed as part of
the subdivision improvements. The assessments will be levied in the upcoming Fiscal Year 1995-1996. The
amount of the first year levy will be no more than the amounts described in the Engineer's Report, and in
some cases may be less the first year if all the landscape improvements have not yet been installed.
On June 20, 1995, it was determined that the activity is not subject to the California Environmental Quality
Act(CEQA)pursuant to Section 15061(b)(3) of the CEQA Guidelines.
IV. Consequences of Negative Action:
Funds will not be available for maintaining the landscaping and other improvements in the zone.

SUBJECT: Confirmation of Engineer's Report,Formation of Landscaping Zone,Annexation to
the Countywide Landscape District and Levying First Annual Assessment,
Subdivision 6927, Zone 23, Oakley Area.
Pursuant to the Lighting and Landscaping Act of 1972,the owner of the land within the area known
as Zone 23 having requested that Subdivision 6927 be included within the Countywide Landscape
District and be assessed annually for the cost of maintaining those improvements described in the
Engineer's Report and, the owner having waived the right to notice and public hearing, on the
annexation to the Countywide Landscape District and the levying of the first annual assessment; and
The Board also finds that the engineer of work, in the Engineer's Report, has fairly and properly
apportioned the cost of maintaining the improvements to each parcel of land in Zone 23 in
proportion to the estimated benefits to be received, and the annual assessment as described in the
Engineer's Report is a range of assessments with the maximum amount to be assessed per parcel and
to be levied on the Fiscal Year 1995-1996 tax rolls.
NOW THEREFORE BE IT RESOLVED THAT,the Board of Supervisors ADOPTS the Engineer's
Report,and ORDERS the annexation of Subdivision 6927 to Zone 23 of the Countywide Landscape
District(AD 1979-3,LL-2),and the levy and collection of the first annual assessment for Fiscal Year
1995-1996.

Zone 23 was previously comprised of 112 units in Subdivision 6922. The action forming Zone 23 for Subdivision
6927 will combine the landscaping facilities to be maintained with both Subdivisions 6922 and 6927, and add an
additional 38 parcels resulting in Zone 23 being comprised of 150 parcels. Both subdivisions are contiguous with
each other and will share common irrigation facilities.
