1.64 RESOLUTION No. 95-52 adopted by the City Council, City of
Hercules, 111 Civic Drive, Hercule, CA 94547, regarding the
discontinuance of the residential surcharge for landfill closure
and its transition to the West Contra Costa Integrated Waste
Management Authority to temporarily offset Authority operating
costs; and
RESOLUTION No. 95-52A appropriating $21,738 from the Sewer Reserve
fund to the Sewer Fund and authorizing payment to the City of
Pinole for $571,738 as the City of hercules' fifty percent share
of the Digester Installation Project.

RESOLUTION NO. 95-52 CLERK BOARD OF SUPERVISO
CONTRA COSTA CO.
REGARDING DISCONTINUANCE OF THE RESIDENTIAL SURCHARGE FOR
LANDFILL CLOSURE AND ITS TRANSITION TO THE WEST CONTRA COSTA
INTEGRATED WASTE MANAGEMENT AUTHORITY TO TEMPORARILY OFFSET =
AUTHORITY OPERATING COSTS.
WHEREAS, the Residential Surcharge is a surcharge on rates levied for collection
and disposal.of waste placed in cans for collection by Richmond Sanitary Services, Inc.
(hereinafter "RSS") from within the Cities of Hercules, Pinole, Richmond and San Pablo
and the unincorporated area of West Contra Costa County (hereinafter "Residential
Service"); and
WHEREAS, RSS disposes of Residential Service waste at the Class II Unit of the
West Contra Costa Sanitary Landfill (hereinafter "Landfill"); and
WHEREAS, the amount of the Residential Surcharge is based upon the Landfill
Closure Costs and Post Closure Costs and the costs of compliance with regulations which
govern the disposal of waste at the Landfill and which became effective during and after
1985; (hereinafter "Regulatory Costs"); and
WHEREAS, the West Contra Costa Integrated Waste Management Authority
(hereinafter "Authority") is charged with the responsibility for making recommendations
regarding the Residential Surcharge; and
WHEREAS, the Authority has reported that on July 11, 1991, the Authority
recommended that the Residential Surcharge be increased to the currently effective rate.
of $2.02/can per month; and
WHEREAS, the Authority has reported that the amounts to be funded at the time
of establishment of the current Residential Surcharge rate on July 11, 1991 have been
collected by RSS via the Residential Surcharge; and
WHEREAS, the Authority advises that RSS reports that Residential Service waste
constitutes twenty five percent (25%) of the total waste received at the Landfill during the
period.1985 through 1993, excluding waste which does not occupy space in the Landfill,
received, at the Landfill during the period 1985 through 1993; and
WHEREAS, the Authority reports that twenty five percent of the total Closure, Post
Closure and Regulatory Costs identified in the Final Closure and Final Post Closure Plans
will have been collected by RSS in April 1995; and
WHEREAS, the Integrated Resource Recovery Facility (hereinafter "IRRF") is
expected to begin commercial operation during the period between October 1, 1995 and
December 31, 1995 and the IRRF Service Agreement and the contract between Contra .
Costa County and the Authority dated May 25, 1993 (hereinafter "Authority - County

Section 5. RSS is hereby directed to notify affected ratepayers of the
discontinuance of the Residential Surcharge in billings to residential
service ratepayers effective July 1, 1995.
Section 6. Funds received by the Authority as a result of this Resolution shall
be used in accordance with operating budgets approved by the
Authority Board of Directors.
Section 7. This Resolution shall be immediately effective upon adoption by the
Hercules City Council.
Section 8. A certified copy of this Resolution shall.be transmitted to the West
Contra Costa Integrated Waste Management Authority, the Cities of
Pinole, Richmond and San Pablo and the Contra Costa County
Board of Supervisors and Richmond Sanitary Service, Inc.
The foregoing Resolution was duly and regularly adopted at a meeting held on the
9th day of May, 1995 by the City Council of the City of Hercules by the following vote of
the Council:

RESOLUTION NO. 95-52A
ADOPT RESOLUTION APPROPRIATING $21,738 FROM THE SEWER RESERVE FUND
TO THE SEWER FUND AND AUTHORIZE PAYMENT TO THE CITY OF PINOLE FOR
$571,738 AS THE CITY OF HERCULES' FIFTY PERCENT SHARE OF THE DIGESTER
INSTALLATION PROJECT.
WHEREAS, the City of Pinole and the City of Hercules share equally the total
capacity of the 4.0 MGD Wastewater Treatment Plant, and
WHEREAS, the 1990 joint study of , the Plant revealed specific capital
improvements required in order to maximize the ability to utilize the Plant's capacity,
and
WHEREAS, ,the 1990 recommended improvements and constrained capacity are
partially the result of"long term drought Conditions and a change in living standards
leading to more concentrated solids that plant design originally anticipated, and
WHEREAS, the City of Hercules presently needs access to its full 2.0 MGD as
provided through its contracted.relationships with the Plant's owner and operator,
the City of Pinole, and
WHEREAS, $250,000, is budgeted in FY 1994-95, $350,000 is contained in the "
proposed sewer budget for FY 1995-96 for the Digester Project and funded within the
$196 annual per household charge and $21,738 to be appropriated from the Sewer for
a sum total of $571,738, and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Hercules appropriates $21,738 from the Sewer Fund Reserve and authorizes a
payment to the City of Pinole representing fifty percent of the total project cost, not,
to exceed $571,738 to be paid proportionately consistent with the .contractor's
progress payments, and
BE IT FURTHER RESOLVED that Phase Four improvements to the Aeration
System will be fully and mutually reviewed and discussed by both Cities in advance
of the bid process.
The foregoing Resolution was duly and regularly adopted at a meeting held on
the 9th day of May., 1995 by the City Council of the City of Hercules by the following
vote of the Council:
