SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT a position in SUPPORT of SB 1290 by Senator Tom Hayden which,
as amended April 17, 1995 would provide funding for improved
security at women's health clinics .
BACKGROUND:
Senator Hayden has introduced SB 1290 to provide a source of
funding for security improvements at women' s health clinics . As
amended April 17, 1995, SB 1290 would do all of the following:
✓ Define the term "qualified women' s health care clinic" as a
facility which is licensed as a community clinic and where at
least 50% of the encounters are female.
✓ Provide that entities that are qualified women' s health care
clinics are eligible for grants for security improvements .
✓ Require the State Department of Health Services to award
contracts through a request for financial assistance, pursuant
to a specified division of the Health and Safety Code.
✓ Provide that decisions regarding priorities for funding may be
based on, but need not be limited to:
• Whether at least 30% of the clinic 's encounters are for
family planning services .
• Whether the clinic has a past history of violence or
threats, as defined.

• Whether the entity has been a target for violence on the
local, state or national level .
✓ Require that as a part of the grant application the clinic
supply a security analysis conducted by a law enforcement
agency.
✓ Require that grants be distributed on or before July 1, 1996 .
✓ Express the intent of the Legislature that funding for the

✓ Provide that an unspecified amount of money be transferred

I urge the Board of Supervisors to support this important
legislation that would assist women' s health clinics to improve
their security so they are not as vulnerable to violence and attack
as has been true in the past.

The California State Senate will soon vote on Senate BILI 1290(Hayden),which would
establish the Health Facility Security Fund. The security fund would be used to
provide grants to nonprofit women's health facilities for security improvements.
Senator Hayden has made a budget request of$1 million to provide financing for the
bill.
The Bureau of Alcohol,Tobacco and Firearms has recorded 24 incidents of violence In
California since 1990 and in the last year six clinics in the state have been the victims
of arson attacks. Planned Parenthood:$hasta-Diablo's Chico dinic,for example,was
firebombed on October 9, 1994. Costs for rebuilding the clinic exceeded$200,000,
which was only partially paid by insurance. The clinic also was forced to operate for
six months in an interim site,where the number of clients reoelving family planning
services dropped by as much as 50%.
The increase in violence has left clinics defenseless unless costly upgrades to security
are made. Many clinics,in order to increase security,have had to take money from
direct medical services so that women have a safe environment in which to obtain
needed health care. The costs to clinics,to law locat law enforcement agencies and to
the women who rely on these clinics Is enormous. For this reason we are urging you
to support 5B 1290.
We are asking network members who live in State Senate districts 7 and 2, to contact
Senators Dan Boatwright(7)and Mike Thompson (2),members of the Democirattc
Caucus, urging them to continue support for this bill. Please contact them now
to show grassroots support for this Issue In the State Senate.

An act to add Section 1267.3 to the Health and Safety Code,
relating to health facilities.
LEGISLATIVE COUNSEL'S DIGEST
SB 1290, as amended, Hayden. Health Facilities Security
Fund.
Existing law provides for the licensure and regulation of
health facilities, as defined, by the State Department of
Health Services.
This bill would define `qualified women's health care
clinics" as entities that meet certain prescribed criteria,
includingthatatleast50% of the encounters at the facility are
female, and would provide that these clinics are eligible for
grants for security improvements. The bill would require the
3 department to award contracts for financial assistance, would
authorize the department to consider certain prescribed
criteria in awarding the contracts, and would require the
grants to be distributed on or before July 1, 1996.
The bill would state the Legislature's intent that fundingfor
the grants be appropriated in the Budget Act.
This bill would establish the Health Facility Security Fund,
into which unspecified General Fund moneys would be
deposited. It would require the department to administer the
fund for the purpose of providing grants to nonprofit health
facilities in order to improve the security in their facilities.

1 SECTION 1. Section 1267.3 is added to the Health and
2 Safety Code, to read:
3 1267.3. (a) "Qualified women's health care clinics"
4 are those entities that meet both of the following
5 conditions-
6 (1) Licensed as a community clinic pursuant to
7 paragraph (1) of subdivision (a) of Section 1204, on or
8 beforeJanuary 1, 1995, ora hospital or clinic that is owned
9 and operated by a county.
10 (2) At least 50 percent of the entity's encounters are
11 female, based on the "Annual Utilization Report of
12 Primary Care Clinics"filed with the Office of Statewide
13 Health Planning and Development, as the report exists
14 on the office's data base file as ofJune 1, 1995, or based on
15 encounter data compiled under the Medi-Cal program
16 (Chapter 7 (commencing with Section 14000) ofPart 3 of
17 Division 9 of the Welfare and Institutions Code).
18 (b) Entities that are qualified women's health care
19 clinics pursuant to subdivision (a) shall be eligible for
20 grants for sec uri ty impro vem en ts.
21 (c) The State Department of Health Services shall
22 award contracts through a requestforfinancial assistance,
23 pursuant to the State Department of Health Services
24 Cooperative Agreement Act (Division 2,52
25 (commencing with Section 38070)). Decisions regarding
26 priorities for funding may be based on, but need not be
27 limited to, all of the following factors.-
