I. Recommended Action:
ADOPT Ordinance which changes the time of collection of the Area of Benefit Fee from the final
map to the issuance of the building permit.

III. Reasons for Recommendations and Background:
On April 18, 1994 the Transportation Committee recommended that the Board of Supervisors
approve the Eastern Contra Costa Sub-Regional Transportation Mitigation Fee (ECC Fee) with
the time of fee collection set at the issuance of building permits. It was also recommended that
the time of fee collection for all Areas of Benefit be changed from filing of the parcel or final map
to issuance of building permits.
This item was brought before the Board on March 14, 1995 and was referred to the Transporta-
tion Committee. On May 2, 1995, the Transportation Committee reiterated its recommendation
that the fee collection for all areas of benefit be done at the time of issuance of building permits.
Although delaying the time of payment may delay somewhat the timing of project construction,
the Committee expressed the desire to facilitate development in this difficult economic climate.

Measure C requires prescribed levels of service to be maintained on most roadways. In order to
maintain these levels of service it is necessary to construct roadway improvements in a timely manner
as new trips are added to an area. Supervisor Torlakson expressed that as a policy, capacity
improvements should be constructed as the impacts occur. This can be accomplished through the
conditions of approval for the subdivision or land development that impacts the transportation system.
If appropriate, the developer may enter into a reimbursement agreement with the County so that the
County may collect monies from subsequent impacting development on behalf of the first developer.
