Specific Request(s)or Recommendation(s)&Background&Justification
I. Recommended Action:
ADOPT the Resolution confirming the Engineer's Report, forming the landscaping zone, annexing to the
Countywide Landscape District and levying the first annual assessment for Zone 60.
II. Financial Impact:
Formation and annexation of proposed zone to the Countywide Landscape District(LL-2) and assessments
for Fiscal Year 1995-1996 will raise funds to be used solely on maintenance work in the zone.
III. Reasons for Recommendations and Background:
The proposed formation of Zone 60 is to implement a requirement of the Conditions of Approval for new
subdivisions which require the inclusion of the subdivision area in Countywide Landscape District(LL-2)
for the purpose of establishing funding for maintaining and servicing landscape and irrigation facilities
constructed as part of the subdivision. The assessments will be levied in the upcoming Fiscal Year 1995-
1996. The amount of the first year levy will be no more than the amounts described in the Engineer's Report,
and in some cases may be less the first year if all the landscape improvements have not yet been installed.
On June 20, 1995, it was determined that the activity is not subject to the California Environmental Quality
Act(CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines.
IV. Consequences of Negative Action:
Funds will not be available for maintaining the landscaping and other improvements in the one.

SUBJECT: Confirmation of Engineer's Report,Formation of Landscaping Zone, Annexation to
the Countywide Landscape District and Levying First Annual Assessment,
Subdivisions 6935 and 7809, Zone 60, Oakley Area.
Pursuant to the Lighting and Landscaping Act of 1972,the owner of the land within the area known
as Zone 60 having requested that Tract No's. 6935 and 7809 be included within the Countywide
Landscape District and be assessed annually for the cost of maintaining those improvements
described in the Engineer's Report and, the owner having waived the right to notice and public
hearing on the formation of Zone 60, annexation to the Countywide Landscape District and the
levying of the first annual assessment; and
The Board also finds that the engineer of work, in the Engineer's Report, has fairly and properly
apportioned the cost of maintaining the improvements to each parcel of land in Zone 60 in
proportion to the estimated benefits to be received, and the annual assessment as described in the
Engineer's Report is a range of assessments with the maximum amount to be assessed per parcel and
to be levied on the Fiscal Year 1995-1996 tax rolls.
NOW THEREFORE BE IT RESOLVED THAT,the Board of Supervisors ADOPTS the Engineer's
Report, and ORDERS the formation of Zone 60 and annexation to the Countywide Landscape
District(AD 1979-3,LL-2),and the levy and collection of the first annual assessment for Fiscal Year
1995-1996.

GENERAL DESCRIPTION OF IMPROVEMENTS
TO BE MAINTAINED
Zone 60 - Tracts 6935 and 7809
Landscaping improvements are located within the public right of way, fronting Laurel
Road and Highway 4, along the frontage of Subdivisions 6935 and 7809 to their point
of intersection. Landscape improvements also include the Laurel Road median
islands and Parcel B (play lot).
Landscape improvements total approximately 2,150 linear feet along Laurel Road and
Highway 4 and vary in width from ten to fifteen feet. The Laurel Road median
improvements are approximately 1,160 linear feet and vary in width from five to
sixteen feet. Parcel B, the play lot, is approximately 0.17 acres.
