SUBJECT: DESIGNATING FLOOD CONTROL DISTRICT REPRESENTATIVE TO THE MANAGEMENT
COMMITTEE OF THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
ADOPT resolution naming the Chief Engineer or his designee as the Flood Control and Water
Conservation District representative to the NPDES Management Committee.
II. Financial Impact:
None to General Fund. NPDES activities are funded by a Stormwater Utility Assessment.
III. Reasons for Recommendations and Background:
The Flood Control District works with Contra Costa County and seventeen of its municipalities to perform
activities required under a joint National Pollutant Discharge Elimination System permit. The nineteen
jurisdictions received their permit from the San Francisco Bay and Central Valley Regional Water Quality
Control Boards. Planning and guidance on joint activities is performed by a Management Committee
which consists of one voting representative from each of the nineteen jurisdictions. The attached
resolution names the Chief Engineer or his designee as the representative from the Flood Control District
to the Management Committee.
IV. Consequences of Negative Action:
The Flood Control District would have no one to represent its interests on NPDES policy and financial
questions.

SUBJECT: RESOLUTION APPROVING PARTICIPATION IN STORM WATER GROUP
ACTIVITIES AND COSTS DESIGNATING FLOOD CONTROL AND WATER
CONSERVATION DISTRICT REPRESENTATIVES TO THE NATIONAL
POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES)
MANAGEMENT COMMITTEE
The Board of Supervisors of Contra Costa County; as the Governing Body of the Contra
Costa County Flood Control &Water Conservation District, RESOLVES THAT;
WHEREAS,on November 16, 1990, the Federal Environmental Protection Agency adopted
NPDES Permit Application regulations for storm water discharges as required by the Federal Clean
Water Act; and
WHEREAS, said regulations require the submittal of permit applications and the
implementation of programs to minimize or eliminate pollutants from entering storm waters; and
WHEREAS,the State of California's San Francisco Regional Water Quality Control Board
has mandated that Contra Costa County, seventeen (17) of its incorporated cities and the Contra
Costa County Flood Control and Water Conservation District be covered by one area wide municipal
permit; and
WHEREAS,all nineteen municipalities have participated in permit application activities and
have received NPDES Municipal permits from the San Francisco Bay and Central Valley Regional
Water Quality Control Boards; and
WHEREAS,a joint effort between the Cities, County, and Flood Control District in a joint
area wide municipal NPDES permit will minimize the cost of the program to all parties; and
WHEREAS,it is the intent of the joint effort between the Cities, County, and Flood Control
District not to dictate land use and zoning; and the success of the permit process is dependent upon
the cooperation of each participating entity.
NOW,THEREFORE BE IT RESOLVED,this District Governing Board shall participate
in the implementation of an area wide Joint Municipal NPDES permit agreeing to provide appropriate
staff support and provide detailed information necessary to implement the permit.
BE IT FURTHER RESOLVED that the Chief Engineer or his designee is designated as the
Flood Control and Water Conservation District representative to the NPDES Management
Committee.
