SUBJECT: Graffiti Abatement
The Board of Supervisors considered the recommendations presented
by Supervisor Rogers relative to a proposed graffiti ordinance and
graffiti abatement in selected redevelopment project areas (S. 1 and
S.2 respectively) . The referenced documents are attached and
included as part of this document.
At the conclusion of the Board's discussion, it ORDERED that the
entire matter is REFERRED to the Contra Costa County Youth
Commission, the various Municipal Advisory Council and Project Area
Committees, and the City County Relations Committee for review.
It is further ORDERED that the County Administrator is REQUESTED to
report to the Board on the issues of graffiti prevention, including
the possible development of a graffiti prevention ordinance,
cooperation with other agencies in graffiti removal, the use of
persons doing community service in graffiti spotting and removal
and the use of murals to prevent graffiti.

SUBJECT: GRAFFITI ABATEMENT IN SELECTED REDEVELOPMENT PROJECT AREAS

RECOMMENDATION:
DIRECT the Deputy Redevelopment Director to prepare and return to
the Board for the Board' s further consideration a policy statement
which gives priority to the use of redevelopment agency funds to
abate on a one-time or periodic basis graffiti in project areas
where graffiti is a significant problem.
BACKGROUND:
One of the most obvious "blights" in many of our redevelopment
project areas is graffiti . We understand that it is possible to
use redevelopment funds to paint over graffiti on a .one-time or
periodic basis . We believe that in those redevelopment project
areas where graffiti is a substantial problem, the Board of
Supervisors should indicate that priority should be given to the
use of redevelopment funds to abate graffiti within the project
area.
Therefore, we are recommending that the Board direct that staff
prepare and return to the Board for further consideration a policy
statement which would give priority to the use of redevelopment
funds to abate graffiti in project areas where graffiti is deemed
to be a significant problem.

1. DIRECT the County Counsel to draft an orcrinance to implement
Government Code §§ 38772 and 38773 . 6 in Contra Costa County,
providing for the summary abatement of any nuisance resulting
f rom the defacement of property by graf f iti by a minor, making
the expense of abatement a special assessment against the
property of the minor and providing that the parent or
guardian of the minor is jointly and severally liable with the
minor and providing that the assessment may be collected along
with other taxes and assessments on the property.
2 . . DIRECT the Deputy Redevelopment Director to prepare and return
to the Board for the Board' s further consideration a policy
statement which gives priority to the use of redevelopment
agency funds to abate on a. one-time or periodic basis graffiti
in project areas where graffiti is a significant problem.
3 . STUDY whether asking retail stores to voluntarily limit the
bIt-04• -tipped markers ' availability on display would help
prevent theft ..problems.
4 . REQUEST the Public Works Director and Director of General
Services to identify and designate appropriate sites on
county-owned property in the unincorporated area of the County
which could be used for creating murals .
5 . ENCOURAGE the schools and art programs in the County to
develop and implement a program whereby young people can be
provided areas designated as above which can be turned into a
mural, thereby providing a constructive outlet for the
artistic talents of the "taggers" .

6 . DIRECT the County Administrator to develop a "graffiti
spotter" program emphasizing the use of workfare and community
service volunteers to identify graffiti and report it to a
central point from which an appropriate response can be
initiated, either to cover up the graffiti by painting over it
or implementing the "nuisance abatement" procedures .
7 . REQUEST the Youth Commission to identify graffiti abatement
programs which are in operation elsewhere which might be
implemented in Contra Costa County at minimal cost and report
their findings and recommendations to the Board of
Supervisors .
8 . REQUEST each Municipal Advisory Council in the County to study
the issue of graffiti within their jurisdiction and provide
their advice and recommendations to the Board of Supervisors
regarding what action should be taken to address the graffiti
problem.
9 . REQUEST each Redevelopment Project Area Committee in the
unincorporated area of the County to study the issue of
graffiti within their jurisdiction and provide their advice
and recommendations to the Board of Supervisors regarding what
action should be taken to address the graffiti problem.
10 . REQUEST the City/County Relations Committee to discuss the
issue of graffiti and provide the Board of Supervisors and
Mayors ' Conference with their comments and advice regarding
what action should be taken by city councils and the Board of
Supervisors to address the program of graffiti in this County.
BACKGROUND:
Graffiti is a significant and growing problem in our community.
State legislation provides us some tools which we can use where we
know the identity of the minor who has created the graffiti . I
believe we should use those tools to declare graffiti to be a
nuisance, to provide for the summary abatement of graffiti as a
nuisance and provide that the costs of abatement and related
administrative costs can be collected along with other property
taxes on the property belonging to the minor or his or her parent
or guardian.
In addition, I think we should also identify suitable sites on
which murals can be created and then ask the schools and art
programs to develop a program whereby those designated areas could
be used by young people to paint a mural instead of "tagging" other
people' s property with graffiti .
It would also be helpful to have a program where our workfare and
community service crews could be on the lookout for graffiti and
could have a telephone number which could be called to report the
graffiti . Appropriate abatement action could then be initiated,
either by painting over the graffiti or taking other appropriate
action.

I would also like the Youth Commission to identify graffiti
abatement programs, either in this County or elsewhere, which they
believe are effective in reducing or responding to graffiti and
which do not cost much money to operate and bring these programs to
the attention of the Board of Supervisors, along with their
comments and recommendations for actions which should be taken by
the Board of Supervisors .
Finally, I am recommending that each of our Municipal Advisory
Council, Project Area Committees and the City/County Relations
Committee be asked to provide us their comments and recommendations
for actions the Board of Supervisors and city councils might take
to more effectively address the problems of graffiti in our County.
