Find that the mitigated Negative.Declaration (January, 1995) for the West Contra Costa Sanitary Landfill Soil Remediation Facility was prepared in accordance with the California Environmental Quality Act, and affirm that the Board of Supervisors has reviewed and considered the Negative Declaration before acting on LUP 2043-94. 2. Accept the report of the Director of Community Development noting the results of a meeting between the Public Works and Community Development Departments with the North Richmond Municipal Advisory Council on items referred by the County Planning Commission. 3. Concur with the County Planning Commission, and the Community Development Department, that the use of metal buildings (a finding called for by the North Richmond Shore ne Plan) by the Soil Remediation Facility is not only appropriate but preferred. Approve Land Use Permit 2043-94 as recommended by the County Planning Commission with the conditions set forth in document entitled Amendment Document, Conditions of Approval, Land Use Permit 2043-94, West Contra Costa Sanitary Landfill Soil Remediation Facility, dated May 9, 1995, with Initial Development and Improvements Plan schematic drawings and including the First Source Hiring Agreement condition added by the Commission. 5. Direct the Community Development Department to file a California Environmental Quality Act Notice of Determination on this approval. FISCAL IMPACT The costs of developing and operating the Soil Remediation Facility will be borne by the permittee. The permittee also will pay for the costs of regulation by the County. BACKGROUND AND REASONS FOR RECOMMENDATION West Contra Costa Sanitary.Landfill, Inc., proposes to add a Soil Remediation Facility to the uses allowed in the Bulk Materials Processing Center by the terms of Land Use Permit 2054-92 (approved by the Board of Supervisors in 1993). The Bulk Materials Processing Center is to be located on the West Contra Costa Sanitary Landfill, owned by West County Landfill, Inc., on a portion of the landfill situated in the unincorporated area of the County. The Bulk Materials Processing Center (for wood chipping, concrete crushing, and soil enhancement) along with an associated composting facility on a portion of the landfill in the City of Richmond, are components of the Integrated Resource Recovery Facility (IRRF) approved in 1993 to serve West County. Other components of the IRRF, including solid waste transfer and materials recovery, are situated at the Central Processing Facility (under construction) located a mile to the east. Both the West County cities and the County (representing the western unincorporated area) will depend on the IRRF to help meet the recycling goals of AB 939. The West Contra Costa Sanitary Landfill, Inc., and the West County Landfill, Inc., are companies affiliated with Richmond Sanitary Service. The project would be operated by TPS Technologies, Inc. The Soil Remediation Facility would treat petroleum contaminated soils (within specified limits)through a thermal process to produce a soil product usable for fill and other applications. Because the landfill's adjoining Class I Hazardous Waste and Class II waste disposal areas are about to undergo closure, it is intended that the output of the Soil Remediation Facility for the next several years would be used for landfill cover materials. Subsequently, the product would be sold to other users. The Soil Remediation Facility would be placed on an approximately 3-acre portion of the Bulk Materials Processing Center. It would consist of an office building, a 260' x 120' metal storage building for contaminated soils, a maintenance area, a thermal desorption (processing) plant, a treated material storage area, and a treated material pick-up area. The Soil Remediation Facility is expected to process about 600 tons of contaminated soils on a typical day (about 150,000 tons per year) and would be limited by the terms of the Land Use Permit to the storage of 20,000 tons of untreated material. It is expected that the facility would receive about 30 loads a day, although the permit would allow up to 150 loads on a peak day. The Mitigated Negative Declaration prepared for the Solid Remediation Facility demonstrated that all of the potentially adverse impacts identified in the Initial Study would be either insignificant or mitigated to insignificant levels by measures included in the project. The North Richmond Shoreline Plan calls for, architectural reviews of proposed metal buildings in the planning area (to avoid unappealing designs and finishes). The County Planning Commission and staff concluded that the facility's use of metal buildings was "preferred" for reasons which included enabling the building to be adjusted to landfill settlement (or moved, if necessary). The County Planning Commission directed the Public Works and Community Development Departments to meet with representatives of the North Richmond Municipal Advisory Council to discuss issues of local employment, noise, and traffic mitigation. The meeting was held on March 29, 1995; a report is included in the documents packet. It resulted.in the letter of April 10, 1995, from the Chair of the Council to the Community Development Department. Both the documents to be approved (the Negative Declaration, Conditions of Approval in addition to this Board Order) and informational documents that are part of the record have been transmitted to the Board under separate cover. H EB/CAZaw RCZ4/WCCSLSRF.bod ADDENDUM TO ITEM H. 3 May 9, 1995 This is the time noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the Contra Costa County Planning Commission on the application of the West Contra Costa Sanitary Landfill, Inc . , (applicant) and the West County Landfill Inc . , (owner) for approval of Land Use Permit 2043-94 (which is an amendment to Land Use Permit 2054-92) to allow the development and' operation of a Soil Remediation Facility which would use a thermal processing system to treat soil contaminated with petroleum hydrocarbons in the North Richmond area. Dennis Barry, Community Development Department, introduced Mr. Charles Zahn, Community Development Department, who presented the staff report and recommendations on the proposal . James Kennedy, Redevelopment Director, spoke on the first source hiring condition, Section 6, Subsection 16, and he requested that the condition be clarified to indicate that the permitee shall enter into a first source hiring agreement with the County for the soil remediation facility. Don Murashima, representing TPS Technologies, presented an overview of the proposal and the steps in the process of treatment proposed to be used. The public hearing was closed.
